My name is Regina P*** and I live in Evans Ga. I have been an investor for almost 7 year and when the sub prime market fell my business took a nose dive for the worst. I found myself behind with many of my mortgages.By the Grace of God several of my friends were willing to step in and buy and or payoff my loans so that I would not be foreclosed on.I thought great, right? Boy was I wrong!
Starting with Option One, I requested payoffs 5 times on 4 properties starting around 1/12/08 through 2/4/08 and could not get them. I could not understand why the foreclosing law firm and the bank would not let me pay off my loans!I spoke with a friend of mine and he mentioned that the reason might be because the bank no longer had the original note.I asked, what do you mean? He said that most of these banks have sold the original notes in the secondary market and that they do not have the right to collect your money or FORECLOSE! I started doing some research and he was right. Under the Federal UCC code only the holder of the original note can foreclose!
Fast forward to 2/04/08, I sent Mc Curdy and Candlier Law firm a letter that said that I have requested payoffs and can't get them and that I don't think their client Option One has the original note anymore. Therefore you better not foreclose on me!The next day my secretary went to the court house to see if they were going to cry out the property. THEY DID NOT FORECLOSE ON MY 2 PROPERTIES IN COLUMBIA COUNTY(one was my personal residence),THEY DID FORECLOSE ON MY RICHMOND COUNTY AND HENRY COUNTY PROPERTIES.
Fast forward some more, then the foreclosing attorneys and Option One went out and hired McCalla Raymer to evict me out of my personal residence when they did not EVEN FORECLOSE! When McCalla found out the truth the did reverse the eviction.
The same similar story happened with Saxon and Wells Faro. The foreclosing attorneys Mc Curdy and Candlier and McCalla Raymer could not or would not get payoffs and foreclosed on me. I am sorry, if the attorneys can't get payoffs from their client banks, THEY SHOULD STOP THE FORECLOSURES! I am holding them just as responsible as the bank if not more! I have done alot of research into these banks that are foreclosing without having the original notes and the foreclosing law firms don't care! MY CIVIL RIGHTS HAVE BEEN VIOLATED AND I AM NOT GOING TO LET THESE BANKS GET AWAY WITH THIS ANY LONGER.THE PEOPLE IN THIS COUNTRY NEED TO WAKE UP AND SEE WHAT AND HOW THESE BANKS ARE FORECLOSING!When the banks can't find the note to foreclose(because they sold it, not lost it) they file what is called a lost note affidavit.There have been 4 or 5 states that have got up against these banks and have won.(THE LITTLE GUY KEPT HIS HOUSE) There is no case law in Ga until me!Most of the attorneys that I have spoken with do not have the b***s to stand up to these banks and foreclosing law firms.
