Choe lost Motion to Disgorge Fees in court and was ordered to return $50,000.  Judge called his behavior in my case "reprehensible."

I represent elderly clients that have been ripped off by The Law Offices of Gene W Choe.  I have filed a suit in Santa Clara County and a State Bar Complaint alleging the criminal activity of this law firm.  

Similarly to this report written by the victim above, my clients signed a contract to have a suit filed to reverse a foreclosure.  Once the law office received their "retainer" and an ACH automatic account monthly withdrawal, they stopped communicating with my clients, totally.  No law suit filed.  No refund sent after demand.

Choe's firm violates the Consumers Legal Remedies Act CC 1780

My clients canceled the contract and the law office kept taking monthly withdrawals out of their account!  There was never an account statement sent, no work done, no return calls or return emails.  

What the public doesn't realize is this firm used with my clients unlicensed sales persons and consultants legally termed "runners and cappers" to sell their services.  This is illegal according to Business and Professions Code sections 6151 through 6154.  Having unlicensed attorneys sell a client is not only illegal but also voids the contract.  I believe all consumers may obtain a full refund of their money back from Choe's law firm according to proof of this violation.

Keeping refundable money is also illegal.  But the worst is where the firm delays processing of your action/matter in order for them to collect monthly fees.  That is criminal activity as defined in Business and Professions Code Section 6128, punishable by fine and jail.

The firm did not include the mandated Notice of Cancelation forms in the attorney client contract, violating the Mortgage Foreclosure Act.  The Law Offices also takes advance fees...this is prohibited in the Mortgage Foreclosure Act as well.  They did not provide my clients with the notice that advance fees are prohibited.

The entire $50,000 was returned to him already. The client enjoyed at least a year's worth of mortgage free living at his house. It is terribly upside down and has no equity. He was denied at least 9 times for loan modification before retaining the firm. We could not guarantee against the loss of his home as he made a choice to default on his mortgage. He and his wife makes at least a quarter million dollars from employment, a Sheriff and a registered nurse.

Also, they own 4 other rental properties which throws off handsome monthly rental income. In the end, these clients enjoyed mortgage free living for almost a year and whatever legal fees they paid were all returned. The firm did not get paid any fees worth at least $40,000 and costs of $5,000. Attorneys cannot guarantee any specific outcome in any case. While the firm could not assist this client with ultimate success with his home, the firm rescued almost 700 homeowners from losing their homesteads. The firm continues to fight the lenders for many more of its clients. 

Incidentally, the bankruptcy attorney and his paralegal after terminating employment with the firm now represent this particular client. The "multiple" bar complaints this client refers to do not allege negligent representation, but rather fee disputes. Most of them have been determined frivolous and have been rejected by the Bar for any further process.
