SUMMARY OF ARBITRATOR DECISION

v.
Ashely Holtam, Author or Ripoff Report #691255

Complainant Simple Real Estate Solutions, Inc. (Complainant), has challenged the truthfulness of certain statements (each, a Statement) posted by Author Ashley Holtam (the Author) on the Ripoff Report website at www.ripoffreport.com on February 5, 2011, as Ripoff Report No. 691255 (the Report). The Author contends that the Complainant did not act appropriately in handling the eviction of the Authors son from property rented to the Authors son by the Complainant. The Complainant denies the allegations in the Report, contending that it acted in accordance with the law in proceeding with the eviction. The Author did not, in accordance with the Program Rules, properly submit a response to the Complaint. By submitting a Report and a Complaint on the Ripoff Report website, both the Complainant and the Author have agreed to submit the dispute to the Ripoff Report VIP Arbitration.
Each Statement challenged by the Complainant has been considered, together with any Witness Statements and Documents provided by the Complainant for determination of the truth or falsity of the Statement. The Author did not, in accordance with the Program Rules, properly submit a response to the Complaint.
The Arbitrator was asked to decide whether the preponderance of the evidence submitted establishes that each Statement is true or that it is false. If the statement identified by the Complainant is determined to be an opinion, no determination will be made as to that particular statement because an opinion cannot be determined.
The Arbitrator was further asked to decide whether the preponderance of the evidence submitted establishes whether the Author was, did in fact, have funds wrongfully withheld. The Complainant denies this accusation and legal recourse for his actions. The Complainant states that the funds were to be returned to the tenant if the property was vacated, the appliances were in working condition, and all personal belongings were removed by the eviction date. The Complainant further states that upon arrival at the property on the eviction date, the home was still full of the tenants belonings. Accordingly, the Arbitrator determined that the tenant did not have the funds wrongfully withheld.
The Arbitrator determined that certain statements in the challenged Report were false. Therefore, according the VIP Arbitration Rules, those statements have been redacted.

Mr Saunders apparently had legal recourse to do this, but the way he handled it leave a lot to be desired. (((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration))). On that date, Mr Saunders stated that if my son were out of the house by 15 Nov 2010, Mr Saunders would return the FULL amount of the cashier's check, (((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration))). Mr Saunders indicated that the only reason he was holding the check was to prevent my son from damaging the house or stealing the refrigerator/stove when my son left.

(((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration))) (((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)))When my son contacted the police that night, on my advice, to receive some kind of documentation that my son had cleared the house with no damage, my son found out that Mr Saunders was out of town.
The police indicated that they could do nothing to assist my son in either getting the money or the clearance paperwork.
On 28 Dec 2010, I wrote a letter to Mr Saunders bringing all this info to his attention. Mr Saunders replied on 3 Jan 2011 that he was under no obligation to respond to me because my son was an adult, he only had to respond to my son. However, there has been no response to my son's query (my son signed the same letter I did on 28 Dec 2010).
Mr Saunders also indicated that my facts were not accurate at all, but he never provided me with info as to where my facts were incorrect. Nor did he respond to my son.
On 5 Feb 2011, I wrote, and my son wrote Mr Saunders another letter asking him to respond to my son's request for the complete refund of the monies he was paid, a total of $950.00.
