Ripoff Report Verified Safe

I went to Full Spectrum Lending to refinance my mortgage, the balance at the time was $30,000.00. They refinance this property of $67,000.00 and gave me a check for $675.00. The closing attorney give me about 10 documents so that I could RESCIND.

I did just that but in the state of Georgia it look to me that the Truth in Lending means nothing to some Lenders.

Now I have a 30 year mortgage on a house that I/we have lived in
for 25 years and nothing to show for it. And it needless to say that I am in the rear on the payments.

I was tolded in Bankruptcy Court that they (countrywide) would do
a Short Sale(accept less), so for all they have done is give me the run-a-round.

My Cast was DISMISSEd on the 27th. of Aug.,2002 but they still have it where I can't talk to the people in the work-out department.

The Bankruptcy department is in Plano,TX. Any help that you can give would be very much appreciate. Because I don't wont to go back to Bankruptcy Court if you know of a good attorney that to would be helpful.

RESPA VIOLATIONS

The appraisal company that works for Full Spectrum Lending has been given the direction to have the appraisals completed in 5 calendar days, NO MATTER WHAT THE COST IS. An example of this; Home in Hawaii that is a 900 sq ft home, possibly smaller, not on the ocean. The appraiser was paid $1750 for a home valued $54,000 and it was completed in 7 calendar days. Typical payment to the appraiser for this home value should have only been $500 or less. I am not sure how Full Spectrum is showing these charges to their borrowers at the closing table since they are again in example to this: should be charged $1850 or more for just the appraisal. I know that there are rules in RESPA that give a maximum threshold of what borrowers are to be charged, but obviously these rules are in no way, shape, or form being followed.

I work or Have worked with the above subsidiary and have a solution for the Consumer,,,,,,

If help needed to get a workout started all the consumer has to do is contact the cservice dept request to speak with Bankrupcy dept and send a
document by fax from the courts showing dismissal once recieved in 24 hrs can try and do a workout plan with workout dept //////////

also if you are trying to do a short sale it prob will not work due to the value on the property is justifiable____but if chapter 13 bk is filed some attrnys have been know to try and due a cramdown on a lein IE Loan at a certain value you basically cram down the value of the house and if judge (approves) and as long as your bk does not get (dismissed) and does finish and (discharges) then you only pay back the cram down amount....

Hope this information was helpfull at least try a work option first its allot more affordable then attrny fees on a Bankruptcy ch 13 filing

Were you forced to commit to the loan prior to disclosures? Please read!

Please take the time to review the time frame in which you recieved the initial disclosures? I am sure that it was well after you were required to commit to the loan! Which per my understanding that a borrower had the right to recieve disclosures prior to any loan committment. I would love to go into further details, but am fearful of retaliation, which is rampant with this company. So without going into any further details, please look real hard at your previous transaction and see what you come up with. In the mean time, I am speaking with many government agencies and senators in hopes of forcing this company to reevaluate its policies and other behavior. The best thing to do is to educate yourself, becuase Mortgage sales is a very very greedy interest and there are people and companies out there that do not care what your best interests are, just there own.

A CO BUYERS NIGHTMARE- DONT DO IT

In 1996, I helped my mother Sheila A. Hayes by co-signing for a house in Riverside, California. The property address is 1357 Canterbury Place Perris Ca 92571 in the Mayranch Community. Sheila at the time did not have enough earned income to qualify by herself for a home. I was working part time job in 1996, I helped her obtain this property for her primary residence. Not rent out the property without me ever knowing about it.

I went into the Army later in May of 1996 and have been in for 7 years. I never recieved any documentation over the years about this property.

The last paperwork I signed was paperwork from a notary so my mother can assume full responsibility for the property.

The property is from Countrywide Home Loans in Riverside, California. I have been trying over the years to get this obligation off my credit reports and numberous times I have been in complete failure.I have contacted contrywide reguarding this matter and there customer service was unprofessional and uncooperative with my matter, for me calling long distance that incurred charges on my phone bill as well. Since this property is still on my credit reports I am suffering substantial credit prejudice and I am not able to provide my wife a house as a man.

I am also a operation iraqi freedom veteran and I hope I am able to get a VA loan so I can get a house for my wife. I have been resonable with countrywide and I am totally fustrated and mentally anguished over this property being on my credit reports.

In March of 2004, I wrote to countrywide revocating any power of attorneys my mother may have had that I forgot about. Based on FOIA I requested the loan documents and the prelimenary title report policy and I still have not recieved anything from Countrywide.

I currently do not own the house and my mother assumes full reponsiblility for the house. I am not making the payments to the house nor do I get any documentation on the house. I have not lived at this property for the past 7 years due to my military obligation and it's still on my credit reports.

I currently suffer mental anguish and currently suffer substantial credit prejudice. I am not able to finance or purchase a house or anything due to property producing low credit scores on my credit reports. The property stated above is currently being rented out.

My mother and countrywide has been very uncooperative obtaining the necessary documents to clear my name off this obligation. I co-signed at the age of 19 not even knowing about credit or buying a house.

I feel that I was financially misguided and been lied to by my mother Sheila A Hayes. I just want everyone to know that at a young age you can be misguided into making the wrong financial decisions by anyone including your own mother Sheila A Hayes and Countywide Home Loans.

Countrywide / Full Spectrum lending does not have an appraisal company working for them, they own the appraisal company and are forbidden to use any other source . before you have an appaisal done with this company they will ask you how would you like to pay for your appraisal check, visa, mastr card what is your credit cadr # thats the stanard pitch. At a reputable company they will charge you when the inspection is complete at your home and some will fund it in the loan.As ar as price,it should be 300.00 - 500.00 depending on the size of you loan not your house.

This company is very big on retaliation they treat their workers just as bad as its so called customers. One of the hardest companies to get a correct commitment letter,or truth and lending letter from is countrywide full spectrum lending.
they are fearfull that once a customer sees all the fees and points and intrest adjustment they will no longer be intrested.if you recieve one of these letters check it good there will probably be a mistake on it and definatlly do not believe the line, oh its a mistake we will fix it.if you cant obtain one start looking for another lender fast because once you come to the table your stuck and anything goes at that point.
If country wide Full spectrum can do your loan so can many other fine brokers.

What was your original purpose of your refinancing?

According to the information that you have provided for us, it looks like you were trying to pay off some bills!!! that is why your final cash back was only $675. In every state, there are laws and reguilations that would restrict any company to charge a borrower more than certain percentage in fees and points. In your case, it is not possible for any company to charge you over $29k to give you a $67K loan. And as far as your 30 year term, it looks like at the time of your refinancing your were not able to pay the loan back based on a lower term, because your monthly payments would have been alot higher than what you could have paid.
