We are undergoing a foreclosure with Ameriquest Mortgage/Amc Mortgage/CitiResidential Lending Inc. All the same company!! We sent our mortgage payment into AMC for the month of June 2007. We have been with Ameriquest since 2003 never missing a payment until are June payment was returned to us without an explanation. Then we get a letter from them saying that once again they are transferring are mortgage to Citi Residential Lending. After a sigh of relief we said ok, this mess is finally going to be fixed and we will be able to get back on track with our mortgage payments. Well, that was not to be. The door bell rings and there is a gentlemen standing at our front door with summons papers from Ameriquest Mortgage.
Neatly enclosed in the papers was a bright green paper that says and I am typing this word for word "Deutche Bank National Trust Company(Yes, yet another company) As trustee of Ameriquest Mortgage Securities Inc. Without Recourse does NOT want you to lose your property. There are programs in place that may be available to you to help you avoid losing your home and your investment."

It also goes on to say "If you are interested in discussing alternatives to foreclosure, call 1-800-214-4826,Extention 201 or 204, Monday-Friday between 10:30a.m. and 5:00p.m. and ask to speak to a Home Retention Specialist. Well, she was not in her office and we are still waiting for a call back, but we are not holding our breath.

People, please hear my plea. The only thing my husband and I have left for our old age is our home we worked our entire life for and now we are about to lose it. Sad, does not describe the ache I have in my heart as I type this report. Do not let this happen to you. Go with a good reputable mortgage company.

My husband and I have read some of your horror letters so we thought we'd inform some of you that you are not alone. It's just so sad that the good Ol' U.S.A. has come to this. It's all about the money folks! And if your not one of the fortunate ones who was born with a silver spoon, Well, if you happen to see an old lady and man living under a bridge, it just might be us. Stop by and say hello.

I don't know what you can do when there is a negative credit report filed. It sure makes it nice for Ameriquest/CitiResidential doesn't it? They got us now!! The people who they scammed are stuck with them for the duration of their loans, because we now have a red mark on our credit report. Another slap in the face.

Especially when they (meaning Ameriquest) could have helped their clients avoid problems. It shows that they can easily find the credit reporting agency, but don't have the ability or tact in other avenues. What I am saying is, when it's appropriate let's act like a bunch of uneducated jerks. But when it serves us, and makes the money flow our way, we suddenly get it right.

It's ALL about the money. The big machine is too big for us little guys. I regret the day I put my pen down on that piece of paper and signed my name.

Please, if there is anything I can tell the next generation is this. Don't sign your name to any documents until you read, re-read, discuss, and above and beyond, research the company before you sign. And if possible get a local company, some warm body you can actually talk to face to face.

We have been battling with these people for months now. And as the days and months go by, more money for them. How long does this process take? Does any one know how much longer my husband and I need to wait? And the worse part is this wasn't our fault!!!! They sent our check back to the bank. Is this a down right scam or what?? Wow, this should not be happening, especially with all the agencies we have today. Where the heck is an agency for tax paying people being robbed by big companies? To be conscious that you are ignorant is a great step to knowledge.

I too was/am a victim of Ameriquest/Citiresidential. I cannot get another mortgage because of how they reported information on my credit report. As of now, I'm not sure where I stand with my mortgage. I also got behind in June and the payment was returned in July 2007. I have been trying to get a repayment plan ever since. Hi Folks
Thank you for your reponses to my plight with Ameriquest/Amc/Citi Residential. Our update with this fiasco is at a stand still after almost 3 months! They are waiting to get our $2500 and then the fun will begin. As I read Leslie's response I feel like I want to cut and run. But I won't.
I have contacted the Florida Attorney Generals office and they are looking into the problem we are having with Ameriquest. Although I want to be optimistic, after dealing with these people it is hard to visualize a happy ending.
I only wish you all the best of luck, but when you are dealing with deceptive people it is hard.We hired a "consulting company" for $1500.00 and they are working on a solution with Ameriquest/Amc/Citi Residential, but I am not going to hold my breath. According to an Attorney we talked to, he tells us we could have probably done the same thing. The only problem, we could never get anyone to talk to us regardless of who we called from these companies.
My husband even tried to get someone to admit they received our mortgage payment and acting like a second grader they said"no we didn't" but they returned it to the bank!
I appreciate the info on this James Brantley. When I read the e-mails I received I was shocked. How could this happen to hard working American people?
There has to be a law maker out there that will read these rip-offs and do something about this. I have written letters and everyone needs to do the same. Write to your congressman, anyone who will listen. One voice, is many. All for one and one for all!! Don't take this sitting down. This company needs to be stopped.Any addresses you come across send them to me I will write a letter a day if I have to.Thank you and thanks to Rip-Off reports, keep it going. Sybil

He took the money and ran, People, I have been Emailing him and bugging him for he is the founder and thefore responsable and I have pushed some buttons on this guy, I urge you all to do the same. My private attorney is going after these people on a flat no up-front fee. Don't settle for the class action lawsuit. Here is his contact info:

Firm's Lending Tactics Investigated

On the same day that the White House announced that President Bush is nominating California billionaire Roland E. Arnall to be ambassador to the Netherlands, the company he controls said it would set aside $325 million for a possible settlement of allegations of predatory lending tactics.

Arnall's company, Ameriquest Mortgage Co., is being investigated by regulators in 30 states. A $325 million settlement would be one of the largest ever in a predatory lending case. Ameriquest is the nation's biggest privately held mortgage company. The company, which is in negotiations with a group of attorneys general to resolve the investigations, said in a filing with the Securities and Exchange Commission yesterday that the amount "represents the company's best estimate of its maximum financial liability for a comprehensive resolution of this matter."

Arnall is the firm's principal shareholder. He, his wife and their companies have been the biggest political contributors to Bush since 2002.

Speaking about the ambassadorial nomination, White House spokeswoman Erin Healy said: "The president . . . feels Mr. Arnall is well qualified for the position. He had a long career in the private sector and has contributed a great deal to his community."

In a written statement, Arnall said he was "humbled and honored" to be nominated.

Ameriquest is facing complaints of wrongdoing from coast to coast, with thousands of customers seeking restitution. The Connecticut Banking Commission settled cases two weeks ago for $7 million, and a private class-action lawsuit in California, representing about 62,000 claimants, was recently settled for as much as $50 million.

"We've made a lot of progress, but the talks are continuing," said Connecticut Attorney General Richard Blumenthal, who is in the group negotiating with Ameriquest. He said his office had received hundreds of complaints, "numerous and long-standing," about the lender.

In response to requests for comment, Ameriquest yesterday issued a statement that said it "continues to be engaged in discussions with a number of state attorneys general and regulators about the company's business practices. We are focused on resolving the issues under discussion with these agencies and hope to reach a reasonable resolution that is fair to our customers and fair to the company. We do not comment on the specifics of regulatory or legal matters."

In depositions, Ameriquest customers have alleged that they were promised good loan terms but instead got high rates, sometimes higher than they had previously been paying; that their incomes were overstated so they could qualify for the high-price loans; that appraisers overvalued their homes so they seemed valuable enough to secure the loan; and that they learned only after closing that they would be required to pay steep prepayment penalties if they sought to move to other lenders.

Patti Thompson, a secretary, was paying 6.1 percent on the $175,000 loan on her Minneapolis home when a pop-up ad on her computer offered the chance to reduce her monthly payments. She clicked on the ad, filled out a questionnaire and 24 hours later, she was contacted by an Ameriquest employee, who said he could lower her monthly payments and pay off her high-interest credit cards. Within about a week, a closing officer came to her home with documents for her to sign.

The hastiness of the transaction raised "red flags" for the Thompsons, and they tried unsuccessfully to cancel the transaction. They went to another lender, who reviewed their documents and told them their interest rate had been increased to 9.1 percent and that they had been charged $17,000 in settlement costs, bringing their new loan total to $193,000. Their monthly payment rose from $1,300 a month to $1,700 a month. The company did not pay off the credit cards, according to Thompson, and she and her husband filed for bankruptcy in April.

An Ameriquest spokesman said the company would not discuss specific cases but "works very hard" to resolve problems.

Thompson was stunned to learn that the White House would consider Arnall for such a prominent post

Dear Sybil:

This is exactly why the financially desperate Citi Residential hired arch mortgage fraud perpetrator James Brantley who led Ameriquest to mammoth judgments due in large part to criminal fraud. Citi, faced with historic write offs and losses elected to sacrifice their reputation and risk criminal prosecution by hiring the second most infamous mortgage fraud perpetrator in America: The infamous James Brantley.

I will offer only a layman's non professional opinion:

1) I think you should go ahead and pursue the non foreclosure option. *Document* everything you do especially the date and place you send your inflated attorney fees and catch-up costs. It is here that James Brantley of Citi Residential will attempt to shamelessly gouge you.

2) Pay special attention to your escrow and corporate advances and suspense fees; both credits and reversals and especially the DATES of application or misapplication.

3) After you have done this either file an individual petition against Citi (I suggest you include James Brantley; he is a known fraudster) or join a long range class action against Citi Residential.

TIP: All indications are that Citi Residential will fold in 2008 due to fraud and colossal financial losses but please understand Brantley and Citi can still foreclose on your house again through further illicit manipulation of their highly incriminating escrow and corporate advance account(s).

I just want you to know what is in store for you. I have been fighting foreclosure with these people for about the last 4 months.

The home retention specialist is going to try to set you up an outrageous payment plan. See my house payment is only $595.16 a month. My husband is self employed in the concrete business and last winter we got 2 payments behind. I sent a payment in and then 2 weeks later sent another payment in. Then it was time for our regular payment to be made(on schedule). I got a letter from Western Union saying that AMC had sent not one but both payments back to me. I called and was told they would not accept anything except the total amount that was due. (the 2 payments) which I sent but not together. So now since it takes 3 weeks or so to get the money back from Western Union it put us at 3 payments behind because they sent them all back. So now I get a knock at the door and get served foreclosure papers just like you. With the information to contact the home retention specialist. I did so. We had to come up with $2,500 with in the next week and then our monthly payment would be $1,090 a month for 8 months. Well the 3 payments that we were behind only add up to $1,785.48. This is not the worst part. We agrred to this because it was the only way to get it out of foreclosure. We paid the $2,500.00 down made our first payment of $1,090 and the 2nd payment we were 2 days late with, but get this I sent $1,800 which is $710 more than the payment amount to be applied to our next payment. They sent the $1,800 back to me. I called in to them (AMC - Ameriquest) & was told I would have to start another payment plan all over because the 2nd payment was 2 days late. SO there offer now is put another $2,500 down and our payments will be $1,394 a month. I am not doing it. This can not be legal. I have not figured out what I can do yet. They say it is for this late fee & that fee & lawyer fees & whatever. Now I am running into my loan was a home equity loan, they have got it appraised so high & loaned us so much on it I am sure no one is going to finance it.

Besides they just sent me a letter saying that as of Nov. 1st my new payment will now be $782 because the interest rate is going up. Which was not even as low as they said it would be when we got to the closing. I hope you do not loose your home as I have had mine for 14yrs. (only with them for 2 yrs.) and do not want to loose mine either. I brought both of my boys home from the hospital here it is the only home they have known. GOOD LUCK!! I pray for you!
