Obviously, from reading other Ripoff Reports, I'm not the only one dealing with this disturbing company. I have missed one payment, and am being THREATENED with FORECLOSURE. When my daughter came home unexpectedly, she found someone at my property with the intention of taking pictures. No calls or arrangements were made for this, and the man intending on taking the pictures could not even tell her why he was there, or who he was representing. He's lucky that I wasn't home, because I would have called the police and reported a prowler. I hope that this is not one of the companies that the tax payers of this country are proposing to bail out. However, it seems they are, as they are paid representatives of Merrill-Lynch. This situation definetly needs investigation and a class action suit, if even only the shady situations that they are accused of are true. I re-financed a couple of years ago, thinking that it was an improved situation with a much lower interest rate, and within a couple of months the mortgage is sold, and you become emeshed with this kind of organization. I have never been able to talk to an alive, real person -- I just get put on hold. I don't know what to do. I have never felt so frightened. Just sign me "Terrified in rural Maine".

That person was there doing what we call a 'BPO', Broker Price Opinion, upon taking some exterior photos of your home we log that valuation into our system so we can see if you have equity in your home, if it turns out your home is worth less then the value of your loan we send you an offer to apply for the HOPE program which we have in our company that can assist you in getting a lower payment since it is nearly impossible to refi right now with the economy as it is. That person was unable to identify themselves to your daughter as they were not our customer and we cannot legally disclose any information about a loan or BPO to anyone but our customer. Since you 'state' that you were being threatened with foreclosure because you only missed one payment (highly doubtful as we have people who have not paid in over 6 months that are still not in foreclosure) it is necessary for us to have an updated BPO.

it is really simple

If you had paid your mortgage on time they would not have had any reason to come out to your house. If you read your contract it says you are responsible for any fees incurred. It also says in your contract that your loan can be transferred this is nothing new. It is unfortunate you had a hardship but just pay your bill and this wont happen. Also, in most states a notice of intent is mailed out after 35 days. It also normally says that if you are late the company has a right to demand payment in full. This never happens but it is in writing.

Deja Vu with Wilshire Credit

The same thing happened to us with the man taking the pictures. That means your home is in the process of being foreclosed on. When it happened to us I called Wilshire and they told us it was only for the purpose of making sure someone lived in the home and it was not sitting vacant. At that time the reasoning made sense but about 10 days later we received a foreclosure notice. Even after the foreclosure notice I was told that it was a computer generated notice and not to worry. Only when I received a postcard through regular mail and called did I know our home was in foreclosure. Believe me please. Do not trust Wilshire Credit! How they are still in business is beyond me!! The majority of people there are complete morons who are credit and collection agency people who could care less if you are living on the street for the rest of your life. How many times can I say that a credit and collection agency and the people who work for them cannot collect on secured loans. Now it is true that Wilshire does have other names such as: Wilshire Bank, Wilshire Mortgage, etc., but still is Wilshire Credit who has violated RESPA and FDCPA laws and guidelines and are on the long list of mortgage servicing fraud violators. However facts are facts and Wilshire has many problems that seem to not be getting any better becausse each time they seem to clear up one problem they make another one. However, I can guarantee you that if a person came to your home to take pictures it is because they need to see how much your home will bring and they do not ask to come on your property. Do not let things go. Call Wilshire before you lose your home because you will. We have been through the same thing and what you are saying is a repeat of what we went through with Wilshire.
