 I have had a mortgage with OCWEN for over 5 years. I have an escrow account that pays my taxes and homeowners insurance. My homeowners policy was due in August. I recieved a letter from State Farm stating that OCWEN did not pay my insurance.

I called State Farm and they said " OCWEN sent a lump sum check for over $400,000.00 . It was payment for over 300 clients in one check. State Farm returned the check to OCWEN.

I called and explained the situation to the insurance department (1866-825-9265) They assured me a check was being sent over night. They even called my State Farm agent to let her know they were paying.

That was September 15th, 2014.

Today October 24th I recieve a letter in the mail that states OCWEN's check did not clear through the bank.

Really ?

So I call OCWEN they again for the second time say we will overnight the check.

They even call my State Farm agent again.

Just seems crazy that OCWEN has my insurance money in an escrow account and the check bounces ?

Wonder where my money is?

If i write a check that does not clear I get charged with a crime. How can they get away with this?

Be very careful here with this insurance payment

First of all, OCWEN is known for doing this exact thing - not paying the insurance out of your escrow. Why? The most common reason is to then say your insurance is unpaid and they will put "FORCED PLACED" insurance on your home. Forced placed insurance is extremely high cost insurance. The lender participates in the profit from the forced placed insurance, plus the lender can then begin foreclosure proceedings on your home for non-payment of insurance (even if they were supposed to pay it out of your escrow).

This is your remedy:  1) pay the insurance payment directly to your insurance company immediately so you are not without insurance 2) Get a copy of your payment to the insurance company and a receipt from your insurance company that it is paid 3) Write a letter to the insurance department of OCWEN notifying them that you paid it and include a copy of the proof of payment for your policy. Make sure the policy number and address are on the payment made (as well as your loan number). Request reimbursement from your escrow for the insurance payment.  If they don't comply then 4) report them for a RESPA violation (look it up) and then 5) take OCWEN to court for reimbursement. 

Be very careful. OCWEN routinly uses non-payment of insurance to begin foreclosure even when it is their responsiblity to make the payment from your escrow account and you have enough funds in the account. Don't let too much time pass by or it will be extremely difficult to recover from the foreclosure. OCWEN has their own real estate auction company that they partner with to auction off the foreclosed properties - so this is a win-win for them.

You have to be very proactive to get this taken care of immediately.

Once it is completed, then refinance with another lender if at all possible. OCWEN is one of the worst mortgage servicers in the country.

Same issue with hazard insurance

OMG.  Reading the report from Paula in Massachusetts is like reading my story with the hazard insurance.  I have been hasseled so much this year about insurance.  Same problem.  Letter from San antonio office saying my insurance was cancelled.  Big lie.  Sent two letters in past two months providing proof and my insurance agaent did the same.  They are ignoring me.  Not only on this issue but the forced escrow of property taxes.  In Texas if you are disabled you can pay these taxes in installment.  On june 10, 2014 ocwen did a tax back search.  Those taxes were due on July 31, 2014.  They violated my rights as a disabled person by stepping in 1 1/2 months early.  In 7 yearsbthis has never happened but this year it did?  Why?  Because they are finding new ways to rob customers and make it impossible to make payments.  What they have done to me and 1000's of others is criminal.  This forced placed escrow more than doubled my monthly payment.  My tax payment is about $280 a month and now ocwen has it at $630.  There is no way it is legal for them to try and make me pay over $4,000 more than what the county says I owe.  They also stole my rights for having a dp exemption on my property.   

I recently filed a complaint with the CFPB and now an Ombudsman is reviewing the complaint.  My hopes for any fairness were quickly dashed when I found out this person is employed by Ocwen.  My understanding was this person is an advocate for consumers who have been wronged.  I actually got to speak to an American.  I stated to this guy that I ddon't see how I will be treated fairly if you work for them.  He said of course our interest is to protect ocwen but we have to comply with the rules of the CFPB.  I'm thinking sure you do.  I let him know I had been doing tons of research.  I came across the Ocwen Consent Settlement from December,  2013.  Basically, it's a judgment that involves the CFPB and 49 states.  It outlines all of the charges against them and the rules they must comply with.  When you see the charges every customer that has made complaints anywhere online has been a victim to some or all of these charges.

I got two letters from Raquel Ruben who supposedly is the advocate assigned to my complaint.  The first letter has the Orlando address at bottom of the letter but the envelope says West Palm Beach. This is odd.  The second letter has same addresz at bottom of letter but envelope says Waterloo, IA.  Both letters with same date from same person.  No one can be in both places and the context was very different and as usual misleading.  One letter says they are still reviewing and will have an update on December 6.

They are ignoring the loan mod documents I reluctantly sent in as this process is a joke.  I get a copy of a document I've never seen regarding the denial of my loan mod request.  Almost 4 years ago I applied and was never told why I was denied.  They send me document dated july 5, 2012 stating I was denied and the letter says I hadn't sent proof of unemployment benefits.  I wouldn't have sent that info because I have never applied for unemployment.  It's obvious this is a fraudulent document.  The date of letter doesn't fit the timeline and I was denied for something that didn't apply to me.

My advice is to complain at any government office or bureau.  The CFPB, BBB, FTC,  State Attorney General,  Elizabeth Warren, etc.  Check out housingwire.com and check out Benjamin Lawsky.  He's after Ocwen.  Be sure to look up Ocwen Consent Settlement
