pro enviro scapes, llc rockaway trucking llc delivered and dumped wrong size of land scape gravel, called them, talked to james arellano, he told me that he would have to charge me extra to pick up gravel rio rancho New Mexico

I  had ordered other loads of gravel from this company, never had a problem, i had ordered the 1-  1 1/2 size gravel once already, so i went by and ordered  13 tons of the same size gravel, and asked for the same narrow dump truck and a different driver if possible, being that  the last driver had damaged my wood fence, the next morning they show up with the wider truck and same driver, that doesn't know how to back up in narrow spaces, he tried several times, hitting my fence three times, finally i told him to dump it where he was, at the  edge of my  entrance to the back yard where he was to dump it. being that the dump truck bed was higher than i could see, he started to dump it, i imediatly told him it ws the wrong size gravel. he said it was too late. I called mr.james arellano , the owner and told him what the problem was, he asked me what i wanted to do about it, i told him to come and pick it up and bring me the right size of gravel, he told me he  would have to charge me to pick it up. i tried to call him two times in the following  days and left a message, he never called back

Response to report against Rockaway Stone and Pro Enviro Scapes, LLC

In response to the report filed against our companies, please read and understand the following:  The individual who filed the report is upset because we were unable to send the truck and driver he requested.   Unfortunately in this business, we are unable to cater to specific requests for certain drivers and or delivery vehicles.  We use what and who we have available at that particular time.  

 Also, we clearly mention in a waiver on the backside of every sales receipt, that we only guarantee curbside delivery.   If the driver crossses the property line for any reason, it must be at the request of the property owner, or person receiving the material, and by making that request, the owner or person receiving the material, acknowledges that we are not responsible for any damage whatsoever beyond the curb or property line.  At their own discretion, our drivers will make every attempt to place the material where the owner wants it, but in some instances this may not be safe or favorable, and the driver will drop the material as close as they feel able to do so.  

Unfortunately, there are a lot of customers who don't want to  or have the means to move the material where they need it, so they expect our drivers to put it there for them, rather than renting a skid steer, using wheelbarrows, or hiring someone to move the material for them.  At $30 for the cost of a delivery to this persons address,  we are basically making very little, or no money at all trying to accomodate their special  requests to drive onto their property, and dump the material right where they want it so they don't have to move it.  This is why we only guarantee curbside delivery.  

In regards to the "wrong material".   In the business of aggregates and gravel, products appearances, sizes, and consistencies  change often due to various reasons including changes in production processes, and equipment by the supplier,  changing actual suppliers due to product inavailability, variations in nature that cause materials to be different in appearance and consistency, among many other variables.  

These are items that are beyond the control of the retail vendors such as ourselves.   We make every possible effort to continue to stock items that are the same or similar , but there are instances where we get what the suppliers produce, and we have absolutely no control over the look, size, or consistency of the materials.  For these reasons, we always recommend that customers come down to our location to view the product in person, prior to making the purchase.   In this particular situation, this gentleman didn't do that.  He assumed that what he ordered months previously was what he was going to get when he ordered again.     It's unfortunate that the material he ordered didn't match the material from his previous order which was made quite a while before the order mentioned in this complaint. We had changed suppliers since his first orders, and the new material was different from what we previously sold as 1-1/2" grey round.

 Being a landscaper for over 20 years, I have personally run into that issue many times, but I can't hold the retailer responsible for it.  It's one of those things that you have to adjust to and figure out a way to complete the job.  It's not something you can just blame on the retailer or delivery guy.  You also can't expect the delivery company to come pick the material up free of charge, just because you don't like it.  We don't have the resources or time to accommodate such requests, especially free of charge.  We loaded and delivered exactly what was on the delivery ticket, from our current stock of material at that time.    Being a very small mom and pop business, we also don't have the resources to track everything someone bought previously, just to ensure that they get the same looking material when they place another order.   In this instance, this customer ordered 1-1/2" grey round gravel.    This is exactly what he ordered, and it is exactly what we sent him from our current stock of 1-1/2" grey round gravel.    Yes, the material we are currently selling is different than what we sold in the months previously, but it is what we sell as 1-1/2" grey round. We didn't send him the wrong material.  He should have inquired about it, and made the short trip down to our yard to verify what he was getting prior to placing the order.  

To make a long story short, we delivered exactly what he ordered.  It just wasn't what he thought he was getting. This is no fault of ours, and it's not the first time something like this has happened with our company or any of the other larger companies in town.   This gentleman neglected to do his homework, and he's upset because we won't pay for his mistake.   Unfortunately this is very common, especially with do it your selfers, weekend warriors, and people who have very little landscape experience in general.    

I'm very sorry that this individual is upset, but we accept no fault for his mistake, and we can't afford to pay for other peoples mistakes.  

My recommendation to do it your selfers, weekend warriors, and inexperienced landscapers, is to do your homework, be prepared to work hard, or hire someone who knows what they are doing, and is willing to use a wheelbarrow, or has the proper equipment to to move it with.
