 I left my house on Oct. 3rd without my cash. I wrote a check for an order I had placed, knowing I would need to put the cash (that I had forgotten to bring)in the account early the next morning.

The check I wrote was deposited in a DIFFERENT bank after 2:00PM on Oct. 3rd.

At 6:00AM Oct. 4th we put cash in the bank night depository.

At 9:00AM Oct. 4th the check had not yet cleared my account (according to online banking).

The deposit was not credited until 11:00AM Oct. 4th

Yet at 1:00 PM suddenly online banking shows that the check (that hadn't yet cleared by 9:00AM OCt. 4th) had cleared the account on Oct. 3rd - the same day I wrote the check.

The check was not even deposited in a different bank until after 2:00PM. But it cleared my account that same day and I am charged $36? When I make a deposit after 2:00, the deposit is credited the next business day. Why is a check that was not even deposited into a different bank until after 2:00PM Oct. 3rd credited to my account that same day?

SUMMARY The check did not clear my account until Oct. 4th after 9:00AM (according to online banking) There had been cash waiting since 6:00 AM to cover the check yet I was charged a $36.00 fee.

 It is very obvious that you spent money you didn't have.

If  you had money in the account you wrote a check on, there would have been zero reason to go to another bank and write a check.  You could have used your ATM/Debit Card either at an ATM or where ever you needed to buy something.

The ONLY reason you did this is because you "thought" that you could float a check for a day or two until you had the money to put back.  The problem with this is that a majority of checks are processed electronically and have been for many years, so when you present a check(especially at a bank) you might as well have just handed them cash and avoided the middle man.  Oh wait in your case you didn't have the cash.

Now I bet you are saying..wow how did this person know what I did.  Well let's just say that it was what you didn't say that made it very clear....

You wrote the check at 2PM on the 3rd, and did not put the money back until 6AM on the 4th.  So while there are just issues with that(more on that in a second), the fact is that you had spent money you did NOT have and technically even if you put the money back in your bank at 2:01PM on the 3rd you were still overdrawn. 

Now onto the "more".  On-Line banking was never meant to be a replacement to your written register.  While it is fairly accurate, it is not 100% accurate and up to date all of the time.  It is possible that your check did clear in the overnight processing but didn't get moved to the On-Line banking system for several hours.  However, it would not have mattered anyways because you just put cash into the night depository, where there is no proof until an employee reviews it that you actually did make the deposit.  But again even by your own admission it wasn't until 6AM. 

Perhaps if this was your first Overdraft(lol) you may get the bank to waive the fee this time.  But if they do out of a courtesy don't expect them to continue to extend you the same courtesy the next time this happens.  So you probably should be careful from now on and not even attempt to spend money until you have it, because you can not guarantee when the check will be submited to your bank.

Oh and I am sure you are still going to think that the bank was wrong, and you are going to "show them" by going to another bank.  Well I have news for you.  Your next bank would probably do the exact same thing.
