Scott Dolan (Montego Pools) was hired to construct a pool, firepit, kitchen and landscaping. Work not complete, caused damage, defective, refused cure

Scott Dolan (Montego Pools) was hired Oct 15, 2015 to construct a pool, firepit, kitchen and landscaping. Dolan would not show up to give instruction, review work and completion of subcontracts. He would also stop work for long periods of time and be non responsive to emails, voicemail and text. Written and verbal contracts indicated work would be completed April 2016. Begged and pleaded with Scott to complete the work. Began to notice issues with work that was performed. He was paid $106,940 via cleared checks and much of the work was never completed or completed up to the itemized items he had been paid for. He cleared land and undermind the footers of my home causing structural problems. He brought in several tons of dirt and dug up clay that cause serious issues to my yard and runoff affecting neighbors. Never properly contained the runoff. He built a 13 foot wall for the pool that is not properly constructed (it's a parged wall). He did not use correct rebar nor properly tie the rebar into the structure. He was going to poor the deck/patio for the pool on top of clay and soil that was not compacted and had no crush and run. Last attempt to work with him was in August 2016. A construction consultant was hired to help discuss what is needed to correct and finish the job. Scott refused to finish the job unless we paid him an additional approx $15K. Even though he had not completed the work as agreed to for the $106K and all parties agreed that he had not done work totalling $106K. He also did not pay for materials but had workers show up on site without materials such as stone. We paid for that to get them working only to have it improperly installed. I had Nova Engineering come out to do assess the work and the report highlights serious defects and damages caused by his work. I have pictures that support he dug up my backyard and footers and left it for several months (From November 2015 until August 2016 - when he was terminated).

 

This is theft by taking, bad workmanship and damages/danger to my home. He took our money, did not complete the work, work performed was minimal and improper and caused damage to our home and yard in the process. The extent of my issues and damages are incredible. This man does not supervise his job or his sub contractors. He has been to my house a total of 5 times from Oct 2015-Aug 2016.
