On 11/08/2009 I made the mistake of having a oil change done at the Fiesta Mall Sears Auto Center. The idiots admitted to damaging the door to my brand new vehicle with an air hose. Seems the moron manager Mike released a air hose with a very strong PSI right into the side of my car. They said they would fix it if I got an estimate which I did. Their "Loss Prevention Nuts" claimed it was to high and should only cost around $150 to fix the dent and the paint. I explained to them its a 2008 with 3,500 miles on it. I did make the manager write down that he did damage my vehicle before I left. The damage is more like 1,600 to 2,000 dollars, this is a new car and Sears did a large amount of damage. Sears had their "LOSS PREVENTION" Jerks call me up and tell me that they needed a copy of my credit report, Social Security Card, Copy of my Drivers License,Auto Insurance card and Birth Certificate and vehicle registration to prove that I really owned the vehicle. They told me if I did not take the $150 settlement that it could be years of court proceedings before I ever got my vehicle fixed and then the lawyers would take all the money.

 

 Needless to say I'm not an idiot and nor would I ever give them such information. I took the vehicle to the certified BBB Auto body repair center for the repairs, filled out the lawsuit and paperwork to serve the statutory agent, paid for the repair using my 21% interest Sears Master Card. I figured when it comes to damages Sears needs to pay the interest that they fleece their customers with, think they will argue with the judge that the interest is unreasonable? I will also ask the court to grant me the filing fees, time lost from work, rental car expenses, and several thousand dollars for the decrease in value do to the claim that will be reported on Carfax Reports. My damaged car is now worth way less than what I paid for it. To add insult to injury after they damaged my vehicle, made me wait 2 hours to get my car the morons charged me for the oil change. I can't wait to have my day in court with these idiots. I plan on taking the judgement papers and making flyers out of them to distribute to every home in a 2 mile radius.  I also have phone calls into the local news stations asking for help from their trouble shooters, this will make a great news story! Oh the BBB thought the complaint was incredible.

Dear Sears CEO,
 
This letter is to inform you that after being a loyal 20 year card holding customer, my relationship with Sears is over. On 11/08/2009 your Automotive Manager Mike Layton at the Mesa AZ store located at 1425 W. Southern Ave. disconnected an air hose from a tire machine that struck my new vehicle. I was at this location for a simple oil, lube and filter. I was told to get an estimate and Sears would fix my new vehicle that has just over 4,000 miles on it. The BBB A+ Rated Body shop I took my now damaged vehicle to, gave an estimate of around $1,600 to fix what your company had done. After a 2 hour wait for the loss prevention people to arrive, I finally received my damaged vehicle and a bill for the oil change that they had the nerve to make me pay for.
 
Your loss prevention people called me back the same day informing me that I needed at least 5 more estimates for the repairs, I informed them that was ridiculous and not going to happen. The next day I received another call from your loss prevention people who offered me $150 to settle my claim. I explained that there was no way on earth would I accept $150 for the damage as the vehicle was in the shop being repaired for $1,600+ dollars plus I had to get a rental car.
 
I was badgered by these LP people and informed that Sears would drag the matter out in court for many years. They also asked that I send them a copy of my credit report, Social Security Card, Copy of my drivers license, birth certificate, vehicle registration, and insurance card to prove that I did "own the vehicle in question". This was a futile attempt to get me to accept their ridiculous offer. 
 
Your employees are insane, liars and just flat bananas! Never in my life have I ever seen such a disaster. I will of course have my law firm sue the pants off of Sears for the damage and the absolute insanity of your employees. I will pay for the vehicle repair on my Sears Master card as well as the rental vehicle and the $2,500 retainer to my law firm. Oh you know the 21% Sears card. Your store manager Burt Desroches has lied to the National Customer Relations for Sears by stating that he has attempted to contact me several times. I called four separate times to speak to him and was placed on hold for 20 minutes at a time. I will make sure I share my Sears Horror story with everyone I can find to listen, with the economy the way it is customer service should be job #1. Well I guess with a store manager who gets arrested for DUI I am sure alcohol is a factor because sober people don't let their employees act this way and get your company sued!

Mr Calm Down,

 

You must be kidding? Sears loss prevention Department acted like the Gestapo threatening me with lengthy litigation and "I would never receive a dime". Oh talk about going off 1/2 cocked? Have you ever had someone damage your vehicle and then ask you for your Credit Report and Birth Certificate? How about charging someone for a oil change after they messed up your vehicle?  You must be insane to think that a claim over 1,000 does not show on a Carfax Report and decreases the value of your vehicle by thousands, especially if your like me and trade them every 3 years. And yes the damage was over 1,600.00 and the vehicle is being repaired as we speak, I used a BBB certified shop and not Goober's Auto Body Shop on Shady lane.

 

It will be more than a pleasure to see Sears pay the damages and the attorney fees, including the 21% interest they so cleverly charge their customers.Nope my pants are not in a wad but Sears will find their pants down around their ankles in the court room, you know its the American way of doing business, company makes a mistake fails to own up, makes it look like its the customers fault and then the company gets taken to court. Well anyone who would buy K-Mart cant be that bright I guess. I will make sure as soon as my law firm gets the judgement to post it for you.

 

PS- I have $50 that says you are probably the idiot store manager(that never returned my phone calls) I hope you will be looking for a new job after this, thanks for the post and see you in court.

I love how so many posters here go off half cocked. Before you get your pants in a wad, just send them (certified) a letter demanding the amount owed within 15 days. After the 15 days just file a small claims suit. No lawyers, no aggravation.
All your histrionics will do nothing. Also, the value of the car won't be affected by one small dent.
PS-I think the damage will cost far less than you think.
