I have a small company and rely heavy on my bank to help me with all alerts, deposits credit cards savings and all other banking activities. In July 2008 My daughter brought to my attention that I wrote a check that was written in spanish I told the bank and found that several other checks were written and not by me and this had been going on for months. My branch manager assured me that all bad checks would be covered and I would get my money after I filed a police report which I did.

I retuned to the bank and the manager pulled me aside and said that they wouldnt refund my money all but only the past bank statment. This was a complete surprise and when I aked her why she changed her mind she said 9 yrs prior I was given a small phamplet saying that banks only have to cover fraud for 30 days. I have been a very good client of the bank and reported this this to the Ca. bank board and they said it wasnt right and thy couldnt by law help me. I was out thousands of dollars and still havent gotten my money back. Ive tried to e-mail the C.E.O. and he has his others tell me the bad news.I feel that others need to be warned to check with ther banks on fraud and never bank at River City Bank.

Dollar Amount Is Irrelevant

Dru, this has nothing to do with the dollar amount. If you had been defrauded for $30,000 in one month, and reported the fraud within the 30 days, you would have been refunded $30,000. If it had been $100,000, you would have been refunded $100,000. The dollar amount isn't the point; your failure to respond to this nightmare should have been quicker and within 30 days. What I don't understand is that you knew how much money you should have made - it would have been easy to determine fraud was going on when someone in your business reconciled your bank account. If no one does that - you really have no complaint here because you essentially brought this on yourself. You can complain and you can even try and sue for the difference, but the point here is you aren't going to be able to collect. You didn't exercise any care in safeguarding the assets of your own company.

There is a lesson here that Victor pointed out to you; I would re-read it and live by it. Banks even provide online services so you can look at checks THE DAY THEY CLEAR THE BANK. You can immediately identify fraudulent checks that way, call the bank, and alert them to the fraudulent checks If you don't do that, then look at your bank statement - look at it! Look at the images of the checks you wrote. Don't blame the bank - it isn't their job to monitor your account - that's your job. Get your daughter to do that job - if she can't, then find someone else.

Thanks for your response to my fraud issue with River City Bank. But your $1500 dollars is not near the $30,000.00 I lost Im not saying that I had no responsability in this issue Im saying that I was promised a full refund and then this promise was reqantid and no monies near this was refunded. I know they have a card on file with my signiture and were very adiment about having this card on file. Every morning the branch manager looks at her reports and goes over tranactions and checks for just this sort of thing. If a check is written in Spanish I just cant accept the fact that the manager didnt do her due dilligence in stopping the fraud.
If a person pays fees to the bank for a bussiness account and doesnt get a proper warning or call Im sorry but others need to be warned. (DONT BANK AT RIVER CITY BANK)

In defense of River City Bank

I am also a small business who banks at River City Bank. I feel your frustration about being a victim of check fraud.

Several months ago, someone did the same thing to me. Luckily, my bookeeper noticed this when we recieved our monthly statement. River City Bank promptly credited my account ($1,500) and protected me.

In your report, you indicate that your situation "had been going on for months". My only suggestion, is that if you are going to be a small business owner, you need to watch your bank statements like a hawk.

It is unfortunate that things are going from bad to worse in our society. Criminals commiting check fraud need to be caught. But it is not fair for you to blame River City Bank for what has happened to you.

Another solution.

Wouldn't a simpler solution be to just read the statement that the bank sends you every month? As you can see, there's a very good reason for sending it.

If you're not in the habit of reading financial statements every month, you need to start. With the proliferation of electronic banking and the Internet, it has become much easier for crooks to get access to your money.
