* OD and Return Item fee overcharge I have been with Simmons Bank for 2yrs now and I feel as if I might as well have banked with Bernie Madoff. In my 2 yrs they have some how swindled over $5000 in OD and Return Item fees out of me and I am now in a bad financial crises bc of it. Not only that but after speaking with Kate the branch mngr and Fre the regional manager they assured me that giving my current account status that they had set me up on what they call a Fresh Start program to begin paying back any owed charges which I was still not ok with completely however even then Kate allowed me to make a withdraw and assured me my account would be back to a positive balance by the next day.

After waiting 4 days over the weekend and into the beginning of next week I call back and speak with free and she stated she would see why it had not went through yet after assuring me it was set up she said she would call and find out what was going on and would call me back, needless to say I never got a return call as promised so I call back and speak with her again and at this point she began to say that I was not going to be in the Fresh start program for unkown reasons. I feel as if I have been baited in order to stay a member of Simmons and on top of that more than anything I feel like I have been robbed adn the worst part is the fact that these are the same ppl I entrusted with all of our money and banking needs and they seem to act like I am some horrible person for asking questions and asking for factual documentation on my fees and also they acted like I was the craziest individual for asking for help and confirmation on my fees. I have never felt more embarrassed to have to reexplain my situation to so many ppl to ultimately end up getting thrown to the side and disregarded. Please Help BBB.... * They are now refusing to honor the refund they stated in the BBB response. Also Mr Dennis the President of Simmons first tried to trick me into paying a $60/hr research fee to research all of the $5000+ in fees. Come to find out the bank offers no such service and has no factual doc to support anything of that nature.. He was trying to steal more money.. Keep in mind this is the President of a Billion dollar company and he either flat lied or has no knowledge of his own companies policies or services... Also he is refusing to provide me a detailed description of the items that were charged or associated with the fees.

Basically its like going to Walmart and them refusing to give you a receipt. If you give someone money they give you receipt to show what you gave them the money for. Why should i be denied this right from the ppl I trusted my life and future with. I have every right to request and be provided this documentation and they are refusing its very illegal as well as shady and could possibly be a peak into a lot bigger window of corruption and very much scam associated. Also to note the President has hung up on me 3 times when i requested this information and also after i asked for paperwork associating the $60/hr "research Program" he stated they offer which when contacting his secretary and multiple branches no one else seemed to know about it.. And he tried to make me pay him $60hr for a service they dont even offer.They have charged me over $5000 in fees and hang up on when i request docs to support the fees and charges. Not to mention he is not only hanging up on me but when i can keep him on the line he says he will not provide the information to me. Please not I did record all of our conversations and would be able to prove everything I am stating is true and that this Bank should in no way be trusted with anyone money. Then why did you cause this amount of fees??? You are the one that overspent your account causing the bank to access these fees. You are the only one that can stop these fees from happening. So if $5000 is not acceptable, have you changed your habits so you won't pay more???

Both responses were RIGHT ON TARGET.  Both hit the nail directly and very squarely on the head.  The original complainer here realizes that and has absolutely ZERO INTELLIGENT rebuttal.  So their response?  The typical brainless, idiotic, immature garbage of "you must work for them!"

$5000 is not acceptable! So your rebuttal sounds more like a Simmons employee trying to justify $5000 and cover up a fraudulant fee so they dont incriminate theirselves even further. Name a business where charging a customer over $5000 for doing business with them is acceptable? Take your time I will wait. Also if you knew the whole picture you would bite your toungue. If the Attorney Generals office and the BBB are concerned for you then you know you have something. The senator even took the time to write me adressing his concerns and offered helpful advice. Im certian he had better things to do if this was just your average run at the mill angry customer rant.

So an average of over $200/month in OD and Returned Check fees and it took you 2 years to actually realize that something was wrong?  Yes, you have every right to be upset...at yourself.  Because this is 100% on YOU and your lack of action.

I can tell you exactly what you did and didn't do, and why you are in the situation you are in. 

You failed to keep a written register, where you write down every time you made a purchase/withdraw.  As a result you continually spent more than you had available in your account, which is exactly what caused these fees.

You failed to review your monthly statements to realize you were getting all of these fees.  However, on the off chance you actually did review your statements.  You figured that the bank must be wrong and you ignored it.  Instead of trying to figure out how to stop it, you kept doing the same thing over and over.  

Yes in all of your complaining, it really just comes down to this.  Oh and no before you say it, no I do not work for this or any other bank, and would have said the exact same thing regardless of the bank you listed.

The cause of overdraft and returned items fees is the account owner. It is your responsibility to make sure that money is available for any transaction you authorize, And also your responsibility to maintain an accurate account register to prevent overdrafts.

The proof of the validity of the fees is on your statemnts. They will show what items posted negative causing the OD fees and what items were returned causing the NSF fees. You should have them or if you use online bnking you should be able to veiw/print them out.

Most banks do have a "research fee" set at a specific rate per hour for any intense research the customer requests. The rate would be documented in the Schedule of Fees and Services you received when you opened your account. Some bank employees, such as tellers, may not know about the fee as it is not something they deal with everyday. Just like requesed copies of checks or statements can cause a fee, requesting the bank have an employee do research on your accountcan cause a fee.

You state an average of $210 in fees per month. At $30 a fee, a usual amount, that's 7 fees per month. My question would be why did it take 2 years for you to realize something wasn't working right and ask the bank for help. They have resources available to educate account owners on how to avoid OD/NSF fees. Easily found on their website even by non-account holders.

As far as the Fresh Start program, it sounds like the Branch Manager tried to set you up in it but was overruled by the back office.

And just to prevent the usal comment, I don't now and have never worked for this bank. In fact, I've never heard of them until I read your post.
