Ripoff Report Verified Safe

I contracted a move thru National Moving Network From CO to NY on 10/15/01. Based on an estimate of $2125.00. The move was to occur on a window of 10/20-10/21/01. My husband flew back to CO to be there for the move and finish packing. We had also arranged for some packing to occur of an estimate of $120.00 to finish packing the kitchen.

Needless to say the movers AY TRANSPORT did not arrive on either day. My husband had to rearrange flights and car rentals for the next day. They arrived on the 22nd of OCT at 12:30 in the afternoon with a truck that was already one third filled. My husbannd observed them packing up the truck and they were taking small and medium uhaul boxes and placing them in larger boxes.They told my husband that all boxes had to be uniformed.

At 9pm that evening they still weren't done. They still needed to put the furniture on the truck my husband had to leave to catch his flight and the airport was over an hour away. He was told to give the company a call in three days for an exact date of delivery. We had already had an ETA of 10-14 days from P/U. National had already recieved there deposit of $607.00 by way of visa.

Three days later my husband called AY TRANSPORT and was told we were 4956lbs over weight and the final bill was an additional $6610.00 instead of the estimate of $1518.00. We demanded a re-weigh when the stuff arrives. They had said fine and our belongings would be here in 7-10 days. They also said they would fax over all copies of our paper work since the job wasn't completed when my husband had to leave. Of course this did not occur either. Our stuff did not arrive at said time no phone no nothing.

Called dispatch at national and was told stuff would arrive somewhere between 11/7/01 and 11/10/01. Aggrivated with new date I called AY directly and spoke with manager Tom who said another 7-10 days truck was leaving from CA to CO on 11/9/01. My father now got involved and called and spoke to Tom at AY and was given a date of 11/14/01. We were told the driver would call two days prior to arival. On 11/15/01 called agian and was told 2-5 days. Well thanksgiving has come and gone. My back is killing me. I haven't a clue as to were my things are National does not call back on my calls and everytime I call AY I get a different date. I called AY agian on 11/24/01 and was told 3-5 days. Tired of waiting for my belongings. When does this constitute robbery????? Some one help me please!!!!!

Rebuttal:
Unfortunately you are at the mercy of the moving company on the date of arrival. If you feel the arrival date is unreasonable then take them to small claims afterwards.

The change of rate mid-shipment is a common scam for moving companies. Checkout the other moving company complaints on this web page. Right now my biggest concern is the new rate of $6,610 they now want to charge you. Be warned they may try to charge your credit card, if they do file a charge back immediately.

Here's what to do in the meantime. Do NOT agree to any additional charges over the phone, that's all they need to legally charge your card.

Normally when the drivers finally arrive at your house they will refuse to unload your stuff until you fork over some cash. This is where you must be prepared.

Stall them and say you need to drum up some cash. Go into the house and call the police. When the police get there they will force the moving men to turn over your things. This is the time to file a complaint of fraud.

After the things are unloaded send the movers packing. Be prepared to move things yourself, the movers may refuse. If they do then you can sue the company for some of your money back, as labor is part of the package.

The most important thing to remember is not to show your hand and let them know what your intentions are or they may drive off with the truck before the police arrive.

After you have your things it will be much easier to sort out the
finances. I would refuse to pay the new price; the original fee is what both parties agreed upon. They know they have no legal leg to stand on, that's why they use your property as hostage material.

Rebuttal:
The police will not force the movers to turn over your goods. they will stand there and tell you it's a civil matter. I know this from bitter experience.

Also, the movers may not have a legal leg to stand on but they sure as hell scam you anyway because they know that most people cannot afford to go after them in court.

Your only recourse is to contact the Department of Transportation to complain. They're supposed to be investigating these moving scams but who knows how long that will take. Meanwhile, I hope you get your stuff back.

UPDATE:

Submitted report on 11/27/01 Called National moving network- AY transport ripped off all of our belongings. File# 8235

I have called this company again on 11/27/01 actually called the driver He was still in Colorado so he says and then was going to Kentucky, ohio, maryland , PA, and then finally to NY.

He said it would be well over another week or so unless he gets more surprises from the company to stop elsewhere. It has been over 1 month since they have picked up our belongings.

Pick up date was 10/22/01 I was told and it is written on the order for service that our stuff would arrive 10-14 days.

Well its not here and the days and nights are getting colder. I have no winter clothes. We are sleeping on borrowed furniture which is going to have to be returned in the next week.

I moved back to NY because my father was diagnosed terminal and has such a short time to live. I really don't think I can handle anymore stress in my life anymore. Help!!!!!!

Dear Fraud C,

First of all, as a woman and a lady, I detest your moniker. However, that having been said, it really helps me understand why you just really don't have a clue. You obviously have never been taken advantage of by a business or someone else. If you had, you would understand the abject despair that comes with being a woman in that situation. One feels powerless and is viewed as one who CAN be taken advantage of.

When I went to the EEOC with my problem, they pressured me to drop my complaint because it would just cost me tons of attorney's fees, eventhough there was a finding of sexual misconduct. I am the source of information for another report, see: http://badbusinessbureau.com/view.asp?id=7519

The thing that perplexes me is that you don't see how untenable your position is. In one breathe you declare that holding shipments is a common ploy, but can't seem to comprehend the reasons why it is so common. I will tell you why...it's because they get away with it. States' attorneys go after high profile, big money cases, not puny little cases for $2k and less. The police will also likely stay out of this because of the liability if they try to get involved before adjudication. That means no criminal justice, unless you hire a lawyer.

I don't know what 'Pollyanna' world you live in, but in the real world the system is too big for the little person. If your boss ever forces himself on you, I hope you don't try to find justice from the State AG's office, or the EEOC. Justice comes only from your own actions. I hope you see how valuable this web site is as a vehicle in turning on the lights with regard to injustice. It is now my only vehicle in seeing that the truth comes out.

I work for moving company Mayflower and I hate the rep we as an agent get from other movers. There are written contracts. If we Bind (guarentee a price )thats the price we can collect no more except for additonal services and as of Jan 2002 the moving tarriff has deleted most of those. Your problem comes when signed a NON binding contract. In addition contract states you can pay estimate plus 10 percent if weights goes over..Read that will always be your protection.

If it sounds to good to be true....

I understand that many people have had problems with bad moving companies but you can't expect to get something for nothing. There is not a moving comapany out there that is going to move a 5,000 pound load for 1,500 bucks!

I have moved many time over large distances and so I have lots of moving experience... Bottom line.. If they do not go to your house to give you a 'not to exceed this amount' contract you are in for trouble.

I have always used Bekin's and yes they are the most expensive but the price they give you IS the final price. You can't expect to get a true price from someone who has never seen what you are moving. When it comes to moving your precious hard earned property why would you look for the lowest price.

Some info for you guys from someone in the business

Hello all, I am an operations manager for a national moving company, and I wanted to chime in with some info that can help consumers avoid problems and possibly help resolve some. I read over your letter and I have got to admit a few things struck me as very odd. Your estimate was for around 2 thousand dollars, did they do a walk through or did they use a cube sheet and estimate over the phone.

Based on your estimate how many pounds where you shipping? Did you sign a contract? Is there a specific price per pound on the contract? If you ever move you need to be sure there is a stated price per pound on the contract BEFORE your good are loaded. Seems like your shipped a lot more than was estimated, what did they end up charging you per pound?

The truck that came to pick you up, was it a shuttle(a smaller 20-30 foot truck like a U-haul)or a full size 53 foot trailor? Its seems like they didnt have a truck to pick you up, so they most likely didnt have a full size truck available and used a shuttle.

When a shuttle picks you up on short notice he will almost always take your good to what we call an origin warehouse or OA SIT (origin agent storage in transit) your shipment will be stored there until a full size can come through and pick your things up, usually its around 5-7 days, however during the summer months if you move with a small local mover they may not have the pull to secure a vanline.

Did you know that you can request a copy of the weight cert, and that weight cert is a legal document. Check your contract for a price per pound and compare that with the weight certs. Also refer to your contract, I know ours state we will take no longer than 30 days to get you to dest from the time of PU. We almost never take that long, however when a shipper (customer) tries to move 5000lbs and only told us they had 1500-2000lbs it causes operational problems and delays transit.

The reason why have removed links or phone numbers from this report is because people have, in the past, attempted the following, ...all too often.

Posting LINKS

Many times links to unknown web sites will cause your pc to freeze up and /or cause you to get a computer virus, virtually rendering your computer useless. Most of the time, this is the work of a Company or an Individual who has been reported.
Many Government links are no better than the BBB and are just a waste of time, giving you false hope. Many government sites (like the BBB) just collect all information from you, the consumer, but never make that information available, so consumers will NOT be educated as to what exactly they should be looking out for. On the other hand, many government agencies have and do come to the Rip-off Report for information. We have been assisting many government agencies for some time now, including the FBI and Attorney General offices from around the country..

Now that all these Rip-off Reports are out in the open for everyone to see, in a way, this embarrasses these agencies into doing something when they see so many reports on a Company or Individual, because they are now out in the open for all to see. Unfortunately, many (not all) Attorney General Office's and government agencies will not move against a rip-off unless there is going to be some sort of publicity on the rip-off. By reporting your experience on the Rip-off Report, is the next best thing to getting your story on TV or in a newspaper. Most national TV networks and many local TV stations from all around the country come to the Rip-off Report for information they will not get from the BBB, Attorney General office's or any other government agency. Rip-off Report has instigated many local and national stories, resulting in help for victims, in one way or another. Most government agencies will never even bother with rip-offs unless it involves $50,000 or more. Now that the government is cutting back even more dollars for these types of programs, this number will even get higher and we can expect even less to get done, by even less people to work on all these rip-offs.

LAWYERS :

We have also struggled with the following for a long time..
The reason why we delete phone numbers, ..all too often unscrupulous lawyers or individuals posing as lawyers are collecting victims information to only further victimize them. Many times, well-meaning consumers think they are going to collect names and get them to a lawyer who will do something. In every case we have allowed a consumer victim to do this, nothing has ever came of it. Consumers were under the impression that something will be done to get them help. In every case this did nothing but lead the consumer on, further victimizing them, and some consumers were mad at us. We feel it is our responsibility to check the legitimacy of the lawyer before advertising their service on the Rip-off Report.

We will also not allow lawyers to use this web site for free when they will end up taking a large amount of fees, leaving the victim with very little. There are many competent lawyers out there that know how to get the unscrupulous Companies or Individuals who ripped you off, to pay their fees. Those lawyers capable of this can post their numbers after checking with us here at the Rip-off Report.

POSTING YOUR E-MAIL ADDRESS:

For similar reasons as mentioned above, we will not allow individuals to post e-mail addresses, so they can be contacted for more info they claim they cannot post. If that person can contact YOU and get the information, so will everyone else be contacting you anyway, and, if it's good enough for them to receive it by contacting you, then you should be able to post that information for everyone to see and know about. And, many times, in an attempt to get your contact information, consumers will leave an email address; this is just a ploy to sell you a product or some other service. Most likely, you will end up on other junk mail lists. ..if they have something to sell, they should place an advertisement showing support to Rip-off Report.com so we can further help consumers.

My Experience with National Moving Network and AY

If I would have known which company NMN had assigned for my move from Wisconsin to Florida, I may have gone another route for my relocation. This was my first experience with a moving company. (My previous relocation was set up and paid for by my employer.)

My first signal that there may have been something to be concerned about was the moving company that actually picked up my belongings in Wisconsin had a paper board taped to the door of the truck with 'AY Transport' written in a black magic marker. National Moving Network had stated that my consignment was to be shipped by 'Midwest Relocation'. I still have not figured out who that comany is. On my invoice from AY, the first line, which gave a description of my move had this written on it. I now feel that MNM intentionally did not want me to know AY was my carrier.

Anyway, after declining used mattress boxes and crates for my TV's, I was able to get away with no additional charges on the load.

Upon arriving in Florida, I did some research on AY Transport. That's when my heart fell into my stomach. After reading all the negative reviews and complaints, I began to feel as if I would never see my stuff again. I called my homeowner's insurer and extended my coverage for a month just in case.

As it turned out, I was over by 1,760 lbs. from the original estimate given to me by Garg Greenspan at NMN. (By the way, after talking to him the first few times, I was handed off the Marlene Fonseca at NMN. I never got to talk to Gary again.) I was told that because my move date was within 7 days, I was being transferred to customer service.

The overage really bothered me at first, especially after reading all about these scams. I calmed down a few days later. What really calmed me was the fact that I weighed a box I brought down myself thinking it was about 15 pounds. It actually weighed 40. I was way off on my estimate. I was shown the CAT weight ticket at both ends of the trip. It took 12 days to get my stuff, with 3 boxes and an 8' artifical tree missing. Besides the overage on the weight, my experience was pretty good. The driver and helper at my destination point were extremely friendly and helpful. After talking to them about moving in another 3 weeks to our newly purchased home, out driver, Eli, let me keep all the blankets and packing materials without unwrapping anything. I thought this was a real nice gesture.

I read someplace on these pages where a person had a good experience and suggested being real nice on the phone, and continually telling the dispatcher at AY that money was in hand and waiting. Let me tell you, that philosophy worked well. I called AY every other day while my belongings were in transit. I was as nice as could be, informaing them each step of the way to the bank for the money. I also had them fax a copy of the invoice to me so I had it in hand. I also verified the amount every time I called.

In closing, if you have the help, do it yourself. I'll never have another moving company relocate me. But after reading all the negatives about this comany, I thought I'd put in my 2 cents worth. Hope this gives some comfort to others who may be currently in this situation. All is not lost. (Only a few boxes!)
