Lawrenceville, GAI had an auto accident in January and my vehicle was totaled. When I recovered a bit from my injuries, I went to the auto dealership where I purchased my car 'Acura Carland' to find out if they do short term leases until I was able to purchase another.
Anyway, the salesman asked me if I purchased the RW21 total theft and loss protection and I remembered I did. He went to get me a copy of the contract and proceeded to tell me that I had a lot of money coming to me.
I immediately took care of all the paper work and faxed to Omni Autos (carrier to the ins) all documents to verify loss of vehicle and the check of approximately $6,000 to Acura Carland.
First of all, I never received a copy of the contract until I went in to the dealership, and I was never told of the so call 'must purchase a vehicle at that dealership and it must be of equal or greater value'. If I were ever told that I would never have purchased this so call gap insurance.
I was going to purchase another vehicle but not a new one like the one I lost because financially I was not going to be able to afford it since things were just not the same after the accident.
They were willing to sell me a used vehicle using that money as downpayment. But after a few weeks my brother gave me a car. Wala, I no longer need to buy a vehicle. So I called the dealership and said to please send me the money because I no longer need to purchase a car my brother gave me one. They refused, and said 'did you not read your contract'.
First they were willing to sell me a car regardless of the equal or greater value than the lost car and now I get nothing. And get this, I didn't know anything about the little details until I told them that I had a car and I didn't need to buy one, to please send me the money. They kept my money and that is fraud.
They took $399.00 from me easily as the purchase of the RW21 insurance and they took approx $6000 when the RW21 paid up the gap. I have bought gap insurance in the past and when I needed the money it came directly to me. Acura Carland lied to me, deceived me, and kept my money and I want it back.
I reported them to the GA State Insurance Commission but I haven't heard from them. These people may a ton of money on me and maybe others, too. Gap Insurance in this case is a rip-off.
People beware, the dealerships make money in the frontend and also in the backend and the consumer is screwed. I WANT MY MONEY BACK, CAN YOU HELP.
