I signed a 12 month lease to rent this 2 story condo style at a place called PALOMINO POINTE APARTMENTS. RMG Realty is the property management and the HOA, and the OWNER. I have requested some things before moving in that needed attention. None was taken care of, especially the carpets. The master bedroom carpet had brown/yellowish big stain as well as a red stain near the closet. The smell of cat urine at the bottom of the steps, which the steps has carpet too. I was told by the people up front i was denied.

The people up front was two girls. They half fast their job, lie and cheat there way out of responsibilties, especially when its their fault, its not their fault. To paint you a picture of their mental attitude. I have requested to speak to the landlord, the person i am paying rent, i ahve every RIGHT to speak with them. I kept getting the "YEAH", after asking some things, and nothing ever happening. Like when i moved in they were going to have an easier way to pay rent and six months go by and nothing came about it, and yes i re-asked each month everytime i paid too! You know the answer i got.

Just to name a few other things, the walls were dirty, the fridge was putrid, oven/stove very old, some stove top didnt work, door not working properly for downstairs bathroom. Now that bathroom, is what they call a "Hide away", there is other names, but its consist of the door as slider, sliding into the wall, typical for bathrooms where the toilet is in some new homes. The tracking is messed and sticks. So you can get stuck in there for a few minute messing with the door to get to slide back little at a time into the wall.

No screens on the sliding screen doors for the porch or balcony, no screens on the windows. In fact i had a screen on the front window upon starting rent, first day i started to move in, the screen was gone and no one knew anything about it. The flooring upstairs hallway is torn up, and also in one spot downstairs too. There was more stuff too, as far as notations in regards of holes in the wall, ceiling, a chunck of carpet missing out of the second bedroom.

I paint you that picture to have you know what i have been dealing with so far. As of June 3rd 2014, i finally met the landlord. Upon paying my rent in check at their office, i walked there with the intention to pay and continue walking down the street to the main road to pick up my vehicle at the auto shop from being repaired. I asked the girl up front now, the same questions i have been asking, and this time there is this guy there and he interjects talking about a portal online to make payments. Like any normal person, i asked who he was. He resonds, "Hi im the owner", i respond back, "Hi im the owner, my name is Paul and i am one of your tenants. Has she ever told that i wanted to be contact with when i first moved in here anytime after that?".

He responds by stating that she doesn't have to do that, you take care of whatever you need done here. Which not only an unprofessional response, but i am paying this guy my hard earned money to talk to people that cannot do their job. So i falt out told them that they have been ignorant to their responsibilities upon asking. He flips out on me, calling me, "a racist piece of s***", "who the hell do i think you are", just going off with nonsense with him cursing and screaming at the top of his lungs and telling me to get the f*** out his office!

Prior to me leaving, i told him right then and there that this a perfect example of being ignorant to your responsibilites because i still have issues at the house that has un atttenative, and the main focus is on the electric. The main circuit breaker keeps popping, causing the whole house not to have power. I have to physically go outside and reset the breaker. This started in MAY, so when i pay my bill in the beginning of the month of JUNE, i will tell them. Which i did exactly that, so he had his NEW maintenence guy(not the one i was used to interacting the first 3 months of living there) to write up the report on it.

I left after he told me to continue walking down the street to pick up my truck at the auto shop. Here comes "Hi im the owner" on his motorcycle talking up a trash storm, like before and proceeds to pull up next to me on the main street talking more, then pulls up to storage business parking lot and parks his motorcycle, gets off his bike and proceeds to walk in my direction opposite to where the auto shop, which is the next business down. He gets in my face talking that same trash, chests bumps, now he is begging me to hit him.

Now i might add this is the public street, and i am walking and he is on his motorcycle. Road Rage best fits this, but wait. Even though its a matter of the "he said, she said" scenario, i cannot prove the words exchanged, but i can prove on why he was parked at the storage lot when i took his picture as well as the auto shop i was walking too after that heated confrontation at his office no more than 10 minutes prior to him oin his motorcycle. I will post the pictures on here.

That same day i contacted APS and wanted the meter changed because the screen is messed up. So the next day on June 4th at 1:20pm, my electrical panel was blue tagged(notice of safety concern) because of the faulty main circuit breaker and the fact the whole panel itself which hold 4 units uncluding minewas about 40 degrees off the wall, not properly secured. A week goes by its June 10th and the main circuit has popped a couple times and no one from the office has come to look at it. The breaker is failing so bad, there is no clicking sound when turn it off or on. 

You can wiggle after it pops, and turning it on took some time, it wasn't at first try. I went back to the front office and talked to Travis. He tells me that they pretty much didn't do anyting because of my s**t talking with the owner. I said, wow, s**t talking, never knew the word ignorant is the new foul language. I demanded that he fix this today, and he tells me he will be out there in about 15 minutes. Two (2)hrs go by and finally shows up with someone else. Sees the problem i have, sees the blug tag on the meter, i mean you cannot miss it and he proceeds to tell me that he has to go downtown and get the part which wont be until tomorrow.

Nothing happens. Unfortunately the power main circuit breaker is becomming more consistent with this power failure within the home. I mean none of the breakers inside the home pops, only the main circuit breaker. After a weekend of a turmoil on June 28thm having the power go out numerous times and then on sunday night the power failing again, but worse. This time around i didn't have enough power to turn the a/c on. I have a fan blowing on me on one cicuit and a refrigerator on another circuit; when the fridge tries to turn on it shut the fan completely, involving me to have to power it back on.

This is when i found out that not only they are closed on thwe weekends, but there is no other contact for any emergencies, nor do they check the voice mailbox. I did leave messages over the weekend, especially when i couldn't get a/c working. It got hot sunday night, and was the worst night ever at this place. I didn't mention this, but i have a dog, so my concerns are not just for my well being, but more my dog, as well as the other human beings that live in the same building that there is a HUGE potential fire hazard going on right now.

I get a response back on June 30th, around 11am. Now its a NEW maintenance guy, never met him before, and apparently they don't have to inform tenants of the change, so if he is a child molestor, its ok to allow them inside the house. On June 30 around 9pm the main circuit breaker was repalced and fortunate enough that the hired professional electrician had an extra main circuit breaker like the existing because its an outdated old style.

July  1, 2014, i come home after work to find a piece of paper on the door for a 30 day notice. Notice of intent to terminate month-to-month tenancy(ARS33-1375). From a Dinorah Fernandez, which i think is that girl up front, which apparently this is all she is good for, making threats, rather than solutions. "Notice is hereby provided that your landlord has elected to terminate your month-to-month tenancy in the Leased Premises". "Notice is further provided that you must vacate the Leased Premises no later than August 1, 2014".

So with the accurate date on there and the law firm they use; "LAW OFFICES OF SCOTT M. CLARK", at the bottom of the page; i contacted them. Since the front office is obviously ignorant to their job, i talked to Chris which says he is the owners attorney; the owner being ROBERT G. DAVIS, designated broker #BR583724000 in the state of Arizona. The lawyer Chris goes on explaing about the process on how he doesn't want to renew the lease.

Ok, but why i am being forced by August? Thats when your lease is up, he said. I informed him that i moved into the complex in January 2014, unless the calendar changed, i recall 12 months in a year, not 8. I went on to tell him on how this is personal discrimination against me from the owner because he refuses to do his due diligence! The lawyer takes my info down and said that someone from the office will call you back and straighten it out.

This is where i am at with this. Not only the owner is a slumlord by nature, but needs a reality check that he owns a business as well as property and that i am paying to live in them. This is a statement for myself to release as a formal document. It has the date and time stamp as well as a reputable name to stand beihind it as legitimate, i mean this only works when your truthful. I can, apparently can only say so much, because the fire nor police department will get involved unless its a criminal matter, aka house on fire, not before!

Whomever has read this, thank you for your time. If you are the person(s) i am talking about, this is all public information you can get online about you, so there is nothing illegal about it. The pros/cons about the digital world, you are more vunerable than you think! For example, ROBERT lives in Washington St., he doesn't live here in AZ.

Small Claims Lawsuit Judgement Awarded to Me

I took the owner of RMG realty to small claims court, after being illegally evcited through court system. I was never given a fair trial, by the courts through  judge conti. However through those same courts, i went a filed a small claims against RMG and was awarded a judgement of $1575.00 This was back in 01/13/15, i was awarded this judgement agaist him, with the case number CC2014178332. In a couple of weeks, it will be two years with no attempt on his part to pay! I am very certain he still collecting profits and screwing over other tenants in the process. Yet, having process of paying and charging late fees when one does not pay, how are you different? That is what a hypocrite is call. I have made a couple of attempts myself, one of them as going as far as sending a certified return receipt postal letter to him, but still nothing. This is business, that does not pay debts, yet still deserves to collect profits? I will see what my options are, in regards of maybe pushing this matter to a civil lawsuit and start taking property away from him. It is evident he is consumed with too much property and too much money to follow through with responisibilities.

First Ten(10) Day Notice

 Back in 02/28/2014, i had a notice taped on my door telling me, notice of intent to terminate lease for material breach. It stated, "your landlord has terminated your possession of the leased premises is/are described as follows: The notice if for removal of everything you have on your front door/porch, patios and or balcony's. Everything must go except patio furniture, grills, bicycles, and toys." I went to the office to complain about this after i spent money and time not only making the outdoor appearance more appealing, but i added a security metal screen door, a bamboo shade, a garden, etc.  I had the ok to do it from the front office and no i am being told i am part of the exception. Granted i have been requesting to talk to the owner, let alone the landlord so i can address some problems to the place, so that i the tenant and the landlord can be working on the same page. Instead i get YES to death and left with these people to be the ones in charge of the whole, since the landlord cannot be disturbed!

Thirty(30) Day Notice

 30 day notice to terminate month-to-month term lease. Even though i have a 12 month lease that started on 01/01/2014 and i being forced out without reason, nor anyone helping me out from the company, because the landlord is the owner of the company too. The law offices of scott m clark is waste of time, either too busy or in court or out of town. I left with the burdens of an immature boy that is twice my age abusing his authority and the law allows him to do it. All Dinorah has to do is go online to:

Ten(10) Day Notice

 On 08/08/2014, i waited all day, specifically between 9:00am - 4:00pm. No one showed up! Around 4:15pm, four(4) hispanics rang my door bell, and i answered it. They asked me if the place is occupied, when i said, yes, they turned around and started walking away. It seemed like one of them had keys in his hand, like the ones to my place, but when i asked them about it, all of sudden they no longer speak english. I quickly put my shoes on, to see where they were going. They disappeared to where normal people would walk, let alone would park if they drove. I did go around the building to see them walking back towards the office. As i return home, i noticed, yet another notice taped on my dooor. This is a ten day notice of intent to terminate lease for material breach. It states, "your landlord has terminated your possession of the leased premises is/are described as follows: Making modifications to the apartment (Screen Door) without management approval." Nnow the funny thing is, the date says 08/06/2014, when in fact it was 08/08/2014 and also stated that it was hand delivered to me, which it was taped to the door, i mean there is tape on the paper still. The other funny thing too, Dinorah is all of sudden promoted from assistant to agent in no problem and yet nobody seems to care, and that is including Scott Clark and Christopher Walker at the Law Offices of Scott M. Clark. Even the revisions are dated back in 2010, which these have not been updated for the new revised laws back in December 31, 2012.

I have had people orignally working there that no longer work there, such as Brenda who worked the front counter and Brad who was the maintenance guy. I already got a ten day notice back in February regarding to clean up the area, after i already invested time to make the property better looking and upkept. Upon questioning it to the front office, not only Brenda is clueless, but Brad is telling me don't worry about it, you are part of the exception. I said thats fine, but what about everything i have done that you guys said it is ok to do? I had a bambo shade that was protecting the southern part of the sun during the winter, as well as the security metal door i installed. I have been asking to talk to the person in charge, and apparently these people is whom i was left with, as, "in charge". Now i am told don't worry about it, because i am making initiative on making the place better, and plus part of the agreement, i am bound to making good looking and taking care of it. on 02/19/2014, I got the security metal screen door, because not only to feel safer, i felt more comfortable having it. The fact of the building being so old, and outdated since it was built. YES, original door and door frame from when it was built. A teenager can come up and kick the door in, while the deadbolt is lock. How i know this, if you look the place and the poor condition it is in, you would understand. So since i have been asking to talk to landlord about making got 50/50 on the door, and install. But no go to talk to the person in charge, just left with brenda who is given empowerment. Dinorah was never there, in fact, the whole time this application went through, i never knew about dinorah until they were closed on the weekend when i went to pay my rent, even though they say they were open. Regardless, i am being in trouble for something that not only i was okayed on, but also YES, YES, YES to death, but let alone security and safety, i am being threatened and harassed again. By RMG REALTY, DINORAH FERNANDEZ(who is not an agent, has no license), and the LANDLORD, let alone the Law Offices of Scott M. Clark that allow this possible!

Two(2) Day Notice taped on my door

On 08/06/14, I left my place no more than 30 minutes and this is taped on my door. A two day noitce of intent to enter premises. States, "that your landlord intends to exercise its legal right of entry into the Leased Premises between the hours of 9:00am - 4:00pm on August 8th, 2014. There will be inspections." She wrote down that she hand delivered it to me, which it was taped on my door. On top of that, this is the first one out of many notices that she signed it as an, "office assistant". It leads me to believe that she has no license to be consider an Agent for RMG REALTY, and if so, then all this is fraud!

HOA negligence to community.

 On July 26th, 2014, there was a severe monsoo that came in and lasted for quit a bit. I recorded part of the storm on my phone as i was woken up by it, between the rain, wind, lightenging, and thunder. Within the recording you can have a crash, which is tree that was uprooted and fell over, causing property damage. Other damage inlcuding large branches breaking off and other trees falling over causing property damage elsewhere. NOTHING has been done about this. Everything is where it sits and has been sitting for over two weeks! Pictures speak for itself. Especially one where there is build up, like a dam, for our overflow of water to go to go, but considering the lack of maintenace down around the place, pictures speak for themselves.

Complained about electrical issues

 I have complained about the electrical problems in the dwelling, especially that problem with main circuit breaker. I mentioned this to them, RMG, and they don't want to look into. Action speak louder than words. APS says they cannot do anything for me except monitor these large spikes in my electricity. This has been going on since i could see, since June. I am very sure it has gone on prior, especially when i moved in. I have a graph here for the month of July, i missed the deadline or cut off time online to get these graphs. APS says they can get me the other months if needed, which is. This could explain the issues i had in JUNE!

on 07/25/14, I then had an issue that my adjacent neighbor had to ring my doorbell telling me my a/c unit is making a very loud noise. It sure was when i opened the door, but very faint inside. As i went to shut it off, the power shuts off in the dwelling again. Main circuit needed to be reset. WHY? If i have an electrical panel with multiple circuit breaker carrying loads to different parts of th house, why is the main circuit breaker failing and not the one that is designated for a/c? Yes, i have questioned these problems, of getting no answers. Upon telling RMG about the fact that i had to wake up to a/c blowing hot air. Of course i had to leave a meassage. I had to find a place for my dog, unfortunately my buddy that helped last time couldn't. I had my dad come down in the morning, which was at 7:00am, to pick up my dog for the day. I went to work, not knowing whats going on. I called them and no answer of course. So i left work early to go to the front office and complain about this. Well they are closed. Which is weird, because they say they are now open from 10:00am - 6:00pm Mon-Fri. Closed Saturday/Sunday. Hmm, when i called it was around 11:00am, i left work early around 12:30pm. Give or take 1:00pm i arrived at the front office to have the door locked, closed, even though they say they are open. Luckily the newest maintenace guy(thats right another NEW maintenace guy unbenounced to me, a tenant), JEFF, was there to talk to me. He said he contacted an a/c repair man and that Dinorah, the girl that is suppose to be "working" up in the front there is out on lunch.

Thats when i found out she takes over an hour lunch, sometimes two(2) hours. I say this because she drives a certain vehicle, only because its either hers or the NEW maintenance guys' truck. With that said, i had left my place one time, and not see her car there, come back over a couple of hours later and her car is still not there, and i went to the front office and the door was lock at that time, which was around 3:00pm. This needed to be said, because she was the one that was suppose to notify me about whats going on.

Since i already have obligations for the day, i couldn't sit around and wait, i needed information on whats happening. No one followed up with me about the time frame, i went on with my day. I never allow them access to the place, unless i am there. I came back, along with my dog, in hopes that something was done, because i never got a call. I got home to see that the a/c unit was looked at. In fact, the piece that was hanging, banging against the fan blade making that loud noise my neighbor told me about, i took the initiative to fix it. The zip tie holding up the plug connecting these wires, failed. Seeing a burnt pattern on the mesh part of the top. Causing it to go into the fan blade and the fan blade knicking one of the wires to cause the power failure. Hence the whole house and not just the a/c. Well it looks like they took the top part apart to gain access to that adapter, because they cut wires for that adapter and just spliced it with wire nuts. Cool, but what really bothers me, is who actually did this? It looks like an unprofessional job. Here is why, first off, if the unit cover was removed, a professional will remove any or all debris that is caught inside as well as helping out the performance of the unit. Instead, wires cut, and spliced with orange color wire nuts, wrapped with black electrical tape. However, debris is still within, especially, the zip tie that failed causing the whole problem to begin with. Nothing was ever addressed or followed up about this problem that i experience again in this dwelling.

IAH HEARING ON 07/15/2014

 After being served that restraining order on July 2, 2014, i went down to the courts and put in a written request for a hearing about this. Unknown for the reason and the extent of the order too. The hearing was made out for Tuesday, 07/15/14 at 9:00am. I went to the courts on Tuesday, 07/15/14, and come to find out that Robert Davis didn't show. So the judge dismissed the case. Come to find out that how he got the restraining order against, he lied! He wrote, "that on June 25 2014, i came into his office screaming and yelling about all the stupid brown people. that i also tried to pick a fight with him on the corner of 29th st and greenway rd." He also wrote, "that on July 1 2014, i said old jewish landlords end up dead and brown people are stupid." HA HA HA HA HA HA.....i laughed my a*s off in the court room when i first was handed these documents that i was suppose to get upon being served. WOW! ITs funny on how the vague details, and they allow him a restraining order, well knowingly he is my landlord as well, but when i actually have incriminating evidence to prove myself right and that his statement is not only false, but conjure/perjury incidents to harass me using an injunction against harassment. On July 1, i doubt he was in town, but i never said how i told him, actually it never said i told him, he just says i said it. As far as the incident about the June 25, well that was on June 3rd. Considering the picture i have that not only datestamps on June 3rd, but that trumps his whole story about that with the time-frame, but moreso the fact that he is driving a motorcylce and i was walking with intention to pick up my vehicle from an auto shop. Anyways, apparently we are allowed to lie, cheat and steal, as long as you make yourself out as the victum!

I tried to get a restraining order for myself against Robert Davis and a Commissioner Brian S. Rees at Maricopa County Superior Court. upon "TRYING" to tell why i need a restraining order against him, he refused to listen, nor look at documents or pictures. Furthermore, after i have listed the limited times i put a incident on the report, which is three(3), but added more incidents on the third part. Brian Rees had the nerve to tell me there is no consistencies with the report. I had to force it on him, to at least see a picture. He denied my request for a restraining order, but insteads sets up a hearing 30 days from this date, so on 08/14/2014, i have to waste my time again to go to court to re-explain myself to the same person, because he didn't have time this day to take care of it. Well knowingly that my iah against me was dismissed by the same person i am requesting one against. Granted the report he filed was false and i had the evidence to prove it, but Brian Rees didn't want to hear about! Luckily its all recorded, at least if i am not committing perjury!

Served a restraining order from Bob Davis

After July 1st having the 30 day notice. I was served earlier today July 2nd by police a restraining order(IAH) from Robert Davis. I went to the office to find out about being forced out & pay my monthly payment. Dinorah, the girl that works u front, the one in the video, wqs very dismissive when i went in, not wanting to help because im not suppose to be there. Ironically she can call ROBERT immediately meanwhile when i request since i moved and everytime i made my monthly payment for to get in contact with my landlord about some questions that were never answered. Apparently the other girl Brenda that doesnt work there anymore, anything she has done for me to move in i

s irrelevant to his eyes, because i was lied too.

 

Dinorah refused to take my monthly payment of the month of July. I repeat, refused to take my money because, she said and i qoute, "your not supose to be in here".  Then police show up to serve me. I filed for a hearing at the courts this generated from. I will update this after having that hearing on July 15 and i will be presenting everything i have talked about on here. What i did mention before in previous complaint is that i took pictures before i moved in & it was crap & i made more welcoming, presentable according to the lease agreement & getting a notice that i violated my lease agreement & that i would be evicted. So its not the first time.
