Title Max owner Jerry is attempting to break the law big time when it comes to AutoPawns.  The Law in the State of Georgia says that,"...The customer has the right to settle any disputes when it comes to Auto Pawn dealerships...."  I am unemployed at the moment with no income and have spoken with Title Max franchise owner Jerry whom is very aware of my situation.   I had a payment of $95.00 that was sent to Jerry in January 2013 but because the premiem was supposed to be $95.87, he held on to the check for that entire month!!  Jerry of TitleMax would not credit my payment because it was a mere 87cent short!!!   His workers called my phone, left messages, emails, texts and everything else because of 87 cents!!  This was the most redicuoulsy thing that I have every done(doing business with TitleMax).  Because of 87cents they called and harrassed me and threatened to return it.   The second month was February 2013.  The payment schedule clearly says to pay $94.50 but when I sent the $94.50 to him, he returned it stating that it was supposed to be $95.87?   Just a dollar and some change and he returned the entire money order.  This wasn't the beginning of it.  Now in March 2013, I am still unemployed and owner Jerry was informed way back in February 2013 that,"..March would be a bad month for me because I still do not have a job.."  I made an attempt to give Jerry $50.00 in cash to cover the month of March because I am in a Financial Hardship and just cannot afford to gim him $95.87.  Jerry of TitleMax(2015 N.Druid Hills Rd)stated,"....No can't do it....if it ain't for the full amount than I am going to have to turn your account in for collection(of your car).."  What does he mean he can't do it?  No where in American can ANY car dealer or business FORCE money out of someone.  I never forced the loan from him?  No I didn't so all these crap about AutoPawn dealerships getting the Police involved is a bunch of crap and lies and is only designed to scare you and nothing more.  Just to scare you. No police officer in America is going to listen to these con-artists lying about someone not making a payment if that person is doing all they can to rectify the situation. Once again the law in the State of Georgia says,"...The customer has a right to settle ANY disputes when it comes to these autopawn dealerships..."  "...The customer and not the pawn broker..."  If Jerry of Titlemax wanted to insure that he received his payments, well then he should KEEP these cars in exchange for the loan.   A title?  Anyone can sell a car without a title and he knows it.  A friend of mine had to sell his car to pay off one of these TitlePawns brokers.   I would never do such a thing but you never know in the face of intense pressure by TitleMax owner Jerry.

Oh My Mr. Matlock,

Well explain to all of us how come I was able to get a lawyer and still get my title back? Explain to all of us how come I didnt get arrested when the police came to my home to get my car? Explain to all of us How come the company you are defending turned whiter than flour when i got my lawyer? Everybody Situation is not the same but sometimes similar. Point is this you are wrong. The way i went to make sure i didn't get screwed was the correct way and i will do it one hundred times again if i have to.
            Once again it is CIVIL not a Criminal Matter. So therefore research your history because every state has different laws Mr. Court TV.  I am here to help people who are in a bind like i was with Titlemax. If you feel you always have to have the smartest remarks and most popular article Please Go WORK FOR USATODAY!!

This is pretty much Standard Operating Procedure.  When a person realizes they are wrong and have nothing..they go to the "You must be an employee".  Well sorry to burst your bubble, but I do not work for them(or any of the other couple dozen companies I have been accused of working for).

The facts are still unchanged.  You can not show in the laws you are trying to use that you can basically make any settlement offer you want and they must accept it. 

As to your continued statement that you are safe from the cops.  If you had any reading comprehension you would realize that you are living in a dream.  As stated IF Titlemax wanted to Reposes your car because you failed to live up to the contract.  Then if for what ever reason you made it impossible for them to do so, they do have legal avenues to take.  One is to go to court, and since it is a Civil matter you are still NOT entitled to a lawyer.  In court they can make their case and since they can show that you made an agreement, and have not met the terms the judge will issue a Court Order for you to hand over the car.  Then one day shortly after that the Officers will show up at your door and you have a choice either hand over the car or don't.  If you chose not to, then since you are now in violation of a court order they can arrest you.  Where you are now subject to not only additional Civil penalties.but Criminal ones.  Of course for the criminal ones the lawyer will help..but you are still on your own for the civil.

I just happen to notice one more of your lovely interpretations.   You can NOT legally sell a car without the title.  If you sell the car with them as a lienholder, you have totally crossed the line into the "Intent to Defraud" and have zero chance of prevailing if they ever sued you and they may even decide to bring criminal charges against you.

Oh and you don't have to believe me...just do a search for "What happens if you hide your car from repossession".    But I warn you in advance..you may not like the answers you see.

Your whole claims are false. No Police gets involved in civil matters. You Are an employee of Title max using a scare tactic to make someone worry and pay and etc. Since you work for these bitchesx  You obviously have forgotten that it is your responsibility as a title max employee to put a tracker on the vehicle just in case the person stops paying on the loan.  You guys didn't do that in this case further more Once you get a lawyer everything changes. Cause u have a right to a hearing and etc. See assholes like you who were taught how to fuck over people as an employee should be ashamed of yourself.

It seems as if you have a very loose interpretation of the law.   It says you have the right to settle, it doesn't say that the pawn broker MUST accept your settlement.  It also doesn't give guidelines as to what that means.  Well let me put it this way..the one sentence of the law you posted doesn't state that.  I bet the full text of the law is a lot more interesting..and damaging to your claims.

- Your right you never forced the loan from him.  What you did do though is go their on your own free will, and in exchange for them loaning you the money you agreed to certain terms.  One of which was to make your payments on-time and for the scheduled amount.

- Your right they can't. But what they can do is take every legal avenue available to them.  In your case repossessing the car.

- You want to bet?  There are people every day all over the country who have their cars repossessed even though they paid "something".    By the way there would be no lie in this case.  By your own admission the amount due was $95.87 and you tried to pay him only $50.      I guess in your mind if you wanted to pay him $1 that would be just as good as $50 because you were trying to "rectify" the situation.

Here is actually what would happen.  The company would locate your car, and if they can not get it voluntarily they would then go to a judge.  The judge would see that a)You did get the loan, b)You did not make your FULL payment, and c)in the loan you signed you gave them the right to reposes your car.  At that time the judge would issue a court order, and then the company along with the County Sheriff would show up at your door.  At that time you have a choice..hand over the car or go to jail.    Oh and you say they wouldn't do that because it would cost them too much..well guess what.  That cost is passed on to you.

The real sad thing is that if you put 1/2 the effort you are putting in to try and prove that you are entitled to things that you are not..you would have zero problem actually finding a job.
