I hired this company in August of 2007 to help me expidite approval of a short sale on a home I own in CA. They sounded great! Knowledgable, lots of promises, etc.

Initially, Vanessa Liddell (owner/founder/president of Short Sale Plan) went to my realtor's office and did a presentation which is why my realtor suggested it.

I paid my $500 fee which was in addition to the substantial junk of commission my realtor had to promise upon approval.

Well, I will not bore you with the literally dozens upon dozens of unreturned calls and emails. It wasn't until 2008 that things got even worse... I opened escrow in February 08. Vanessa Liddell (owner/founder/president of Short Sale Plan) told me she had a new arrangement with my lender and would have approval in two weeks, which then turned to four weeks and on and on. I was given the name of her "inside contact" but was refused the contact information. I contacted my lender and was told they reviewed the organizational chart and no one was employed by the name I had been given.

When I did get a call or email from Vanessa or her assistant it was contradictory misinformation. I would be told on Monday we would know by Tuesday, after spending the remainder of the week being unable to reach anyone I would be told the following week that it would be another week.

My last correspondence in March was that I wanted to cancel my contract this was after finding they lied about "their contact" and never submitted my package. Next, I received an email from an assistant their on March 25th that they were submitting my packet (we opened escrow beginning of February mind you) and that we should know something by the end of the following week.

Independently my realtor and I submitted the info when we found the lender still hadn't received it after over one month of an open escrow. And surprise on March 26th I received a call from my lender stating that they had the approval but didn't know where to send it because their call to Vanessa and Short Sale Plan was never returned.

I have since continued to handle all negotiations with my lender. Needless to say after over six weeks of waiting just to hear if we were going to get an approval my buyer bailed on us. Fortunately we had a back up offer and opened escrow the following day with a new buyer.

Other realtors in the office where mine works that have been handling their own short sales have gotten quicker approvals than either myself or my realtors other three clients who got conned into Vanessa Liddell's Short Sale Plan "bill of goods."

I still have gotten no calls or response since March despite more emails requesting contract cancellation, refund and return of my personal information.

Whoever this Ron Garber guy is also despite my concerns and messages he has never bothered to call. I have no idea who he is other than the web site lists him as founder and chairman although Vanessa always presented herself as such.

There are NO Guarantees with Short Sales

I was very dismayed to read this report from a disgruntled client relating to a  company I was previously involved with namely, Short Sale Plan.  To clarify the facts, I was merely employed by the company in the position of President but had no ownership whatsoever.  The founder and CEO - Ron Garber - was and still is the sole owner of Short sale Plan.  All policies and procedures were created by Ron Garber and merely carried out by his employees or which I was one.

Short Sale Plan was founded as a short sale processing company created to assist real estate agents in processing short sales.  The company was not involved in listing, selling or buying real estate.  The company did require $500.00 upfront from seller's to begin the process of collecting necessary documents and paperwork to facilitate a short sale once the listing agent was able to sell the property.  No other compensation was received until the short sale was successfully closed - and then the company was compensated by the listing agent with a portion of their listing commission.

I understand the frustration expressed by the writer as to the length and confusion in getting a short sale approved and closed.  However I feel obligated to state that in my entire time with this company and my subsequent involvement with short sale processing and the teaching of this complex subject, I have never made a guarantee or promise regarding the price, sale, time or eventual outcome of any transaction - short sale or not.

I have been an escrow officer with over 25 years of experience and thoroughly understand that any transaction and especially a complex transaction such as a short sale cannot be guaranteed because of all the intricacies involved. Also with all the "hands" involved you can never guarantee the level of expertise you are dealing with.  So with that many variables it would be foolish for anyone to make promises and guarantees.

As a follow up I no longer work with this company and am now involved in teaching agents how to do their own short sales - because I do agree that agents can do short sales better - with the right training of course. 

During my involvement with Short Sale Plan everything was done professionally and with the sole intention of assisting clients to get short sale approvals.  Sometimes it was successful and sometimes not.  I remember this transaction but I don't feel that "battling" over the details will make any difference at this point.  I left this company with a clear conscience that nothing was ever done to hurt or mislead - I stand by that today.
