Uptown Motor's owner admitted in court that his road test was only driving the car ten feet back and forth in his garage.

A road test is supposed to on the road at least around the block but it is usually at least a quarter a mile and most of the time more than that for the purpose of determining that the repairs made to the vehicle are proper and that the car is operating properly and is in good condition with no problems. Driving the car back and forth ten feet in the garage can not do that.

Andy Buczek only drove my car back and forth ten feet after making his negligent and faulty repairs on my 1961 Chrysler 300G classic car but he lumpted a road test in his chages in his bill - I consider this fraudulent.

The result of his negligence in working on my classic car was that the transmission exploded costing me two thousand dollars in repairs. He refused to take responsibility for his negligence and I had to sue him. At the trial the expert testified that Uptown Motors was negligent in making the repairs. Sadly, the judge who was a woman with no knowledge of cars said that the car was old and disregarded the expert who testified that it was Uptown's fault and found for Uptown despite it being their fault.

Here is the sad story about Andy Buczek's faulty work and his stubborn refusal to even talk with the expert about his negligence.

My classic 1961 Chrysler 300G was stalling and would not run so I had it towed to Uptown Motors located at 327 East 84th Street in New York City to have it repaired and put into proper operating condition. I did not limit the work. I wanted whatever work was necessary to get the car put into proper operating condition. According to the expert, what was wrong with the car was that the carburetors were gunked up and needed to be completely rebuilt.

Andy Buczek did not realize the carburetors needed rebuilding and what he did was to increase the idle speed of the car from its proper idle speed of 850 rpm to 2500 rpm to get it overcome its stalling. According to the expert, this idle speed would cause the transmission to blow up which it did after I took the car out of Uptown Motor's garage after picking it up after it being "repaired" and drove it for two blocks.

I told Andy Buczek what the expert said and he refused to take responsibility saying that he told me that the transmission was "locking up." But the expert said that even if the transmission was "locking up" which it wasn't, this would not result in the transmission blowing up, that it was setting the idle speed to 2500 rpm with Andy admitted to.

I asked Andy Buczek to turn my claim for his negligence over to his insurance company and he refused. So I sued him. He did not turn this lawsuit over to his insurance company but defended it with his own lawyer at this own expense paying I suspect much more in legal fees that it would have cost to pay my claim. He refused to speak to my expert who would have explained to him what he did wrong. Andy is a very stubborn and stupid man who does negligent work and refuses to take adult responsibility for his mistakes.

The worst part of the story is his lumping a charge for a road test and then not doing what is normally considered a road test. According to my expert, driving a car back and forth ten feet in a garage is not a road test. Calling it a road test and lumping a charge for a road test in my opinion is a scam and a fraud.

Does Andy Buczek do this for all his so-called road tests. Is the car you bring to his repair shop being really road tested after being repaired? He testified in court that his road test was driving the car ten feet back and forth. Beware of Andy Buczek and his Uptown Motors. He is a ripoff charging for a road test that wasn't really a road test.

Judge was completely wrong

The judge's knowledge of the law also appeared to be deficient - she completely disregarded the testimony of the expert witness who testified that the age of the car had nothing to do with the transmission blowing up and that the transmission had been recently been rebuilt.

Also, the expert testified in detail exactly how the high 2500 idle speed caused the transmission to blow up explaining in detail how it caused the pump to increase presure on the torque converter, etc. He testified that Uptown Motors was negligent and was completely at fault.

The judge was required to accept the testimony of the expert and find in my favor but she disregarded the expert and went on her own misguided opinion that the car was old, etc.

I will be filing a judicial complaint against this judge when I have the time to do this as her total disregard of the expert who she qualified as an expert clearly was judicial misconduct.

While I lost in court, this RipOffReport.com forum provides for justice. There are many Google Reviews that complain about Uptown Motors and I will be reposting them on this website for all to see so that they will know to AVOID UPTOWN MOTORS AT ALL COSTS.

First, that car is a classic and the OP said he took to the business to have it serviced. He DID NOT buy the car from there. You obviously have little knowledge of the repair business and how it works. This mans claims sound completely legitimate. The owner of the company in question clearly performed faulty work and deserved to be sued. Now the comment about the judge well, that may be a little extreme. As a mechanic he is bound to follow what the customer would like done. They may make suggestions however, they are supposed to do what the customer orders. Clearly this guy was out to make a quick buck on the back of a hard working person. No where does it say that this person bought the car from this business. It is a repair facility NOT a car dealership. Troll somewhere else or pick up a book and learn a thing or two about car repair. To the original poster you were ripped off, sorry about the outcome of the trial.

"the judge who was a woman with no knowledge of cars" Her knowledge of the law (not her gender) was a factor. I'm sure she reminded you that you agreed to a final sale on an AS-IS purchase. Why didn't you mention that in your report?  How many miles did you road test the 51-year-old car?
