I had a Vivint (formerly APX) security system installed over 2 years ago (April 2010).  At that time I was told my contract committment was 2 years.  Since that time I have become increasingly uneasy about the company and my system performing as promised.  I began researching other systems and found another company I thought might be a better fit for my needs.  I called Vivint to tell them to cancel my service and auto draft payment.  I was told my contract had been "automatically" renewed and I would have to pay over $300 to break my new contract.  I do not understand how a company can "automatically" renew services without some sort of approval or signature from the consumer.  I am furious with this company and after reading complaints from others, I see I am not alone.  My suspicions of horrible  business practices and an inferior service are comfirmed.  What steps can I take to get away from this company without costing me hundreds of dollars or risking my credit rating?

Best way to get rid of Vivint.

Do not mark your calander, send your cancellation notice today! Mark your calander on the day you wish to revoke your cancellation notice if you wish to keep the service. I am a previous customer that was lucky enough to find out what kind of business I was dealing with. They operate on the edge of the law and arent worried about misleading you. If I were still a customer here is what I would do.

#1 Stop any automatic withdraws or credit card charges. If they wont stop it themselves check with your finacial instutions to take a corrective action. You might wanna even change your account number or even your bank if they wont help you. Vivint will direct invoice you if you stop payments to them. Plus they have a web site you can see your balance and any other information you need. Because even if you send a cancellation notice 30 days prior they will still bill you and withdraw funds and you will find it hard to recover those funds. I was getting direct invoices when I sent my cancellation notice 60 days in advance they still sent me invoices for 5 months after the contract had ended. A total of close to 200.00 dollars called me 3 weeks straight acting like I owed them some money. Imagine if I had given them direct access to my back account or credit card. Most banks have a free Bill Pay feature with a checking account. Use this feature I checked into them the money is transfered to the banks account and then sent to Vivint the nice thing about that is your account number is never in there hands.

#2. Send cancellation notice now. Mark your calander to resend the cancellation notice if you wish to keep the service. The contract does not stipulate a time frame on when the cancellation notice can be sent. Just needs to be in 30 in advance. If you send it 4 years in advance its still good. Just send it registered mail return receipt so you have proof cause your gonna need it if you send it 4 years or 30 days in advance of the end of the contract.

#3. Do not listen to them. Read some of these complaints. Folks have called to cancel, vivint thanks them for their call, what happens they still get a bill and are automatically renewed. You have to send it in writing registered mail, return receipt at least 31 days in advance.

By the way I stuck to my guns didnt talk to them let them know over the phone not to make their problem my problem. I got invoices for 5 months now I guess they figured I wasnt gonna be bullied or tricked into renewing with them I now get "we miss you come back" cards in the mail. Holding on to those also just incase. Proof they knew i cancelled per the contract. Good luck.

RE:Check state law some states only allow automatic renewal on a month to month basis. if not your stuck. If you send the cancellation notice you will get phone call after phone call trying to trick you into staying on and resending your cancellation dont listen to them. When they say its vivint just hang up if it makes you feel better tell them "you got my cancellation notice and then hang up". The most important thing to do is stop automatic withdraw now. Send your payment in by mail or pay online through vivints web site. They probably wont do it voluteerly so you will have to end up doing it at your bank. The bank may want you to try and work with vivint, tell the bank person 1 or 2 options are going to happen today. 1 you stop sending payments to vivint even if it means you have to change account numbers or 2 you will do your banking somewhere else. There are complaints all over the internet about folks who sent cancellation notice per contract and vivint, apex and what ever name they called themselves at the time still withdrew funds from their accounts and had to fight to get them back.

You should have read the contract you signed with them when you got the service..

Perhaps you should read it now...It will tell you that the contract will automatically renew on a year to year basis when the original term and subsequent one year terms expire unless you follow the cancellation procedure.

How do I know this...because i have their service and HAVE read my contract...before signing. The salesman left a copy, at my request, and came back later.

"What steps can I take to get away from this company without costing me hundreds of dollars or risking my credit rating? Central Texas Consumer"

There are no legal steps to avoiding all this now...the right time to head off this kind of problem is being an educated consumer....before signing.

No, I don't work for them, have had NO trouble with their service in over two years and have found them to be helpful when I've contacted them, including accidentally setting off my alarm.

When I call in for periodic testing of all my equipment they are thorough and professional.
