Hi, my name is Gary Franks and my wife is Rene’. I would like to respond to these allegations. I never told Richard that I am a realtor. My wife Rene’ is a REALTOR®/Broker but I am not. Richard, his girlfriend and his realtor with Adventure Realty came to look at the home we were living in and had for sale back in March of 2008. His realtor called us and asked us to leave so that they could tour our home. We left when they showed up and they were there going through our home for about 30 minutes. A few days later, Richard’s realtor called us again and wanted to take a second look at our home. Again we left so Richard, his girlfriend and his realtor could tour our home without our being there. A few days later, Richard’s realtor called us and made an offer on our home. We negotiated on the price and finally excepted an offer. Richard, his girlfriend and his realtor showed up with a "home inspector" of his choosing and that he paid for, to go over our home prior to the closing of the sell. We were asked to leave the home for them to do their inspection. We obliged. As we were leaving, I saw the home inspector climb up on the roof to start his inspection. I don’t know who his home inspector was, but all four of them went from the top of our home, around the outside of the home, through the inside of the home and should have checked under the home. This is a manufactured, double wide home that a previous owner prior to our owning it, had added on an inclosed Arizona room.
Now that you have a better understanding of the situation, I will address his issues. Lets start with the roof. It was the same roof that was there when I bought it and sold it. It never leaked. Not once. I did not pull up the shingles on the roof to see how they were place so I can’t say if the job was done wrong. During the winter months, there were times we had icicles hanging from the roof. We like to keep the inside of the home warm during the winter months. Every home that people live in during the winter months up here have icicles hanging from their roofs. A very common sight. I do go through the homes that we own and seal the outside and inside of the homes every year. This is called "maintenance". I recommend anyone owning a home do it. There were no leaks. As for the painting of the inside. I painted one wall. I had a water pipe leak within a wall. I cut a small hole in the sheet rock, called a plumber and had the leak fixed. I then sheet rocked that hole, textured the new piece of sheet rock and painted that wall the same color as the rest of the room. You can’t see where I fixed it. If you could, he would have mentioned it. That is the only painting we did to the inside or outside of the home while we owned it. We hid nothing. What Richard, his girlfriend, realtor and home inspector saw while going through the inside and outside of our home is what he bought.
The furnace worked fine while we lived there (remember the icicles on the roof?). Richard’s home inspector should have checked the furnace and A/C while doing his inspection. If there was something wrong, it should have been brought up prior to the closing. I don’t know what happened after we sold that home. I can understand a repair man coming out twice to fix a furnace. Once to see what the problem is and the second time to bring parts they didn’t have on the first call. But six times!???? I don’t know. I saw that he had put a new roof on the home. A double wide manufactured home that he says was to the tune of 10K. I think someone took advantage of him but that was his call.
Richard must be in his late 50's or early 60's. This is not the first home Richard has bought. As you can see, Richard had problems with his home warranty people, he complained to me about his realtor not representing him correctly, his home inspector not doing his job and accused us of not disclosing "problems". I see what he was trying to do. Do you?
