My fiance is a full size truck driver. Has been for 13+yrs. We were n our ford explorer and he dropped me off at the door of the bank. He then pulled up past and parking stall and started backing in. He was perfectly lined with the stall and 1/3 into the stall when the utility truck parked n the stall next to him started to back out.
My fiance stopped hit the horn and the guy hit and then ran his metal bumper down the panel and back door.
When i came out of the bank the guy came up to me and said he didnt see my fiance and admitted fault. He also said his friend who was a cop was on his way. Not a big deal cause the cop was honest and wrote the report up as it had happened.
Now, progressive is saying that we have to claim 10%liability and that r insurance may go up. I have full coverage. All the other guy had to do was look into his side mirror. Its the size of a laptop because its a utility vehical. They say theres nothing i can do. I can definatley go to another insurance company... That i can and will do. However, i dont understand how we have no recourse and have to take liability for someone elses carelessness. Also, if this is how all insurance companys r, why do i have full coverage,if im going to have to pay out of pocket when its someone elses fault. Because, i have no choices my insurance is going up,i have to pay out of pocket,and my policy has to pay towards this guys carelessness. This is the worst kinda betrayel by a company. I feel like im n a communist country. Why do i have no options and no one on my side. If i wanted to b this way i should just have liability. I am only saving $200.by having full coverage.i feel extremely screwed.

Sorry to hear about this unfortunate accident. I'm not familiar with laws in NJ but do have some knowledge of how an auto policy "works" and steps you may want to take: 1). Was the other driver ticketed by the officer? --this would show who, in the eyes of the law, was "at fault". It sounds like the other driver was "improperly backing" and should have been cited. 2). Even with a "full coverage" policy, there will be things the policyholder is responsible for (deductibles; co pays; etc). Look over the policy or have the agent review it with you 3). Question the insurance claims adjustor. Why is this being assigned EXACTLY as 90/10? Under what premis of the policy or law?
If you're unable to get answers, your state should have a department of insurance or department of financial services that handles consumer complaints about ins co's. I would call them for assistance as a last resort.
