My 84 year mother is suffering from a variety of medical problems, severe heart condition, mesial phenomia, poor circulation in the extremities, type 1 diabetic and goes on. at the recommendation of her vascular specialist we researched walk-in tubs and had a representative of Premier at my Mothers house.

After the salesperson took measurements to be sure the tub would fit, he proceeded with his sales pitch. At the conclusion  of his presentation we discussed options for equipment and methods of payment.

My Mother selected a specific model, the sales person made a phone call to the "main office", after which he informed us the tub we selected was not in stock and would take approximately four weeks to be delivered to my Mothers house. After agreeing to a price, the sales person required us to provide him with a 1/3 deposit, $5,000, which we did.

Three days later we received a call from our financial advisor about ours losses in the market, this was late Friday, Monday we called Premier and cancelled the order. They refused to refund the deposit but would apply it to a future purchase.

Response from Premier

AUTHOR: Melissa allman - (U.S.A.)

POSTED: Wednesday, July 07, 2010

I am writing on behalf of Premier Care in Bathing (Premier) with regard to this complaint posted on your web-site. Pursuant to our contract, as well as state and federal laws, customers can cancel their contract without penalty within three business days. The customer must send a certified letter to Premier postmarked by the third business day.

Additionally, pursuant to the contract, should the customer cancel outside the mandated three day cancellation period, they agree to forfeit a portion of the total contract price. However, as a gesture of goodwill, should the customer choose to move forward with their contracted purchase, Premier will provide them with a credit in the amount of the forfeited deposit toward their purchase.

Sincerely,

Melissa Allman

Take them to court!

AUTHOR: Inspector - (USA)

If you did not sign anything that states that the deposit is non-refundable, I would sue them.  If no work was done then, I'm sure you will get your deposit back and court costs.  They don't think you will sue.  Drama aside, this is a slam dunk case.

I was considering this company and thank you for the warning.  I won't be doing buisness with them.
