I was hired to work for a private automotive repair business at the beginning of the month.  All the hiring and wage details were discussed and agreed upon.  The business owners own words to me were " Don't worry, I'll take care of you."   I began in the middle of that week and paid for what I did those 2 work days.  I asked for a payment reciept for the work I performed and they said they would get it to me.
The beginning of the first full work week with them, they were late every single morning opening shop.  I would be there on time every morning, and I would sit and wait for a good 30 minutes before they would show up.  It's a family owned business, and they would have their children there during business hours in the office.  I was the only full time mechanic.  Again I mentioned needing a pay reciept and they said they would get it to me.
Come Friday, payday, I was not paid the full amount for that week.  I personally keep track of all my jobs and hours I work on each car/job I do.  I brought my paperwork to the owner(s) and let them know that I hadn't recieved the entire amount.  They said they would take care of it.  I was already behind on my own personal bills and I explained my situation to them, so they were aware that I needed to be paid for the work I had done.  It was promised that it would be taken care of.
Another week goes by and I'm still waiting on reciepts or some sort of paperwork from them.  They would leave and take care of their own personal business without taking care of what I needed done.  That Saturday alone, I worked over 12 hours and also did work on their own personal car.  At the end of that day, he paid me, and again it wasn't the full amount.  I pulled out my book again and said that I was still owed and it wasn't adding up.  I needed to be paid or I needed to get another job that would pay me.  He immediately got angry with me, calling me a thief, shouting at me "well what have you done for me???"  I was working for him!  I still hadn't gotten paid for previous work, and still needing paperwork from them and I hadn't gotten anything.
I had to explain to my landlord the situation, that again I couldn't pay rent yet because they owed me money still.
The next Monday I started to look for a new job.  I went to get my tools to take home, and I was approached by the owner's wife, asking me to "please don't leave.  I will handle your pay, I'm sorry for how my husband treated you. Don't worry, I'll pay you today. I will give you a raise of $5 more if I stayed." 
I stayed.  I waited.  No pay.  So I told them, when they have the money they owe me to call me and I'll come back in.  Never got a call.  So I tried calling them.  No answer.  Called their cell phone .  No answer.  Come to find out, they hired someone new...and they still owe me! 
And come to find out, they are denying every single thing they said to me about what we agreed my pay would be when I was hired on.  They are denying that they said they would give me any sort of pay  or pay raise.  Instead they are saying if I come back to work for them, then they will pay me.  They are withholding my pay for the work I have already done, and I still have not recieved one proof of payment or any kind of reciept from them. They have a gun on the premises in their office.  And they keep their kids there during hours and around a gun??
I called the Labor board, I've called DHR and I've contacted the local news station.
I want to let everyone know what they are doing.  Not one customer not one potential or current employee needs to be associated with these people.
They claim that they have over 20 years experience.  This is absolutely false.  They have no experience whatsoever in the automotive field.  They want certified mechanics working for them for free.   They pay when the want, what they want or when they can.  Meanwhile, I have hours and weeks working in with them and have  recieved no pay whatsoever for what I've done.  I've rebuilt transmissions for them and I have NO money from doing it.
Hiring on someone to work for free is illegal.  I will recieve my money that is owed to me for the work I've done.  And I will make sure that everyone knows just what they are doing, and what they have done to me and my family.

So I see that an ex-employee of ours has decided to tell the world a lie about our locally owned and operated mechanic shop.  However, I would like to tell the world the truth about the situation that had taken place.  After reading this complaint I am sure that I know who wrote this, but I will stay professional and not mention any names.  Since this person decided to write anonymously I will handle this accordingly and just go down the paragraph written and point out the facts and lies. 

I personally handle employee pay and hours weekly so I am speaking from this first hand.  First of all, I keep weekly records of hours/pay in a columnar folder and have each employee initial beside the work that has been completed by them at the end of each work week.  Therefore, if anyone wanted a pay receipt it is easy accessible to make copies to do so.  Not one of our employees has ever asked for a pay receipt of any kind.  However, we keep this record because we hire our technicians as contractors and pay based on commission.  In doing that, the contractors are responsible for filing their own taxes so it is a MUST that we keep good records.  So that statement given is a complete lie! 

We are a family oriented business and we try to keep open communication with our employees and treat them like family as well.  As far as opening up late, that did happen occasionally.  I have 3 school age children who cannot be to school until a certain time, therefore leaving me running late some days.  This was not anything that our employees did not know upfront.  It is not something done to inconvenience anyone or waste anyone's time.  On the other hand, we are lenient about our contractors arrival time to a limit.
Yes, my children are here somedays.  That statement is partially true.  They are not here all day, everyday.  Furthermore, they do stay inside the office and not in the shop area where workers are working.  They are in no way disruptive to our employees or in an area where they can be hurt.

Back to the pay situation, each of our employees is paid on commission.  For those who are unaware of what that is the mechanic business let me try to lay it out for you----hours are calculated based on a computer system that tells someone how long it takes to complete a job.  Those hours are considered "book hours".  ie. -----If the book hours state that it takes 3 hours to complete a job, then the technician is paid for 3 hours.  If it only takes them 1.5 hrs to complete the job then they are still paid for the 3 hours, however if it takes them 5 hours to complete the job, then they are still only paid for the 3 hours.------  Anyway, I stated all that to say that we have always paid our employees in full and on time based on book hours for jobs completed.

This particular ex- employee was asked to stay after initially trying to quit because we were unsure of why he was quitting and wanted to try to resolve the issue with him.  We had indeed discussed pay rate with him upon initially hiring him.  We even gave him a raise after the first week of him working based on his work ability.  After that, he was paid at the same rate for 5 consecutive weeks.  It was not until the 5th week that this employee had an issue with his pay and brought it to our attention.    Once I sat down and compared his notes to my records I realized that the error was on his part and not on ours.  This employee was calculating his pay at a rate that was totally unreasonable, instead of the rate that he had agreed on.  So once that was determined to be the error and was unresolvable because it was so unreasonable then we had no choice but have him leave.


Another comment listed states that we keep a gun on our premises.  It is not a crime to have a gun.  I have a pistol permit and am permitted to carry my gun on me.  It is strictly for my protection.  It is not anywhere that it can be accessed by my children, nor anyone elses.  My children are safe with me at all times.  So for that to be assumed upon is degrading to my character and unacceptable.


This person is WRONG in the situation and even more wrong for writing this complaint.  I keep records of everything here that will prove the truth in the situation.  I have no reason to lie and handled this situation head on, instead of avoiding it as he stated.
