We now find ourselves in a very tough and stressful situation.  This is potentially forcing us to leave our home of 8 years, through no fault of our own.  

We originally bought our home 2007 and placed it on our children’s property. (at 6023 Windy Ridge Rd, Shingle Springs, CA) We were hoping to help raise our new granddaughter, and to be there for their support. Unfortunately our children divorced two years ago.  Our daughter and granddaughter moved off the property, leaving the ex-son-in-law to control his home and destiny.  He was terminated from his employer 2011 and hasn't held a steady job since.  Though we retained council and assisted in securing him a mortgage modification in 2013, (with OCWEN Mortgage) he defaulted again approximately 12 months ago.  In fact his mortgage was already in foreclosure proceedings, and we were not even made aware of this until June of this year!  When confronted, he told us not to worry; that he would obtain the money to catch up on his payments. (Approx $30K)  Unfortunately that did not happen, and his property (which our home sets on) is being sold via trustee sale. (if it is not already sold)

*Furthermore, the mortgagee for this property/OCWEN is using our home and site improvements, in their overall increased valuation of the property!  *We live here via a temporary family medical hardship permit with El Dorado County.  Any new buyer will not have the use of this permit; we cannot remain here if the property owner is not “familyEl Dorado County will force the property owner to move the home/our residence from their land. (and we will be forced off the property)  *I have confirmed this with the El Dorado county planning dept/apn: 091-08028-200.  The real property @ 6023 Windy Ridge Rd is being sold by Trustee Western Progressive LLC. (TS No.: 2014-07982-CA)  We have our own address which is 6021 Windy Ridge Rd.

We have been advised by our attorney, that it is possible OCWEN Mortgage could try and claim that our home actually belongs to their property, as it is attached to it.  Furthermore, our own Mortgage Co. (21st Mortgage Corp) would have the legal right to demand payment; even attach our paychecks to collect payment, on a residence WE CANNOT LIVE IN.

*We have over $100,000 in cash invested here. (Excavation, utilities, septic, 60 ft. deck, garage, front porch, well upgrades…)  We put everything we had in this property, and now potentially find ourselves threatened with an eviction notice, and a beautiful home we CANNOT live in.  We no longer have the cash needed to relocate this home, nor the set up costs involved to purchase another property for it.  Believe us, this was NEVER our intention: I have worked for 47 years and never collected unemployment!  We have always done things the right way. 

*FHA and conventional lenders both, no longer offer financing to relocate manufactured homes.  It would cost $30,000 to dis-assemble, move and set up our home again; not including cost of land, site costs, utilities etc.  Our own mortgage company (21st Mortgage corp) will re-finance to include these new costs; but ONLY with us paying a new $11,162 broker fee and 8% loan interest; which makes a $235K mortgage cost us over $2000 a month... with traditional rates of approx 4% these days.  We can not pay this, nor should we be forced to... the only option is to just "walk away" from our beautiful home and default on the mortgage.  We are not made this way and desperately want to do the right thing.

We feel we are being ripped off by BOTH of these giant Mortgage Corps. (not to mention our ex son in law)  We feel desperate and without hope.  At 64 years old I should be ready to retire; not faced with this this impossible struggle.  We are looking for ANY options, advice or someone to turn to.

How are they ripping you off?

You say that you are in this situation by "no fault of your own".

Okay, say that is true.  The fact remains that you are on the propety of someone who failed to pay their mortgage and therefore are being foreclosed on.

Do you want them to ignore that and just let you remain on the property because you put a mobile home on it?  In other words you want to become a "squatter".  Because this may be an assumption(but I have a feeling I am right on) that you were not and are not paying any sort of "rent" on the land you are on. 

The 100K in upgrades, yes is going to be added to the value of the property.  It doesn't matter who paid for them. 

Have you(or do you plan) on talking to the new owners to see if they can let you stay on the land?

Look I do feel for you, and keeping in mind that it was your Ex Son-In-Law who failed to pay the bills.   I am just a bit confused as to what you want to happen.
