This is the email I have sent Kings Creek

To Whom It May Concern

I'm writing this to everyone that has any kind of affiliation with Kings Creek Plantation Williamsburg, Va.

We booked a reservation with their marketing staff about 2 weeks ago. The trip was scheduled for Oct,9th,2003. We booked it with a Mr Lewis @ 747-254-8407

At the time of booking I did notice he was short and not willing to disclose a lot of information without me really pushing to get such info. He did inform me after I asked him if we wanted to cancel on what to do. He said if we canceled 10 days prior we could, and that he would not take the funds out until Monday, Sept 29,2003.

On Friday Sept 26,2003 I called Mr Lewis and emailed him informing him we would need to cancel due to having to work. Within the next 3 hours I had checked my bank account and my account had been debited $129.00.

I promptly called my bank's 24 hr line, and they informed me that a debit from Kings Creek Plantation had gone through, that I needed to contact them to have the funds released by to my account. I then called Mr Lewis. I explained him that the $129.00 was already taken out, that not only did we cancel earlier that day, but why did they debit the funds days before they were suppose to ? I then asked Mr Lewis to please call my bank and to release the funds back into my account.

At first Mr Lewis was hesitant, stating the banks were not open , and I then told him, my bank had a toll free 24 hour line that can be called and can we go ahead and get this taken care of tonight while I am on the phone. Only after about an hour of being put on hold while he took care of other callers and helped his staff in his office did he make the call.

Mr Lewis did talk to a representative from my bank and told them that we had canceled and that we were not interested that he was authorizing them to release the funds back to my account. I thanked Mr Lewis for his help and later than evening the funds were back into my account.

On Wednesday Oct 1,2003 I was checking my account, and noticed that there was a debit again in the amount of $129.00 from Kings Creek Plantation . I again called my bank, explained the situation that is when they told me that, yes the funds had been released back into my account on Sept 26,2003 , but the company in mention did not follow through with the paper work . So that is when my bank advised me to call Mr Lewis back and explain to him that though a release had taken place on Sept 26,2003, they still needed to follow through with paper work and now I needed to be refunded.

My husband called Mr Lewis to explain the matter. Mr Lewis told my husband that he had already helped us once, that he was not making any money off of this, and that he was not going to call or check into this again. Only after Mr Lewis had gotten rude and unhelpful with our problem, did my husband tell him that if he did not see that funds were refunded back into my account he would drive up there and collect the money himself. Mr Lewis refused to cooperate, and hung up on him.

My husband then got a hold of a woman in the office named Pam @ 1-757-873-4005 ext. 100. Pam was surprised and was apologetic and said that if I would fax proof that they had charged me, she would be sure to refund my money to me. I promptly faxed the required information to her. But as of today , Oct 5,2003 I have not been refunded.

After finding out how rude Mr Lewis was to my husband, that is when I personally emailed what had happened to the company and that I expected the money to be refunded back to me that we had done everything correctly according to Kings Creek Plantation's guidelines, by giving plenty of notice in canceling and not to mention that my account was debited before it should have been. That is when Chad Davis replied to my email stating my husband was rude and made threats to them, and that they had credited my account days ago , and they were no longer going to help in the matter.

My husband and Chad Davis have exchanged emails several times now, and none are very nice, it was only after being treated rudely did my husband get rude back in the emails.(I think anyone can agree if money was taken from them and a company refused to help,and treated you rudely you can see how anyone could loose their cool.) But in no way what so ever did my husband ever make any threats towards Mr Lewis or anyone at Kings Creek Plantation. My husband simply stated that if we were not refunded he would drive up there himself to collect the money. That was not a threat in any shape or form.

In an email from Chad Davis he claims that they recorded the conversation between my husband and Mr Lewis were they claimed he made threats. Number one, if they did record the conversation without my husband's knowledge, that is illegal, but however they say they recorded it, so I invited them to play it back to provide proof of such threats, but Chad Davis refused. We have also asked Chad Davis if they credited my account please fax us proof. Chad Davis also refused to do such.

Now it has is come to this. Bottom line, I canceled my reservation with Kings Creek Plantation on Friday Sept 26,2003 . I did it well before the 10 days prior. I by canceling my reservation proves, I did not want or that I am not interested in Kings Creek Plantation. I consider any debits/money taken out of my account from this company after Friday Sept 26, 2003 stolen money, and when I see a debit on my account for $129.00 on Wed. Oct 1, 2003,from Kings Creek Plantation. I am sorry but this in my eyes is stolen.

This is my proposal. I expect my money refunded, no more, no less than what was taken from my account $129.00 and I want it no later that Thursday Oct 9,2003. If I do not see this refunded to me I am going to post how this company stole my money to every travel agency in the Williamsburg Va area, I will use the power of the internet to post what has happened and warn others , on message boards, and I will report this to ripoff.com .

I will also contact the Better Business Bureau that Kings Creek Plantation is a member of and if necessary within reason I will seek legal action. I understand you are in the business of making money , but it should be done legally , not by ripping people off.

Mr Lewis and Mr Chad Davis are not only representing Kings Creek Plantation , but they are also representing INTERVAL INTERNATIONAL & RCI , and I am sure that they would not like to have people like that treating potential customers, and the general public the way they have treated us. It not only makes Kings Creek Plantation look bad but INTERVAL INTERNATIONAL & RCI look bad as well.

I hope this matter can get resolved!

Not RCI - You've Got the Wrong Company!

I am extremely disappointed in the Rip-off report implicating RCI and Interval International in some sort of scam. The consumer who submitted this report is pointing the finger at companies completely uninvolved in her problem.

As an employee of RCI I am quite knowledgable regarding Timeshare purchase and exchange. Scott and Lori are attempting to slander unrelated parties in a misguided attempt to 'forewarn others'. King's Creek Plantation is an independent resort that has resort owned rental units as well as sold timeshare units. RCI is an independent timeshare exchange company that offers alternate travel to timeshare owners. Lori and Scott clearly made a reservation directly with the resort. This is obvious as they do not mention owning timeshare. The second clue is the phone number provided in the report. The phone listed in the report is a Virgina phone number. RCI is located in Indiana and II is in Florida, and both companies provide their members with toll-free customer service numbers. RCI is in no way responsible for, or even related to such a reservation.

A consumer who purchases a timeshare resort week will have the opportunity to join a timeshare exchange company at the point of sale. This DOES NOT mean the customer has purchased deeded property from either RCI or II. The member owns deeded property from the resort or developer, RCI is a CLUB the owner joins if he or she wishes to exchange the week purchased for either a different week at the purchased resort, or for a vacation week at another resort altogether. RCI does not become involved in resevations made in resort owned units, therefore is not deserving of being listed as an offender in conjunction with this consumer's issue.

I do understand it is important for consumers to have a forum where frauds can be reported, however it is COMPLETELY IRRESPONSIBLE to list businesses in the title of a complaint which in no way applies to them! Perhaps Lori and Scott should purchase timeshare so they may participate in RCI, but until they do their problem is with the resort at which they reserved their vacation.

Chad Davis/Nelson Lewis

I have recently become an ex-employee of King's Creek Plantation. I sincerely hope that you got your money back. Even though this was a while ago, I thought you should know that Chad Davis and Nelson Lewis are the same person. On several occasions while I worked there, Mr. Lewis told me to tell anyone that was upset by something he had done that it was Chad Davis. I asked him who Chad Davis was and he told me that he was Chad Davis and he told people that to get them upset with someone else. Not only was your money taken from you, but you were lied to as well. Again, I sincerely hope you got everything worked out.

Beware RCI is some way is connected to Royal Holiday See the reports in Ripoffreport.com Key Word ( Royal Holiday).They called last night 18months after they stole $6400 from me after breaching contract.

I have worked for RCI member services for 2 years and love my job! First of all Interval International and RCI are competitors. RCI was created by a husband and wife team 20 plus years ago, they divorced, RCI is owned by ex wife and interval was started by ex husband.

Second, just like booking a hotel, or buying airline tickets, every reservation has a cancellation policy unless you have travel insurance. Most travel insurances will not cover any pre-existing medical conditions, so keep that in mind when purchasing travel insurance.
Acts of god ie natural disasters are not covered by most travel insurances.

Rci weeks cancel policy is, that you get 24 hours, (til the end of business of the following day) to make a change in your reservation. After that it is considered a final transaction, and if you cancel your reservation 61 days or greater before your travel date, you forfeit 109us or 129 canadian or 60 days or less before your travel date you forfeit the entire exchange fee of 149/189 us or 177/244 canadian.

Neither our members nor rci itself is responsible for acts of god, but the cancellation policy is the same. That is why one should purchase travel insurance from an outside vendor if you are concerned.

So RCI didn't rip you off, you just cancelled outside of your grace period on your reservation.

Nicole is exactly right, Chad Davis and Nelson Lewis are the same person, I also worked for King's Creek Plantation and witnessed this fraud many times, everyone involved with King's Creek Plantation knew of this fraud and encouraged it.

But you must know that at no time were you ever speaking to someone who was actually at King's Creek Plantation.
You were speaking to someone at one of King's Creek's marketing entities. The place you were interacting with was located in Newport News Virginia,in the Oyster Point area.

King's Creek hires off site telemarketing companies to do It's dirty work, and then assumes no responsibility for their actions, just as in this case. When these telemarketing companies get caught and shut down, they simply move their location and change their names and do it all over again.
