My problems with US Bank began when I applied for refinancing of my mortgage when the interest rates were low.  It was taking quite a while for them to process my paperwork and I was getting concerned because my next payment would soon be due. So I called the loan officer to check on the status of it  and she told me that is was almost through the process. So then I asked her about my payment that would be due soon and if I would need to make that payment. She told me no. I asked her a second time, and told her I did not want to get into trouble for not making a payment. She assured me that I would not get into trouble and that it would be included in the refinancing.

Well needless to say, she provided inaccurate instructions to me. The due date past and I got a late notice from them. So I attempted to contact the loan officer several times over the next month to discuss this problem. She refused to return my calls and emails. Two months went by when she she finally replied with an email stating that I misunderstood her, for which I did not. So I sent a letter to them telling them what happened and explained that I could only afford to make one payment a month not two.

So I started making my monthly payments on time every month while I continued to try and get them to respond to this problem to work it out. They just continued ignore all letters I wrote them. I did not waste my time calling them because I would not have any proof of what they said. I wanted an answer in writing for proof.

In the mean time because I could not afford an attorney I went through various means like attorney general and down the line to get help. This went on for quite a few months. Then one day I received a letter from US Bank along with my payment that I had made stating that they would no longer accept my payments, and then they attempted to foreclose on our house.

Fortunately for us, the judge in our county listened to our story, and looked over our proof that we attempted to contact US Bank more times than should have been necessary and he denied them foreclosure. Now it would not stop them from doing it again, but they would have to start the process all over again. So we were forced to apply for a loan modification which we did not want just to save our home from being taken away from us.

The modification loan process was a night mare as well and took about 6 months until it was all said and done. During the process they repeatedly claimed they did not receive paperwork that we emailed to them. And they repeatedly prolonged the process until it was past the deadline that they set and required us to fill out new paperwork repeatedly because it expired. We learned that if they tell you something is going to take x number of days, it is guaranteed to take 2-3 times longer than they state. In the process, the happily continue to charge you late fees every month. The sad part about this whole deal is that before the day we decided to file for refinancing we never missed a payment or had a late payment. It would be very clear to anyone who reviewd our payment history the 2-3 years prior to that, that something was not right and very clear that US Bank was scamming us, trying to get any fees they could out of us. They claim they are willing to talk to you and work things out with you, but that is a false statement, because if they did help you, they would not make the money from the fees they can charge you.

Now we get to our current situation with US Bank. We sold our home and were scheduled to close June 25th. During this process we received several severe storms which caused roof damage. We agreed with the buyer to make the repairs as a condition of the sale. It should have been no problem. We filed a claim with our home owners insurance and they cut us a check for the damages which also included US Bank because of the mortgage. Which we understood, and were fine with. We were then required to get a conract from the roofer and turn it into our insurance company to get the remaining funds from our inisurance for the repairs. That was no problem. We scheduled the work to start June 24th and to be finished June 25th, the day of our closing. That was no problem either.

One week before closing we took the insurance check to US Bank to get them to endorse the check so that we could pay the roofer. He required the money to cover the cost of materials up front before he would begin the work. Again we were fine with that. US Bank refused to sign the check. We were told that we had to sign the check over to them and then they would send us some paperwork that we had to fill out. We were told that we would have the paperwork that day. It did not receive it.

The next day I called them and asked why we did not receive the paperwork. They said they got the information after their 11am cut off and that we would definately get it that day. The day goes by and we still did not get it. So I called once again. They only thing they told us was that it was being processed and that is takes time to get the paperwork gathered up and that we would definately get it by 5pm that day. OK, you have been in business how long. Shouldn't you already have knowledge on what paperwork is needed. Anyways, needless to say we did not get the paperwork by 5pm that day. It arrived the next morning four days later.

After reading through their paperwork and their requirements we knew that we had a major disaster on our hands. They wanted us to fill out the paperwork, endorse the insurance check and then mail it all to them. Then they said it will take 10 days to process the paperwork. After that they would schedule an inspection of the damages. Once they finish processing the inspection information, then they wanted the contractor to come and do 2/3 of the repairs. Once 2/3 of the repairs were completed, they would again schedule another inspection. After they process the inspection information, they would release a portion of the insurance money in an amount determined by them to us. Then the roofer must complete the rest of the repairs. Once done another inspection is scheduled and once again we have to wait until they process that information. When that is done, then we have to wait until they process the payment to be sent to us. Long story short, they turn a 2 day job into a 30 day or more job. At the same time they expect the contractor to do foot the bill for the materials until they decide to send the money. And with their track record in delaying for as long as they can it would be 2 months or more before we could close on the house and even see any of the insurance money that we are entitled to. Needless to say we do not have that kind of time with closing being in 5 days.

I placed a phone call to them, explained to them that we sold the house and were closing on June 25th, and that we did not have the time to go through their paperwork and process.  They told us that they couldn't do anything about it because of our late payment history, which was caused by them during the 1st problem we had with them above. 

By now we are in a severve stress mode, because we were 5 days from closing. We had already turned in our notices at work and our last day of work was June 14th.  We had a moving truck reserved, all our utilities scheduled to be shut of the day of closing, a change of address was reported with the postal service for the day of closing and everything is packed. We sold all of our appliances and now cannot cook any meals, have no refrigerator to store any food and no washing machine or dryer to do our laundry.

US Bank has put us in a severe situation. If we cannot close as promised we will lose the sale. We stand to lose alot if we cannot close as promised. So US Bank has stuck us once again.  And once again it would require us to take them to court and it is very obviously that isn't an option for us since we no longer have jobs. This is just out right wrong, and we feel that US Bank should have to pay for our losses and suffering for what they are putting us through. And they should be held accountable for putting their own investment in jeprody. There was no excuse for them not to sign the insurance check when they knew the house was sold, and 0% risk for them in doing so. 

We even sent them a copy of the sales agreement as proof that the house was being sold. But it made no difference to them. They do not care. All they see is a way for them to earn some money on fees etc. because they know they have us in a corner now with no way out. We are going to lose everything. And that is our story.
