Purchased a used transmission in April 2014 and paid an extra $100 for a full year parts and labor   Did not even receive transmission until first week of May.

Transmission shipped was faulty Dale in warranty dept will not return any calls

I have put in 3-4 phone calls to their warranty dept last week and they have been unanswered to me.   I have spoken to Scott 3 times and he told me on 2 of those occasions that Dale was indeed in the office those days. I also sent Dale and email on July 3rd that has also been ignored.  Previous history:

Invoice #235949   I sent confirmation email  to start my warranty on 5-16-2014  I asked for confirmation email back back but never got a reply.  My local transmission shop has indicated to me after messing with it for over 3 weeks that the problem is internal and it would be very expensive for them to pull it and open it up to repair. The transmission simply will not shift into overdrive or 4th gear.

I opened a BBB complaint with Western Mighigan   Case# 37050010   Then I recieved an email from them simply telling me to read my warranty

Susequent emails from them are basically them at first saying I had not validated my warranty, then accusing me of driving the car with no fluid in it and burning it up and then back to "read your warranty"

 

I also now have a complaint opened with the AG of Michigan and that complaint number is 2014-00857770 

 

Finally, this is probably what is happening or will happen to me:  This is from one of their other compaines SW Engines but same principle.  Source is BBB again and I quote:

  "According to the extended warranty company, SW Engines sold the extended warranties to consumers at a retail price and collected the funds for the extended warranty. In some circumstances, (not all), SW Engines paid the extended warranty company the wholesale price of the warranty as is customary. When a situation arose where a refund was necessary, the extended warranty company would issue SW Engines credit for the wholesale amount, SW Engines would then be responsible for refunding the consumer the amount he/she paid. The extended warranty company was unable to issue the refund to the consumer as it did not collect the money from the sale of the extended warranty. However, in many complaints, SW engines maintained that it was not responsible for issuing a refund and would refer the consumer back to the extended warranty company. This resulted in what consumers referred to as "the runaround" and much confusion. In the end it was my VISA card company thru my bank that finally got my money back.  The merchant kept delaying it with one line responses that would reset the clock 30 more days and I kept calling my Visa card company weekly to ensure they were staying on top of things.   I was credited my money back.  It is a hollow victory, because I really just want for people to be warned that this company has a history of doing this.   I still have tickets open with the BBB and Mighigan Attorney Generals office

They received a letter back from the merchant ( Quality Used Transmissions and asked for my rtebuttals, which is attached below.    Quality Used transmissions continues to lie and avoid repayment

I received the letter yesterday from The Consumer Protection division with the response from Quality Used Transmissions.  Almost all the statements in their rebuttal are untrue.  I will address each one:

“The transmission was sent in a timely manner”

I ordered it and paid for it on April 10th, 2014 it was not received until the 7th of May, and this was after I called 2x to ask when it would be shipped.    So, one month

“He called us on July 1, 2014 and reported the transmission went out.”

I have never spoken to anyone on the phone in warranty at this business.  I called multiple times the week after the transmission was installed (May 16th) first to validate my warranty and then to report that the installation shop said the overdrive did not work and my calls to Dale were never returned.  I have email proof I asked for my warranty to be validated on May 16th which was as per their instructions, which was to validate it within 10 days of installation. 

“Neither did we hear from him until he filed a claim with the BBB and that was on July 11, 2014”

This is why I opened the BBB complaint in the first place, to get them to respond.  They never, ever provided any information to me to take it to a shop and get it verified and they would send another.  The first correspondence I got was from Dale in warranty via email on July 10th with an attached copy of the warranty and one line to me which was in the subject line.  It read this: The Warranty (this is the warranty and how it works please read)   In my email back to them on the 10th I asked at that time for a replacement transmission to be shipped  “First of all it took me opening a BBB complaint to even get you to respond to me which is very unprofessional.    I also asked for an acknowledgement of my warranty validation on May 17th which went unanswered.  Where do we go from here?  I am expecting a replacement Trans shipped ASAP or authorization for the shop to fix the one you shipped me” I have received 3 emails the entire time of this issue and never had one phone call I placed returned.

“Then we emailed him and he said the transmission started leaking and then it stopped on him.  We again told him to take it to a shop, find out what is wrong with the transmission, get it verified and we would send him a replacement”   

This is another fabrication.   The car has never stopped on me; in fact the car is being driven occasionally today.   It simply has never has the overdrive gear working and so top speed is about 50 mph.  Here is what Dale from warranty sent me via email on July 11th  after my repeated emails to him, and I sent him email proof I has asked for my warranty to be validated and this email was sent  was on July 11th
“So you say you were driving, the transmission started leaking, then stopped moving. Sounds like you blew a line or a seal then kept driving and just deliberately burned it up”

The only time I ever said the transmission was leaking was when I was explaining the issue  and I said that the transmission was also leaking out the front main seal but that I understood that was not covered under the warranty

“We again told him to take it to a shop”

This never ever was asked of me from them.  In fact, my car has been at the transmission shop the entire time of this issue and after being there so long they asked me to come get it from their garage as it had been there since May awaiting the replacement transmission from Quality. I paid an additional $100 to them on top of the $600 I paid to have the trans. installed for them to give me a full diagnostic of what was wrong.   I have statement of what is wrong with the transmission and their recommendation for it to be replaced under warranty attached.

“We got a chargeback in the mail from him on August 4, 2014 and he now has all his money back” Another untruth.   I am in the process of having Visa dispute this charge and the $$ has not been refunded to me as of yet while they investigate the issue as well.   I have not been refunded any money as of this writing.

So, in closing I urge at your office to investigate this company and perform due diligence on the facts that I have presented in this case.   They have done this same thing with numerous other customers, as evidenced in my research with them.  I not only want my monies refunded in full but would also like for them to be fully investigated by your office for fraud and any charges or fines levied for same so that other customers do not experience what I have.
