My mortgage was sold to Ocwen in the summer of 2009 from another company. Ocwen immediately began calling me, not even telling me who they were, but asking me for my social security number. Of course I would not give it to them without knowing who it was. They continued to call 10 plus times a day before I did finally inquire what they wanted. Their English is broken (they are Indian) and they could barely get out what they wanted. I am hard of hearing as it is so I asked them to converse with me through mail. They began sending me notices that my mortgage wasn't being paid. It was being paid and to their address, in their envelopes, and checks were being cashed. Then they began stating that insurance wasn't on the house. It was and my insurance agent faxed them numerous times the policy. Then they stated that there had been a lapse. There was no lapse, again, the agent tried to speak to them but they refused to listen. Now, they say that we have several late payments on the account, when really we don't. This is effecting my credit and I am very, very concerned. In October we received a notice that we had an excess amount in escrow and so they were reducing our payment. The next week, we got another notice saying that we would get a check for excess escrow. The next week we got a notice saying that our payment was going up because we had no escrow. I have piles and piles of paperwork and never know from one month to the next what my mortgage is, even though it is a fixed mortgage rate. I feel like I am living in a mortgage nightmare and in all of my 50 plus years have never experienced such a fright. I even tried to refinance just to get another company, but with the economy in such turbulant time, it is pretty much not going to happen. Every night I just pray that my mortgage gets sold.

Your mortgage servicer, OCWEN, is notorius for doing exactly what they are doing to you. Your best bet is to get an attorney, a good real estate attorney and file a Qualified Written Request (QWR) with OCWEN. You can file one without an attorney, but OCWEN is known for ignoring consumers. You will find a good template for a QWR on the web. Make sure it is extremely detailed - they must respond to the request. If you have an attorney that knows what they are doing (not all do!) you could also receive damages from OCWEN.

The option most people don't know about is have the paper work put through a forensic analysis.  There is one company that has certified mortgage loan auditor that provide a complete audit based on your states laws and even municipality ordinances.

They are Endless  Fraud Detection and can be found by adding a com on the end of the name.  This can even include all the litigation support paper work that any lawyer will need to file in court when the violations are identified.  Many are so egregious that the law requires the return of all money as the contract can be considered void from the very beginning.  It is not if you defrauded, but by how much? 

I have seen one the audits and it is impressive and I have researched many audits and these are the only one that provide a level of service where your lawyers work is 90% done.  They even have a radio show and the links can be found at the top of the home page.  Listen to the Dec 3 and 17 show on the rule of law website and you will hear one of their clients talk about his audit and his 17 violations, 11 of which are recindable which means the return of monies as the contract was void from the beginning.  It only takes one recindable item to make it void.
