On Monday, January 21, 2008 a phone call was placed to my residence by one of Drive Financial account representatives. At that time, I was not at home, but a few friends, relatives and my mom's boyfriend answered my telephone and this is when a representative of Santander Consumer USA Inc. (a.k.a. "Drive") deliberately disclosed and informed said boyfriend of my current vehicle information and told him to tell me that if they did not hear from me by tomorrow, they would place my car up for repossession status.

Yes I have been having issues with my car note lately, I have a sick child and that keeps me out of work. They have been gracious enough not to repossess the car, good, but the fact that they constantly ignore FEDERAL LAW!!! What they did was a violation of the Federal Privacy Act of 1974 as well as the FDCPA. The portion of the act(s) are noted herein:

(b) Conditions of disclosure
No agency shall disclose any record which is contained in a system of records by any means of communication to any person, or to another agency, except pursuant to a written request by, or with the prior written consent of, the individual to whom the record pertains, unless disclosure of the record would be

The FDCPA restricts debt collectors from engaging in conduct including the following:

Contacting a third party who does not owe the debt, such as a relative, neighbor, or your employer. Co-signers to the debt, however, may be contacted by the debt collector;

I have verbally told Drive about his once before and they continue to do it.

Once before back in 2006, they contacted my boyfriend at the time father and step mother and told them that they were going to take their home becasue I was in default of my loan. I guess they assumed that my boyfriend's father was him, since they have the same name. I have affidavits from all the people they have disclosed my personal information too! This is a violation and I am shocked that they are allowed to constantly act as if they are oblivious to the law.

My sister recently purchased a car through Drive. They charged her finance charges of 11,000.00 and the car was only 12,000.00! I am going to check the usury laws of my state! This is ridiculous and they must be stopped!!!!
PLEASE KEEP ME APRISED OF ANY AND ALL DISCUSSIONS FOR A CLASS ACTION LAWSUIT!
