I was on Troy hwy. making a turn onto Virginia loop road in montgomery, al and my light was green when I made my move right before the light switched to yellow. When I got right onto the road, the driver failed to yield the right of way onto a service rd. and I hit the back side of her car. When the police arrived and asked questions as to what happened, the driver(female) lied and said that her light was. The officer later determined that it was her fault. So I contacted her insurance(Travelers) and after the adjuster reviewed the police report she decided to deny my claim.

I didn't even know that my claim was denied because i called the adjuster several times and I couldn't reach her(elizabeth fowler), when she did answered she hung up on me twice. I called the main office and they told me that they were trying to collect from my own insurance company and i asked why and they said it was because my claim was denied. So I decided to call the adjuster in the first hour of her work time, she answered, then she told me that she denied my claim. I asked her why, and she responded with some ridiculous sh*t that the accident was 1 percent my fault because I could have stopped the accident. So I decided to get a lawyer.

Rental costs

So it would be better to claim just rental and insurance, no fees. Which amounts to $75.

I would be leary...

I asked the adjuster if I could use a friend's car for the rental at the same rate that a rental dealer would charge, and she said yes.

If you are saying that you are going to try and claim $100 a day(or even the $80) on a car you borrowed from your friend that may be a tougher claim if it got to court.   

Because they could try to claim that you were just trying to extend this out to make some extra $$$$ for your friend.  After all if your friend is getting around $560-$700 a week for doing nothing more than letting you borrow a car what incentive is there to get your car fixed?    Just think if you go 10 weeks you could get a decent used car and pay for it outright with the $5,600 to $7,000 in "rental" costs from your friend.

Would you be able to claim something..sure.  But a lot of the cost for you is the underage fee as well as other fees and taxes that your friend isn't paying. 

Just something you need to keep in mind.

Rental costs

The rental quote was from hertz. The rental car on the quote is a toyota corolla, my car is a dodge neon. The rental altogether with tax and fees for being under 25 amounted to $80/day. I then added loss waiver insurance to it which costs $19.99 a day. I haven't paid for the rental yet. I asked the adjuster if I could use a friend's car for the rental at the same rate that a rental dealer would charge, and she said yes.

Should you try and claim the rental car expenses..here is my two cents.

Generally you can claim the cost of a rental in any damages, so yes claim them.

But with your rental car expenses approaching DOUBLE the repair estimate you may have some issues to try and prove that you are not trying to take advantage of this situation.  After all if you have $3000 for a rental why didn't you just pay the $1700 for the repair and go after them to reimburse you?

Not knowing the exact length or what you are renting on the surface $700/week seems a bit excessive even with an Under-25 Driver.

One other thing to think about is the car type you are renting.  If the rental is a significant "upgrade" to your regular car they could also see that as excessive and only reimburse you up to the amount that a lower level car closer to yours would have cost.  Of course that works the other ways as well, if you are renting one significantly lower than yours, you could show that you were not trying to take advantage of it.

Accident costs.

The adjuster's estimate on the repairs is $1700 and the rental cost right now is more than $3000 because it has been more than thirty days. The more they keep delaying the process, the more it will cost them. I just hope I'll be able to get rental reimbursement after the lawsuit. I'm 21yrs. old, and when someone is under the age of 25 the rental costs the person more. I'm just wondering if I can also sue for the rental costs.

Simple.

  If your sure of your facts (that it was the other drivers fault), the solution is simple.   If your damages are $15,000 or less, you can file in small claims court without a lawyer.  Just file suit and if the insurance company truly believes their client was not at fault, they'll defend the suit.   More likely, they'll realize that their driver was at at fault and they'll settle with you before the court date.

Well I have to admit this is a new one.  You hear a lot of times they say well it was 50% your fault so we are only paying 1/2.  So perhaps you want to take this path.  Where once they say that it is 1% your fault, then you tell them to pay you 99% of your claim against their driver.

Of course if that doesn't work then sue the driver.  If the claim falls under the "Small Claims" limit just take them to small claims court and avoid the lawyer.
