In September of this year I hired Phillip Tolk to write a script for me. He charged me $500. I paid him in full. The script did not work well but I made do with what I got.  About a month after I paid him, the script STOPPED WORKING. I repeatedly called, emailed, and text messaged him until he finally responded. He told me that his partner had the passwords to their website and that  his partner was on his honeymoon, so there was nothing he could do until his partner came back. I was out of business for about 21 days before Phip Tolk finally fixed the script. About two weeks ago he charged me an additional $100 for an upgrade - I had asked for the feature (download the data into a CSV comma delimited file and an up-loader to broadcast my sales message) in the original plan.  Five days ago, the script STOPPED WORKING - AGAIN - DOING THE EXACT SAME THING IT WAS DOING THE LAST TIME IT STOPPED WORKING!  This time he blamed it on my hosting service. My hosting service said that the only change was a security update which  goes nowhere near the script's code. My hosting service made copies of the error messages.  I am not an experienced programmer so I do not know how to fix it. This morning I made it clear that I depend on this script to make a living.  His response was "120/hour. How many hours am I approved for?"  I plan to sue Mr. Tolk.

Dear Dan,

I am taking the time to respond to this claim because I am in the same industry - computer /software development, and find this complain both unreasonable and slanderous.

First, mere $500 was paid for the script. And in an industry where costs are counted in $100K or in millions, this is basically "free" work. Especially when all the headache and problems it has caused.

Second, it worked fine for a month. One good thing about computers is they will do the same thing over and over again, until end of time - or until something changes. In this case, since the script worked for a month and then it suddenly broke, it goes to reason that the cause was not Mr Philip's doing. Most likely it was an environment change (probably with your hosting provider).

Third, Philip seems to have resolved the issue without additional cost. It seems that he resolved the issue as soon as he had access. It appears that he did not charge you, but would have been completely in his right to do so because this was additional work. 

Fourth, additional work is not free. When you wanted updates and changes Mr. Philip made the changes at a reasonable cost ($100). It's beyond unreasonable for you to expect him to work for free.

Fifth, change of scope was quotes in advance. When you wanted scope changes it seems that Mr. Philip quoted you a fair hourly rate ($120/hr.) and asked for budget ("how many hours do I have"?). What is your issue with this?

 

It appears that you are not accustomed to dealing with software development, and have gone out of your way to be unreasonable in your demands. Worst yet, you have slandered someone on the Internet to a point where a search for his name brings up this results at the top.

This is incredibly irresponsible. You should either take this post down or sue him at a court of law (as you have threatoned) so a judge could throw this case and you out of the court room for wasting her time.

 

If you want cheap developers then I suggest you find a lower cost/off shore/remote developers to help you.

PS: I have never met, nor do I know Mr. Philip Tolk in any form. But I took the time to defend him because this seems like an unreasonable and unwarranted attack on a fellow developer.

Anyone that reads this can see that there are dubios details left out. The script was written, in operation, working and then a month later it stopped working. What changed? Was it running on faulty hardware or was other data/structures it was interacting with change? Was that the original script creators responsibility?

And then you paid him again for an upgrade. And now you complain again because whatever happened happened again and the script no longer works? Sounds like you have other things going on and that conditions need to be adjusted from time to time in order for it to operate.

Anyone that does SEO knows that the conditions, rules and data structures are always changing and that it needs to be maintained.

You expect a guy you pay to do a few hours progamming to be available 100% of the time and have all your data available on call. Did you pay a retainer fee for that or are you just wishing in the cloud somewhere? Please anyone reading this that knows anything about software and development will understand this report is bogus!

PS I am not sure but isn't threatening to sue and not even having a case legally considered to be slander?
