 rocky Mountain legal services did a loan Modifaction for me back in aug.of 2010 I paid them
$2995.00 for the loan modifaction it was to be for the life of the loan and only lasted for six mounts
Im now back to my orginal loan payment with my morgauge company (hsbc morgague services)
Im under legal  contrack with then and want to continue my loan modifaction or my full refund back
from them

I am one of the attorneys that is looking at this file and complaint. I am here to give the facts regarding this file. We want to make it clear that the client did not pay our firm. He chose to pay the 3rd party affiliate Taskrow Financial for services. We have no record of any payment made to our FIRM, but yet we will continued to work on file to help client out.

As we have listed below the facts are clear and shows that this complaint is False and unwarranted.

1. Please see all notes listed below that infommed the client of every possible option FROM HSBC.

Mike Dellere left vmx on clients cell phone w/ info about option to extend reduced rate plan after 6 months and info about payments of $1512.19 due on sept 3. Client called back said he understood exactly how the modification works. I also explained the option to excend the modificaiton if client could prove further hardship. Made it clear that if client could not prove continuing hardship the bank would put client back on original payments.

Mike Dellere client faxed in letter from HSBC regarding loan mod approval. Approved for rate reduction to 5.59291% for 6 months (can be extended for additional 18 months if client can show extended hardship needs), new payment $842.97. Called HSBC, spoke w/ carol in Home Retention. Client account is updated w/ modification plan. Clients next payment is due 9-3-10. Payment is actually $1512.19. This payment includes $669.22 for past due property taxes. HSBC paid $6870 in past due property taxes in Feb 2010 to prevent tax delinquency sale of property. Client will have to pay future property taxes on own, no escrow account on client mortgage. Carole mentioned that client can contact HSBC and request that property tax payment be reduced if needed, is currently based on HSBC being paid back within 1 year on past due property tax payments. Calling client w/ status of payments and due date.

We have also attached a Letter from HSBC that the Client signed and sent back to HSBC explaining again in detail the MODIFICATION IN DETAIL.

Now if the Client could not prove any more finanical hardhship and is looking for a free house or lower payment with no hardship he will not get it.

IN ORDER TO CONTINUE A MODIFICATION YOU MUST BE ABLE TO CONTINUE TO PROVE THE HARDSHIP.

If you are on a Rate Reduction Plan (this type of plan includes the Pay Right Rewards, Rate Rollback or Timely Rewards Program described in your Loan Agreement), you will not qualify for any reduction of your rate during the term of the loan modification. Additionally, payments made prior to the term of the loan modification and since the most recent qualifying Rate
Reduction, as well as any subsequent payments made during the term of the loan modification, will not be qualifying payments under the Rate Reduction Plan.

Additionally, the loan will qualify to receive future rate reductions if the eligibility requirements of the Rate Reduction Plan are met. A Rate Reduction Plan is the Pay Right Rewards, Rate Rollback or Timely Rewards Program described in your Note, Modification to Note or Note Rider.

For A&H insurance, your monthly premium will be reduced based on your new monthly principal and interest payment. Your new total monthly payment amount will be reflected on a subsequent statement. In addition, any attorney fees and costs associated with the escalated collection activity on this loan will be collected.

Allpayments must be made in accordance with the temporary LoanModification Agreement. In modifying the terms of the original loan agreement, there may be a negative impact to your credit score. Your temporary modified payment amount will be accepted

Upon completion of the temporary loan modification, your loan will revert to the interest rate and payment schedule set forth
by your Note and Security Instrument. If there are any accrued late charges prior to and during the loan modification period,
these will be assessed to the loan once the loan modification has expired. Your temporary loan modification is set to expire
on or after 02/03/11. You may be eligible for an extension of payment relief at the end of the temporary modification period.
To be eligible, you must make all contractual payments that are due during your temporary loan modification period, and
demonstrate your continuing need for assistance once that loan modification has ended.

HSBC mortgage Services reserves the right to resume collection activity on your loan (including foreclosure, if applicable) if
you fail to make your modified loan payments on or before the scheduled due date. The loan modification may be withdrawn if
you file bankruptcy, fail to maintain the required hazard insurance, or do not pay your property taxes on time.

Additionally, your loan will revert to the interest rate and payment schedule set forth by your Note and Security Instrument.
This temporary loan modification will void any active temporary modification currently on the loan. HSBC Mortgage Services has temporarily modified your loan whollyas a consideration. All obligations, rights and remedies set out in your Note and Security Instrument remain in full force and effect. If your loan includes escrow for taxes or insurance, we will continue to perform the regularly scheduled escrow analysis on your loan. If necessary, the escrow will be adjusted, causing your modified payment amount to change.

If your loan is a Home Equity Line of Credit (HELOC) and is currently open for advances, please be advised that your HELOC
has been suspended for further advances due to our reasonable belief that you will be unable to fulfill your payment
obligations. Your credit line will remain closed for further advances until you notify us in writing of any changes in your
status at the address listed below. HSBC Mortgage Services will then evaluate your loan to determine if your credit line should
be reinstated.
