Ripoff Report Verified Safe

ok i'm driving down the road around 7 o'clock at night. there's a dark blue truck parked along the road, but the truck was sticking out about a foot onto the road.

the guys back tire was on or a lil over the white line! i would've just moved out of the way, unfortunetly there was a car approaching in the other direction.

my mirror hit the back end of his truck. i exchange insurance info with the guy. he says his insurance will cover the damage and he ADMITS his guilt.

i then call the sheriff's office just to make a report and make sure there's nothing else i need to do.

i contact my insurance and was told to contact his insurance, geico... i told them my problem and what happened and they told me that because the guy wasn't in the truck at the time they arn't claiming responsibility for it and will not pay.

then they say they'll contact my insurance for damages done to his truck! i was like 'hey', they guy was parked in my lane of the road, he was at fault and admitted fault.

they basically said, we don't care. i was told that he may be at fault but they were not responsible.

so now i've got about a few hundred dollar bill, who's gonna pay it? i'm gettin ready to look into law suits.

i mean even though i'm not at fault they still will not pay. something just isn't right about this, am i wrong? any advice or help???

Are You Blind?

In response to the above situation, as a claims
investigator I would have to ask why, if you were
on a one ln each direction roadway, at night, with
an oncoming car, you did not at least brake when you first saw that disabled truck on the side of
the roadway?

The truck was there to be seen and you are required to control your vehicle at all times.

While I agree that the truck driver has some negligence in your accident, too. You were
in the majority.

Anyone with basic claims experience would tell you the same. The bigger question by far is how GEICO handled the damages to the truck.

Since Ohio is a comparative negligence state, we would have been able to place at least some negligence on him too.

I would have handled your claim as an 80/20.
That's 80% on you and 20% on the truck for not having hazards or flares to warn traffic he was
disabled. GEICO did their best to protect you I
am sure.

I suppose you are lucky that the truck driver was not in between your car and his or they
may not have been able to. Especially if you were
carrying the minimum required liability limits
of 12,500/25/7,500. Hope this helps you understand that it is Geico's job to protect you
even when you disagree with us.
