I HAVE PAID $840 TO TALKFUSION TO PROVIDE ME WITH THE SOFTWARE THAT THEY CLAIM WILL ALLOW ME TO CONNECT WITH OTHERS PEOPLE BY VIDEOCONFERENCING. I WILL ALSO BE ABLE TO INVITE FAMILY AND FRIENDS TO THEIR VIDEO CONFERENCING AND START MAKING MONEY. THEY BASICALLY TOLD ME THAT THIS $750 WAS A DEPOSIT THAT IF I DO NOT WANT TO CONTINUE I CAN ASK THE REFUND.

UNFORTUNATELY, I WAS NOT ABLE TO USE THE SERVICE FOR MY PRIVATE NEEDS BECAUSE THE SERVICE IS NOT WORKING THE EREA WHERE I LIVE. I LIVE IN ARKADELPHIA, ARKANSAS. I IMMEDIATELY CONTACT TALKFUSION'S REPRESENTATIVE WHO INTRODUCED ME TO THIS COMPANY. HE HELPED ME SOLVED THE PROBLEM BUT IT WAS TEMPORARILY THEN IT QUICKED WORKING AGAIN.

I ASKED FRIENDS AROUND ME TO TRY TO CONNECT TO THE VIDEO CONFERENCING AGAIN NOBODY WAS ABLE TO CONNECT. AFTER 3 WEEKS OF UNSUCCESSFULLY ATTEMPTS TO SOLVE THE PROBLEM, I ASKED FOR REFUND. THEY TOLD ME THEY CANNOT REFUND BECAUSE THE POLICY SAID AFTER 3 DAYS THEY CANNOT REFUND THE MONEY. I USED A DEBIT CARD, CURRENTLY MY ACCOUNT IS NEGATIVE FOR THIS AMOUNT.

WHAT CAN I DO IN THIS CASE TO HAVE MY MONEY BACK?

Please note that it is the official position of Talk Fusion that the purchase is 100% valid for the following reasons:

Mr. Georges purchased the product on March 15, 2013 online from the Talk Fusion website, www.talkfusion.com.  

At NO TIME did Mr. Georges request to close this account within the allotted 3-day time frame.   As the Agreement proves, there is no “Deposit” of any type. The funds paid by Mr. Georges were for the product purchase in its entirety.

Mr. Georges did not submit any cancellation request until April 12, 2013 which is almost 30 days AFTER the refund eligibility timeframe had expired.

Pursuant to the Electronic Commerce Merchant Refund Policy Disclosure, Mr. Georges was provided with the “Proper Disclosure of the Refund Policy and the Recurring Transaction Policy” during the order process. These Disclosures are clearly posted on the same page as the “I Agree” Click through process within the sequence of Web pages accessed by Mr. Georges before the final checkout.

For ease of reference, the Refund Policy on the original purchase is as follows:

If any Independent Associate or Customer is unsatisfied with any product purchase for personal use, Talk Fusion offers a 100% three (3) day money-back guarantee. Please note that shipping charges and sales tax are not refundable. Returns in excess of the purchase price of $250 will be deemed inventory returns and will he handled in accordance to section 7.2 of the Policies and Procedures titled - Return of Sales Aids by Associates Upon Cancellation. Returns in excess of the purchase price of $250 shall also constitute an Associate’s voluntary request to cancel.

The Customer agreed to the aforementioned purchase conditions on March 15, 2013. Hence, the refund eligibility period on the original purchase expired on March 18, 2013.

In closing, Talk Fusion has proven the purchase is valid.  Mr. Georges was provided proper disclosure and acknowledged the Refund Policy BEFORE the purchase was made.

  1. Mr. Georges immediately received the product that was purchased.
  2. At NO TIME did Mr. Georges request to close this account within the allotted 3-day (72-hour) time frame.
  3. Mr. Georges derived benefit of the product and logged into this Talk Fusion account up to and including April 12, 2013 when the cancellation request was submitted.
