We entered into a contract with United-Bilt Homes on 10-08-05 to build a custom home. The foundation of our home was not constructed to the plans or specifications. Our contract clearly states the home would be built to specification, drawings, floor plans, etc.

We made United-Bilt Homes aware of the mistakes that were being made on our foundation the day the foundation was being constructed, and were ignored, until we hired a professional engineer to back up our claims. At that point United-Bilt made a halfhearted attempt at correcting one of the issues.

This quote is from a letter United-Bilt sent to the Better Business Bureau.

We regret it has taken this long to finish and are working to address the Davis' concerns in accordance with the terms of the contract and the warranty We do not claim to be faultless; we recognize we have not handled this project with the speed and planning we should have, and regret the Davis have had to point out so many of our errors. We are working to correct all of those.

Alan Gauldin is the company's general manager and attorney, he has made it more than clear that United-Bilt Homes did not have to build this home exactly to the plans and that there are no contract plans as stated in our agreement.

This quote is from a letter United-Bilt sent to the Better Business Bureau.

One point of confusion that I may be able to clear up is the "contract plan documents." The plans we made for construction of this home are not part of the contract. We have provided the Davis' a copy of those plans as a courtesy and we are working to make sure the home closely complies with those plans; however, the home is not built precisely to those plans in every particular nor does the contract require that it do so. Those plans constitute our internal instructions to our staff and subcontractors on how we want them to build the home.

There are no contractual plans. The plans that we gave the Davis are not a contractual commitment to build everything in the home exactly to those plans.

We have been attempting to resolve construction issues with United-Bilt Homes via the Better Business Bureau since 2/13/2011.

During the entire construction phase, United-Bilt homes would race up from Austin to the construction site 2 hours away to have change orders signed.  Unfortunately they never gave us a copy of the change orders.  We have also requested a copy of the plans, but they said that the plans were not part of the contract and no money was collected from us for them at the closing for them therefore they would not provide the actual plans.

"Pine bluff Arkansas" quoted the response from United-Bilt's attorney to the BBB in their original complaint with Rip-off Report.

They have provided similar responses to the Better Business Bureau regarding the construction issues.  

When the contract was signed last Summer with United-Bilt homes, the company had an A+ rating.  Please don't use the BBB ratings in your decision to sign a contract with United-Bilt homes.

The you tube video below is one example of the verbal contract that they will enter into with you but then file the opposite response with your Better Business Bureau complaint.

We communicated regularly with these customers during the time this report was made (we were unaware of this report). We completed each item they complained of and we have received no claims or concerns from them in over a year. To our knowledge, all issues were resolved and addressed and the customers have full use of their home.
