my story begins in may of 2013. I entered into agreement to purchase a samsumg s3 phone, and a 24 month to month service agreement. I was told that I would get a rebate of 50 dollars (at which time I completed and mailed the rebate form). everything went moothly until t mobile took an about face, and denied the rebate, saying I didnt have the "right plan". it seems that even though you pay for a premium plan, and in mycase, the very highest amount and unlimited everything, you dont qualify unless they say so, based on, it seems, on their whimsical practices. anyways, I digress.
to continue, I called them and inquired about why I was disapproved. their answer was, ...."the individual who sold you the phone made the rebate statement in error. you werent supposed to get the rebate." my contention here is, that he was an agent of the company, who made a point of fact statement of which we both entered into agreement, later of which t mobile corporate back peddled on. anyways, because they jerked me off of the rebate, I told them that was wrong, and the sole purpose of buying the phone was to receive the rebate. their answer was sorry about that buddy. too bad. so I then told them to take the phone back and we'd call it even. they said no way that was happening because the return period expired (45 days).
so I became upset, quit t mobile that day and went to sprint AND EVEN PAID MY CURRENT BILL. t mobile subsequently billed me, with erroneous charges to boot on my final bill (monthlly service charge - for the month I was never there, and for insurance on a phone I didnt have). I called them, explained that I WANTED THE d**n INSURANCE COST REMOVED MONTHS EARLIER, BUT THEY NEVER TOOK IT OFF, AND I WASNT PAYING FOR A MONTH THAT I WASNT THERE. the young lady agreed, adjusted the bill and allowed me to make 4 monthly payments to pay off the phone and for cancellation fees.
I have since paid the bill AND T MOBILE KEEPS CALLING ME TO PAY AN ADDITIONAL 72 DOLLARS FOR FEES THAT THEY MAKE UP. ADDITIONALLY, THEY REPORT ME AS LATE, UNPAID ON MY CREDIT HISTORY REPORTS, AND CALL ME UP EVERY DAY AND HARRASS ME ABOUT THE d**n 72 DOLLARS. IVE TALKED TO NO LESS THAN 50 PEOPLE AT T MOBILE ABOUT THEIR SCREW UP, BUT ALL I GET IS, " WE UNDERSTAND YOUR FRUSTRATION, AND WE WANT TO RESLOVE THIS ISSUE, BUT YOU OWE US MONEY." NO I DONT! what part of I have proof I paid my bills on time, every time, and have proof that they jerked me off, that they dont understand? I am suing their a**. and asking a judge for the max. anyone who wants to join me in court is welcome. I will commence the process on or about september 5, 2013 in the county of orange, california superior court.
