I have been unemployed for several months and am sick, on and off with lupus. I am a single parent with two sons and have filed a contempt suit against my former spouse who owes me over $10K in back child support. I have been unable to pay my Capital One account timely and it was sold (??) to Viking Collections. Have tried to call and settle with Capital One several times and they transfer the call to Viking Services, while I'm on the line, trying to speak to a manager at Capital One.

A Mr Simmons, who say he's with Viking Services, continues to call my home repeatedly and when I tell him I'm a divorced person and am unemployed and waiting for back child support, he then asks to speak to my parents (I'm 47 and my parents are not responsible for my finances). I am refinancing my home to pay my Capital One payment and Mr Simmons calls several times a day and demands I pay on the day he calls. When I state I cannot pay until my refinance closes, he then asks who my refinance is with and for the lender's number. I have hung up on Mr Simmons almost daily when he doesn't like the answer I give him which is that I have no money to pay this bill and won't until my refinance closes. He gets loud and verbally abusive with me and I have recorded the last three conversations with this man.

I plan to pay my Capital One account when my refinane is complete and do not intend to NOT pay this bill. I am never rude to this Mr Simmons, but have never been spoken to in such a rude and threatening manner in my life!!!

Today, Mr Simmons informed me he had called my former husband. Why would this agency call a man I divorced in the 1980's and harrass him? He is remarried and we have not spoken in ten years. Mr Simmons then tells me "their conversation was private". I do not believe it is legal for this agency to call my former spouse of years ago about my personal finances, nor is it legal of him to call my parents or aqnyone else qbout myt finances.

I need advice on Georgia laws for the fair credit act and plan to google this information tonight. I also plan to send a certified letter to this company and ask that they not ever contact me again and copy the BBB in both states in which this questionable agency seems to be listed as doing business.

They broke the law

Viking Collections just broke federal law by calling your ex-husband. The law I am referring to is called the Fair Debt Collection Practices Act "FDCPA". Google it and read up on what your rights are and what a collection company can and CAN'T do. Read specifically sections 804 and 805 that pertain to communications with third parties.

Viking is allowed to call a third party (namely your ex) for location purposes only. They can't discuss what they're trying to locate you about - they can only ask for your contact info. Since they obviously already HAD your contact info (since they've been talking to you on the phone), they broke the law.

Have you confirmed this telephone conversation with your ex, by chance? If so, you would have good grounds to file a lawsuit against Viking.

May I ask when you last made a payment on the Capital One card and about how much they charged-off? I ask because if it's a relatively small amount, Viking's federal law violations could offset the amount due on the credit card.

Contact Bud Hibbs at his website. He will put you in touch with an attorney that will be more than willing to help you out.

By the way, stay off of the telephone and send them a certified letter stating that you dispute the debt and that telephone calls are inconvenient. Keeps copies of everything that you send to them and that they mail to you (along with the envelopes). You need to start tracking their violations (and reading up on the FDCPA will jump start you).
