My nightmare with WFS began in November 2004. Because of my families hectic schedule, WFS was unable to get a hold of me by phone when I was about 10 days late on my payment. They then sent someone they called a gaurdian out to inform me that they were trying to contact me. I immediatley called them while the man was still at my house. I made a payment over the phone and set up another electronic debit for 2 weeks later. Both were deducted from my bank. About 5 months later the phone calls began again.

When we finally made contact with WFS, they told me that I had a $l72.00 late fee. They never told me that this person that came to my home in November was paid a $55 fee....right out of my truck payment. For 5 months they kept deducting $55 out of each payment to make up for the last payment! This resulted in having a late fee added on each month. When I agreed to just pay the fee with an electronic debit and asked that they defer a month for me, they said they would. I gave them the bank info and thought that was the end of it.

About 2 weeks later, I received a letter in the mail that stated I had given them an invalid account number for my bank. I then tried to contact them and only ended up playing telephone tag. The following Sunday, while I was at work they towed my truck! The statement that they gave me said I owed them a total of 1223.00. For the last 3 months worth of payments. Their own statements showed that I paid my bill each month. I had canceled checks to show for each payment they said I did not make and I am still fighting to get my money back from them. There were also other fees that totaled an additional $386. I am in the process of hiring a lawyer to deal with this mess.

you had already contacted a lawyer and were suing them. SO you were just blowing smoke? Nice credibility.

After reading another report on this company from Molly, I was again amazed that she was telling my story almost word for word! Mine however, didnt end with a positive result....WFS finally repossessed our Dakota. They never let us get our belongings or even notified us as to where the vehicle was and never sent a post-repo notice which by law is required. We were shocked to receive a defiency notice saying we owed another $9000 to them. Not only that but this stupid company never took the vehicle out of our name and months later we received fast track violations on it! I have everything documented also...an entire egg crate of paperwork! I am interested in a class action lawsuit and definately would like to talk to Julie, the attorney. I dont know how to go about doing that....anybody know how to do this please post....I'll check daily

Reading the post on this board is like liveing thur it all over again. We were in our late 60 and still got skunked by them. They put us thur hell. They pulled a switch and Bate and even tho we were called in 4 days later to sign new papers upping the price thousands of dollars we felt we had to sign because of there pressure from day one it was a nightmare. the extra charges etc. the phone calls and threats. Well after more then three years almost 4 of paying on it with the balance not going down as it should have we got 87.00 behind they picked it up .They sold the car within 24 hours to some poor fool and destroyed our credit which at our age really is hurtful. They should never be able to give auto loans in any state . Good luck on your lawsuit if a class action ever comes up I would be frist in line . Nevada Grandma

IN RESPONSE TO YOUR REBUTTAL, I HAVE CONTACTED A LAWYER AND WHAT YOU DO OR AT LEAST WHAT YOU HAVE DONE WITH MY LOAN IS NOT LEAGAL. AS FAR AS THE REPO GOES, I RECIEVED MY PAYMENT HISTORY FINALLY AND SEE WHAT THE PROBLEM WAS.

YOU ADDED INSURANCE ONTO MY LOAN AT AN OUTRAGEOUS PRICE....AND I HAVE HAD MY OWN INSURANCE SINCE I BOUGHT THE TRUCK! DON'T TRY THE "INSURANCE LAPSING" BIT EITHER, IT HAS NEVER LAPSED AND YOUR COMPANY WAS SENT MY PROOF OF INSURANCE, NOT JUST ONCE, BUT SEVERAL TIMES! ONCE I LOOKED AT THE PAYMENT HISTORY AND FOUND A WAY TO DECIFER IT, I FOUND ONE ERROR AFTER ANOTHER.

NOT ONLY THAT, BUT YOU MADE A HABIT OF NOT CREDITING ANY OF MY PAYMENT TO THE PRINCIPLE AND ALL TO INTEREST! YOU ADDED FEES THAT WERE BOGUS...SUCH AS UNAPPLIED AMOUNT, 8 DIFFERENT DEFERMENT FEES, MDI INTEREST, AND THE LIST GOES ON!

MY LOAN IS DUE TO BE PAID OFF IN JUST A LITTLE OVER A YEAR AND THE BALANCE HAS BARELY CHANGED IN 3 YEARS OF PAYMENTS.

YOU ALMOST HAVE TO BE A ROCKET SCIENTIST TO READ THE PAYMENT HISTORY AND, OF COURSE, THAT'S SO NO ONE WILL QUESTION YOUR STEALING FROM THEM!

I AM SURE THAT THE OTHER 32 COMPLAINTS ON THIS SITE ARE SIMILIAR AND SINCE NONE OF US KNOW EACH OTHER, I THINK IT'S SAFE TO ASSUME THAT YOU PEOPLE ARE CROOKS!

YOU ALREADY LOST ONE CLASS ACTION SUIT, AND EACH COMPLAINT ON THIS SITE IS SAYING ALMOST THE SAME THING....ESPECIALLY ABOUT YOU SLAPPING INSURANCE ON THE LOAN WHEN PEOPLE ALREADY CARRY THEIR OWN.

AS FOR ME BEING BEHIND, YOU BETTER GET YOUR FACTS STRAIT! YOUR CROOKED ACCOUNTING IS THE REASON MY ACCOUNT SAYS I WAS BEHIND...MY CANCELLED CHECKS TO YOU EACH MONTH TELL A DIFFERENT STORY, SO I GUESS WE WILL BE SEEING EACH OTHER IN COURT.....GOOD LUCK, YOU'LL NEED IT TO GET AWAY THIS KIND OF CRAP!

First off, you're in the state of California so you automatically have a ten day mailing window. During this time your considered late by the company, but you will not have a late charge. For the collections department to hire someone to personally contact you in person means that you were delinquent for at least 30dys. By that time we've already reported it to the credit bureaus. Typically this is a last resort before repo'ing your car. So this probably accured after you've been 30dys late before, your not extremely late probably between 30-60dys, you never returned any of our calls, and/or you changed your number.

Let's face it, after you make a few payments we all know when our car payment and mortgage/rent is due. It's your responsibility to pay it. For you to get nearly $200 bucks in late charges means you made your payment after 10dys almost every month for at least six months. Each late charge is 5% of your car payment. Sometimes there's a max around $25 or min around $10-$15 depending on your state, but for Cali I believe it's 5%.

We wouldn't repo a car over $55. We start calling you after the payment is 5dys late so you probably got a call about this, plus we send letters, not to mention you get a statment each month, can always call customer service or can sign on to your acct online at anytime to know how much you owe. Those late charges didn't sneak up on you. Think about it, we lose an average about $4k-$7k on a vehicle when it's repo'd. We have to pay a repo man, than sell it at auction for a lot less than it's worth and since you still owe us the rest of the loan money but now you're really not going to pay us since you don't have the vehicle anymore, we have to charge off the account and sell it to a collection agency. You cost us money and you hurt the hard working employees and consumers. Don't post false info since you got repo'd after NOT following through on the financial promise you made the day you signed the contract. Also, we're welling to work with you if you had just talked to us. I've seen people go about 3-4months without being repo'd after like the fifth time that had happened just because they communicated.

We'll defer your payment three times to help you out. And it's not our fault if you don't know your own checking account number. That's your responsiblity to give us the right info. Hello, if the money wasn't deducted from your checking account you should've noticed BEFORE you got our letter. Some banks will take upto 10dys to let us know we're not gonna get paid. Read your contract and the state laws, you have no reason to sue and if you can't pay your car payment, I don't you have the money to.
