Won 2000 BMW from Paul Miller BMW they offered for sale on Ebay on August 6, 2006. Stated that car had been checked out by their expert service staff and was in great condition with top notch suspension. They noted and photographed (up-close) scratches on back bumper and trunk. I had the car transported to NC.

What a surprise when I received it on August 17th!! Front bumper was dented in 2 places to the point that one of the front grills fell out when I put the car in reverse (they blamed the transporter for this but he photographed the car on the lot before picking it up), the wires on the tires were exposed on all tires, the windshield cracked, air conditioning does not work, passenger power windows do not work, just to name a few.

Had a real expert mechanic check it out and mechanical repairs totaling $3500.00 have to be done such as: Both lower control arms and bushings, rear shock absorber mounts, both lower bumper grills, r/f fog light assembly, front brakes, pads and rotors and the list goes on.

Contacted Lou Alimi and Ryan Brock at Paul Miller BMW several times and all I got was "You purchased the car AS-IS". Funny that nowhere in the ad did it say this, in fact it listed that "Extended Warranty Available".

What a ripoff!! Expert service staff?!?! I am a woman who knows nothing about cars beyond pumping gas and I could see the cracked windshield, no inspection sticker, no a/c and bald tires!!

BUYERS BEWARE, do not believe descriptions on these vehicles and be sure you can drive to New Jersey with your mechanic to check it out thoroughly! By the time I get through with all the cosmetic and mechanical repairs I will have more than half of what I originally paid for the car and their attitude is "You believed our lies and bought it, now it's your problem".

Why would anyone buy a car on ebay, not only sight unseen but not seen by a certified mechanic? I'm not surprised that you were ripped off. You've heard the old adage about believing a used car salesman. He wouldn't be able to rip off people if no one bought his cars. We would all like to believe that people don't lie and we won't have problems in certain situations, but the opposite is true. If his "customers" used more caution, he'd be out of business. I hope you make out well with your claim. Perhaps small claims court?

You have all your ducks in a row, and that's rare. I am glad that you won't rest until this is resolved. I hate to see people taken advantage of on Ebay when buying a car. I myself have had only 1 problem, but it miracuously worked out for the best.

However, I sell classic cars on Ebay all the time, and have a spotless rating, usually people say the car is much better than described, because I am HONEST about the cars I sell. It burns me to no end to see people, especially dealers, lie about their cars and cheat the bidders!

By the say, did you check his feedback rating, and did you leave him bad feedback?

Paul Miller BMW in Wayne, NJ Filed complaint with Ebay

Before filing a complaint here, I filed a complaint with Ebay, who informed me that undisclosed mechanical damage is limited to $1500.00 per defect and only includes engine, transmission and frame damage.

The only thing ebay did was contact the dealership to initiate a resolve and was told by Ryan Brock "manager" of PMBMW that the listing noted all factory options, not whether they worked or not. He was also told that their ebay selling privileges could be suspended or revoked and Ryan replied "I don't care".

They are still offering cars for sale on ebay but have added in bold letters that "This vehicle is being sold mechanically and cosmetically AS-IS" to each listing, which actually adds even more credibility to my claim.

I have copies of everything having to do with this transaction, the entire description printed from my computer, photos, the letters of complaint to and from ebay, all quotes, etc. I have filed complaints with the NC and NJ Attorney Generals' offices, have an appointment with an attorney in 2 weeks and the inspector with the NCDMV will be here Monday to see the car.

I AM and WILL continue to do everything in my power to see this resolved.

File a dispute with Ebay

IF the seller stated the condition of the car as you say, then file a dispute with Ebay. Make sure you have a written copy of the mechanics inspection, and pictures of the car when you received it, a copy of the bill of laden from the transport company, and a copy of the ebay ad. Print the ebay ad out as a precaution.

Also, file a complaint with the AG's office both in North Carolina and New Jersey, as well as the DMV in New Jersey. Don't sit there and take it, do something!!!!
