We were really surprised that it is legal in the "Land of the Free" to intimidate and threaten people to sign "agreements".

Previously we had seen this only in certain mafia-movies when business owners are offered "insurance agreements" from agents with loaded weapons.

We bought a rental property that is connected to a septic tank about 2 1/2 years ago and were pretty surprised when we started to receive bills from SMCFD #1 for "sewer services" a few months after closing. Neither the seller nor the title company had disclosed that one of the previous owners had signed a so called "Petition" with SMFD, saying that the owner of the property would have to pay sewer fees regardless of not being connected to the sewer.

We started to make the payments of $ 32 to the sewer company and went to court against the seller of the property for not disclosing this material fact.

Now, years later, we have received a letter from Carolyn Garverick from SMCFD that says that the property where we are living in (and that is connected to the public sewer line) would be disconnected and declared uninhabitable if we would not sign an application for sewer services. We were also forced to sign an agreement saying that we are "desirous to receive sewer services" for the rental property. If we would not sign this agreement for the investment property we would be evicted from the home were we are living in.

5 days after receiving the letter from Mrs. Garverick we found a fluorescent note attached to our fence saying: "A disconnection order has been issued" We had to sign the application and the "Agreement" that would say that we desired sewer services for the other home the same day without any other options.

SMCFD lost in court

Good news: in a recent case in which SMCFD thought that they don't have to ask anybody for permission because they feel like they are "the government" (even if their name ".... -District" implies that they are a government agency, it is a private company !) they were found guilty of trespassing.

SMCFD ran a sewer line through a mobile home park without asking the owner for permission. In court the judge found that their attitude "its in the public interest so the interest of an individual does not matter..." was wrong.

We have done some research and found out that SMCFD #1 has a long history of reaching their goals by scaring and intimidating septing tank owners:

In order to make them sign their "petition" years ago, SMCFD told septic tank owners that their tanks would not last forever and that they would charge them a horrendous amount of money at a later point of time when their septic tanks should become defective. In this case they would not be allowed to repair their septic tank but they would have to get connected to the sewer line for a fee of aproximately $ 20,000 or more + the cost that a contractor would charge.

If, on the other side, they would sign the "petition" immediately, they would not have to pay this $ 20,000 fee. The total cost of getting connected to the sewer line, even with a signed "petition" is still $ 6,000 or more, that's why many septic tank owners ended up with an "agreement" to pay sewer fees of around $ 400/ year without ever receiving any services.

Only with SMCFD's horror vision: "Your septic tank is going to brake soon and then you are going to have to pay an additional $ 20,000 in fees if you don't sign now" this company was able to get sewer fees from customers who never had a problem with their septic tank.
