NOTICE TO JOHN DOE A/K/A "DAVEY CROCKETT":

A lawsuit has been commenced against you and is captioned Paul v. John Doe a/k/a "Davey Crockett."  The claims made against you in this case arise from your anonymous post about Mr. on the Ripoff Report website.  It has been filed in the Superior Court of Gwinnett County, State of Georgia and has been assigned the civil action file number 10-A-09059-7.  The Plaintiff in this case is attempting to uncover your true identity through various discovery requests sent to non-parties.

On October 29, 2010, the trial court in the case issued a "Commission to Take Deposition" to the Clerk of the Superior Court of Maricopa County, Arizona requesting that the Clerk of the Superior Court of Maricopa County, Arizona issue a subpoena to the Custodian of Records of Xcentric Ventures L.L.C. d/b/a Ripoff Report to cause the Custodian of Records to appear for a deposition and to produce the following documents:

1. All postings made by Defendant John Doe a/k/a Davey Crockett upon the Ripoff Report website hosted or operated by Xcentric Ventures, LLC d/b/a Ripoff Report (www.ripoffreport.com) concerning Plaintiff Paul.

2. All subscriber, poster, or member information and details for the individual or individuals using the posting identity Davey Crockett on the Ripoff Report website, specifically including Report #644134 (http://www.ripoffreport.com/employment-services/paul/paul-aka-global-energy-e-ba9b2.htm). The information requested includes, but is not limited to: first name; last name; usernames and aliases; passwords; email addresses; home and work addresses; zip code; and home, work, and cellular telephone numbers.

3. Any and all records pertaining to user login information for the individual or individuals using the posting identity Davey Crockett on the Ripoff Report website, specifically including Report #644134 (http://www.ripoffreport.com/employment-services/paul-syiek/paul-syiek-aka-global-energy-e-ba9b2.htm). The information requested includes, but is not limited to: all remote IP addresses with corresponding dates and times logged by your system on each occurrence of the account being accessed, and remote IP address, date and time logged by your system when the account was created and all other information pertaining to the account in the custody of Xcentric Ventures LLC d/b/a Ripoff Report.

4. All documents referring, reflecting, or evidencing Defendants true identity.

On November 8, 2010, the Plaintiff filed an Application for Issuance of Subpoena in Foreign Action with the Superior Court of Maricopa County, State of Arizona. This matter is styled Paul v. John Doe a/k/a "Davey Crockett" and has been given the case number CV2010-031867. The subpoena requested by Mr. seeks for Xcentric Ventures L.L.C. to produce the requested documents numbered 1 through 4 above at a deposition on November 30, 2010, at 10:00 a.m. at Bryan Cave LLP, 2 North Central Avenue, Suite 2200, Phoenix, AZ 85004-4406. This subpoena has been issued and shall be served on Xcentric Ventures L.L.C.  Unless you move to quash the subpoena, Xcentric Ventures L.L.C. may produce the documents requested by the Plaintiff. You may wish to consult an attorney to advise you about the foregoing.
