My family and I decided to go on a trip to Kings Island on Saturday the 31st of August. We booked our reservation well in advance. They explained to me they will hold the amount for the rooms with a credit card, and we can pay cash when we checked, and we wouldn't be billed. Thinking to myself okay fair enough. The date we booked it for was the 31st of August which was on Saturday for 1 night. Proceeded to write down all of the information and the times to check in, etc. The day before we checked in they called my cell phone to confirm our reservation for the 31st of August of 2013. At this point the family was really excited about this trip. On the 30th of August in 2013, which was on Friday. My family and I stayed at the Days Inn East in Cincinnati, Ohio on Friday night to be closer to Kings Island. Before we went to Kings Island on the 31st of August in 2013, we went down to Super 8 motel to check in during the times we were supposed too. The motel went ahead and charged my credit card for the room, and my initial was this could have been an oversight, and I would give them time to correct the problem. When we checked in we paid cash, and we got a receipt for the rooms for 1 night. After we checked out, I kindly asked if they fix the problem with my credit card being charged, and the lady told me she will leave a note for the manager to take care of this. My reply was, "Thank you, I appreciate that". In the meantime, I kept an eye on my online account activity to see if they refunded the money that was overcharged back to my credit card. Because, I was told to give 5-7 business days to show up. The time had expired and nothing was done, so I called the Corporate office for Super 8 Motel, and they filled out a formal complaint for the motel manager to give me a call. That night the manager calls and I told him what happened, and keep in mind, I was on 3-way calling with a supervisor from the corporate office, and they said, "We see the problem you were charged because you were a no call no show for the 30th of August, which it was a misunderstanding on our end, because your reservation was for the 31st, and we will correct this immediately. Two weeks had passed so I decided to call my credit card customer service to dispute the charges. The credit card disputed it and the motel told the credit card dispute department that I was a no call no show for the 30th of August in 2013. I called a local attorney to take legal action, and that law firm wouldn't take the case, and they wouldn't go into detail. Keep in mind, I have the billing statement where I was overcharged, and I got the receipt from the motel when we paid with cash when we arrived. Until this day, I haven't been refunded and this is the 14th day of October in the year of 2013, I haven't received my refund for being overcharged. If there's an attorney out there that would take this case, I will supply all of the information that he/she may need to file a class action lawsuit with the Super 8 Motel.

 Good words for a rebuttal and talk about slander. You know I believe in the Golden rule. Wal-Mart has an optometrist there during normal business hours for you if you need it.

Clueless...

 Perhaps you got some of your "gray matter" shaken loose by the roller coasters or you are just watching too much CourtTV.  Because you don't even have the faintest idea what a Class Action Lawsuit really is, let alone how much it costs and who is the real "winners" in a Class Action Lawsuit.

First of all you need to file a regular lawsuit and then if you are lucky get a judge to certify that this happens to a "class" of people and gives you Class Status.  For an attorney to even take this on you are looking at a 20-30K retainer fee paid to them up front.   That is unless you have a slam-dunk case against a mega corrporation that they can get a lot of publicity off of..which you do not.

The first attorney did you a favor.  He/she would have cost you several hundred dollars up front to take your case, and for probably under $100 it isn't worth the time or effort.

Now, what you SHOULD have done, and you still have a couple of weeks left is to contact your credit card company and file a dispute.  You have 60 days to dispute it so you can not delay.  The exact procedure should be on your statement.  If not, call them up and ask them the procedure.  The reason for your dispute is that they charged your credit card and took cash from you.   Now, not to say that they will see it your way, but you need to try this before the window closes.  

However, if you truly did have a reservation for the 30th and you did not show up, then the charge is valid per their policy and you will not win any dispute or court case.  Of course if you still think you are right, there is nothing that says you can't file a suit against them in Small Claims.  But please drop the Class Action nonsense.
