Ripoff Report Verified Safe

I purchased a 1992 Toyota Landcruiser yesterday from the New Lamb Car Company on Kearny Mesa, San Diego. Figuring that any used car has it's problems I negotiated a price that I felt would allow me to fix any minor items that may become apparent over the next few weeks. I also got a 90 day warranty on the engine and trans. They said the car had been safety inspected (Sticker on car!!!) and as far as they knew it was in extremely good condition.

While driving on the way home the car died a few times (the 15 minute test drive prior to purchase did not reveal this malfunction) and then the rear power windows decided to stop working. I also noticed that the air conditioning has a few problems and the transmission makes a few odd noises on accelleration. I do recognize that it is my duty to identify as much of these problems prior to purchase and it is a buyer beware market...so be it, I am willing to eat the cost on reasonable items and I trust the dealer will honor the engine and trans warranty, however what really concerns me is that according to a vin report the odometer has been rolled back about 50,000 miles and also according to the report the dealer bought the car at auction with knowledge of this fact... a fact they somehow forgot to tell me about... I believe this is called fraud.

In the past few hours I have become aware of another buyer that had similar distasteful experiences with this particular dealer.

I am now going to call the dealer and demanded a full refund by this afternoon...I will keep you all informed of their actions...if they are honorable men, or????? If not I may need your help.

I must give Lamb Car Company credit, they were very accomodating and apologetic. They informed me that they were unaware of the milage discrepancy and had assumed that the mileage shown on the odometer (sworn by the previous owner as correct) was indeed legit. They refunded the down payment and ripped up the contract in my presence and thanked me for bringing the situation to their attention. Whether they were aware of the situation or not I don't know, but they did respond quickly and agreeably when confronted with the VIN report.

Thank You
