Before going to have your "Full Vehicle Inspection" and "validation of (your) car's condition, call the location up and ask what the contract they require you to sign provides about your car's condition. If you think it's As/Where Is, like it is for most used car sales, you are WRONG, BIG TIME.

Despite the inspection and test drive,  their agreement provides that the seller is liable for undisclosed defects in your car's condition, even if you don't know anything about these defects.

So, they inspect and test drive it, and you sell it to them and think the deal is closed.  NOPE, if an unknown defect be discovered in the car, they have the right to sue you for breach of contract.

The worst part is WeBuyAnyCar.Com agreed in England with that country's Office of Fair Trade to stop this (among many other) unfair trade practices. (Search Internet for Webuyanycar Office of Fair Trade)

After I walked out of the Branch (after wasting a lot of time) without selling my car, I contacted the Compnay and made a complaint to "Corporate."  They thanked me for bring this to their attention?????, but, other then coming up what a lot of excuses, haven't done anything about this "newly discovered" problem.  Among other excuses for the delay was that their attorneys were busy.  Funny, these were the same attorneys that were involved in the Office of Fair Trade proceedings.

WBAC Rebuttal is More Whitewash

Opinion:

Seems like some one had the bright idea of exporting the WBAC UK business model to the US and decided to use some of the same practices that "worked" so well in the UK, that is, until the Office of Fair Trade "nailed"  WBAC as being unfair to consumers.  I guess WBAC thought let's try to old UK practices in the US until we get caught.

 

OOPS, I caught them.  In the UK they had agreed with the Office of Fair Trade, that, among a lot of other unfair practices, the WBAC contracts were not to make consumers responsible for disclosing information about the car being sold that the consumer did not know about.  Remember, that as part of WBAC's service, the car is inspected and driven by them and also keep in mind that there is no mention of this broad consumer contract liability in their advertising or the "pitch" made in the branch location. Dispite already been found to be an unfair practice, the WBAC agreement that I was given to sign at the last moment contained language that imposed this unfair responsibility. (I've copied as an example one provision below  for those who want to read it.)

 

It's also suspicious to me that consumers are, at least according to WBAC, bound to keep confidential all of the WBAC agreement that is required to be signed to sell a car.  They "spilled" the secret provisions to me when I threatened to take legal action.  In contrast to the Rebuttal statement, I noted to WABC that their contract needed to made fair to consumers, not merely "more consumer friendly."

 

After going around in circles with WBAC for over a month, they offered to pay me what I considered to be a bribe to "go away." Details of their settlement proposal, which per WBAC's custom they wanted to keep confidential, will be made available.  I refused their settlement and its confidentiality, except as evidence in litigation.

 

Bottom Line: Don't use this buying service and be skeptical of any positive on line reviews. In my view, WBAC is involved in heavy social media brand protection or "Astroturfing."

NOTICE THAT THIS "LEGALISTIC" LANGUAGE IS NOT LIMITED TO INFORMATION THAT THE SELLER KNOWS ABOUT

"Seller has not  omitted any information that could be reasonably pertinent to the Compnay; and there are no undisclosed physical defects with the vehicle that a prudent purchaser would want to be informed about (including without limitation, defects that would render the vehicle mechanically unsound or inoperable or unroadworthy).

After you shared your thoughts, we did reach out to our global legal counsel to be able to respond to your concerns as you noted that you were a lawyer and thus we wanted to make sure that we could provide you with a legal response. Given the circumstances, we believe that we responded in as timely of a basis as possible.

 

We advised you that our contract was fully compliant with the law and also noted that the US management team runs the US business independently from the UK. As you noted that you believed that we could make our contract more consumer friendly, we made an adjustment to our contract wording to do so as it has always been our intention to be a customer service focused company. It is our goal at webuyanycar.com to completely satisfy all of our customers.
