Firt I would like to thank Dave, Steve, and Tony from Bakersfield, for all of there help and advise. This is the second time I have been contacted about this matter. Unfortunately I don't remember the Name of the first contact, but in essence I told the person that contacted me that I didn't owe this debt and that it was well over the statue of limitation even if I did owe it. I also sent them a letter stating the same.

I never heard from them again. Now I get this letter (2 yrs later) from RJM about the same matter. This is unbeleavable. They gave me two oppts. to pay this.

1) RJM would like to offer you a settlement of $1,726.65, a 60% discount off the balance due of $4,316.63, payable in 10 monthly payments of $172.67. Upon receipt and clearence of all ten payments in accordance with this offer, your account will be SATISFIED IN FULL.

(this is double the amount of the original debt, which was paid)

2) RJM will be pleased to accept $60.00 a month until the balance due is paid in full. ready for this $4,316.63!
These offers are only valid til 8/25/06.

I have not responed yet. I plan on sending them Tony's letter. But I don't want to open a can of worms. (that they are) I guess what I would like to know is who Do I report this to? The NY Attorney General or in my state, and what should I expect to happen.

That's a relief, I was affraid that I was going to be hounded about this.

My mother had a simular situation and she had to go to court. But I don't know the details. So she may have spoken with them or what ever.

IF the account is past the statute of limitations, there is legally nothing that they can do to collect the debt. They can not sue you to bring about payment.

However, they can still attempt to collect on the debt for years. If all they are doing is asking for payment, there is nothing illegal about a collection agency doing that. They can not be rude when they call you, and they can not harrass (calling once a day to your home number is not harrassment) you either. And chances are is that after they try for a certain amount of time with no luck, it will be passed along to another agency who will try.

The bottam line though, is that if it is past the SOL, there is nothing legally they can do to collect on the debt.
