Smith Family Farms, Tim Smith Dog Kennel, Breeder, Cedar Creek N.C. Bought a puppy from this guy and buy the next evening it was sick with parvo which has an incubation period of 4-10 days. I have now spent over a 1,000 dollars trying to save this puppy. Mr. Smith wil Fayetteville, North Carolina

We, Jason and Lori Brown, were researching chihuahua puppies for sale and found a "Smith Family Farms" 7175 Cedar Creek Rd., Fayetteville, N.C.  They had 2 female puppies there pictures were so cute and the ad stated that they were completely updated in their shots we foolishy did not research the reputation of this Kennel. Within 24 hrs. our puppy was in serious condition. Our puppy is now in an incubator with an I.V. in it's leg struggling to survive. We still do not know if she will pull through. We have now become yet another victim of Tim Smith and his breeding operation that is pumping out puppies with parvo who seem to be fine when purchased and then within 48 hrs. are dying with this virus.


I spent most of the day talking with Smith over the phone once we determined the illness. He said he was sorry but that the dog was healthy when it was sold to me. Two different Veternarians and medical science STATES that the incubation period for PARVO is 4-10 days. This means that there is NO WAY the dog contracted this illness after being purchased.  People like this discust me. Our hope is to bring together ALL who have been RIPPED OFF by this guy and get FULL compensation. I hope and pray that JUSTICE WILL BE SERVED. Strength in numbers. My family purchased a puppy from Tim Smith on May 12, 2010.  A male Boxer pup 9 wks old.  That was a Wednesday.  We drove to Fayetteville from Virginia Beach.  By Friday night our pup started throwing up, and would not eat or drink.  all day Saturday he layed around and would not eat or drink and had diarrea.  Sunday morning we put the little guy to sleep because the vet tested and found parvo virus.  Mr. Smith will not return my emails.  I contacted Cumberland County Animal Control about him and they visited him today, May 18.  They found no sick dogs or any violations.  They said he has had several complaints in the past.  Money is money but having to lose our new puppy was hard on the whole family.  Obviously, reading other posts, this guy is not on the up and up.  He would not show me the parents but said he would email pics.  That should have warned me right there.  Plus, the guy would not look me in the eye.  Take that as you wish but it means a lot to me.

 I am in law enforcement and will be following up with animal control down there.  You screwed the wrong guy Mr. Smith.  Man up, give people their money back and clean up your kennels.

Admittedly a sick puppy is a shame and My Heart goes out to you for this.

BUT, You should look into Small Claims court to sue them for Defective Product (Your Pup).

Did you receive any paperwork showing that the puppy had been vaccinated against Parvo? (Required under NC Law if they are a licensed breeder) Not the Advertisment but actual Vet's Documents showing Dosage and Lot number of the Vaccine administered.

You can recoup up to $7500 in Small Claims court without having to hire an attorney.

Posting your complaint on ROR should have been your OTHER option. Call your county Court Clerks Office and they will advise you on what paperwork needs to be filed and how to serve Mr. Smith. If Mr. Smith does not respond to the Summons you will win by default and the sheriff can seize his property to pay the Judgment.

I know this does not make up for the potential loss of a loving animal.

Report his "Puppy Mill" to the State of North Carolina Animal Welfare.

Here is the Law:

NC Animal Welfare Act. (1977, 2nd Sess., c. 1217, s. 1.)

19A-21. Purposes. The purposes of this Article are (i) to protect the owners of dogs and cats from the theft of such pets; (ii) to prevent the sale or use of stolen pets; (iii) to insure that animals, as items of commerce, are provided humane care and treatment by regulating the transportation, sale, purchase, housing, care, handling and treatment of such animals by persons or organizations engaged in transporting, buying, or selling them for such use; (iv) to insure that animals confined in pet shops, kennels, animal shelters and auction markets are provided humane care and treatment; (v) to prohibit the sale, trade or adoption of those animals which show physical signs of infection, communicable disease, or congenital abnormalities, unless veterinary care is assured subsequent to sale, trade or adoption. (1977, 2nd Sess., c. 1217, s. 2.)
