The Judge was in our favor and Mr Shene was required to pay the $550 security deposit back along with court costs.
HOWEVER... MR Shene then filed a claim against us for several items he claimed that we had either not cleaned, items missing form trailer, lawn care, roof repair, chicken coop debris, fire pit debris, , late fees and missed rent for over $1400.00.
We returned to court again in May 2011.
The Judge decided in our favor again.
I urge everyone out there to take any and all issues of this matter to the courts and let Justice prevail.
I also urge everyone to take photographs prior to and exiting any rental property. Keep accurate records of all contacts with landlord and receipts for any item replaced or repaired. Having Proof in court will help you. We were lucky that the Claimant DID NOT having anything to back up his claim.

I took him to Fulton City Court in Fulton NYon Jan 6, 2011. He tried to claim it cost $550 to clean the house after we moved.. I E dirty bathroom, stove, floors and carpet. He even claimed I owed for late payments from Jan 2010, which he never asked for in the 8 months prior to my moving. I feel the Judge will decide a fair judgement. Still waiting on a court ruling.

It is now OCT 24, 2010 and I have yet to see or hear anything back regarding the return of my $550 security deposit. Looks like court time. I am also looking for others in Central NY that have probably encountered the same NON RETURN of money owed by this person. Maybe if more persons step forward we can file a group claim.

I moved out of that dump on 08/03/2010,,,, It is 09/08/2010 and after several non returned phone calls he stills has not returned a call let alone my deposit. Looks like legal action needs to be taken on this guy. Maybe I should report him to the county for having a vehicle salvage/sales business without a license.
