Ripoff Report Verified Safe

I joined a Lady of America Fitness center with a 1 year contract. Along with the 1 year, there was an additional 2 years available for renewing at the same price. After joining, I read some bad reviews on this site, or one similar about National Fitness (the previous company name that handled the gym's financial stuff) and the problems that people were having when they tried to cancel, and not renew, after their contracts were up. So, when my year was over, I sent a written notice of non-renewal. I sent this letter CERTIFIED, so there was no question down the road. Oh, but was I wrong! They have tried to get around this in every way possible. I have had to EMAIL bank statements proving my EFT withdraws from my account, because they have no records showing I paid the dues for 12 months. Well, if they are doing automatic withdraws, isn't it their responsibility to take the money?? So, the emails were somehow never received, so I then FAXED over copies with, again, another request for a cancellation confirmation letter. I then receive, not a confirmation letter, but an email stating the EMAIL I sent could not be connected with any of their accounts, and asked if I would AGAIN send my account number with the bank statements (FYI:my member number was in the subject line of the email). So, this I did. I actually sent this email repeatedly, about 5 or 6 times. Waiting patiently for my cancellation letter, I decided to check my bank account, and sure as shit, they EFT'ed my account for a 13th month! At this point, I am getting ready for battle. Please do not do business with ABC Financial or National Fitness. They are scammers!! I will also be going to the gym and making this public knowledge to any prospective gym goers...you bet your ass!!

just read it.

everything that you people scream about on the phones with abc financial CSRs is just a waste of time. anything that this company does in error is resolved. they wouldn't do something like this for fun. if thy draft your account and weren't supposed to, send them proof so they can fix it. if your credit card was declined but you had funds available, prove it. if you contract wasn't supposed to automatically renew, prove it. how hard is it. you people work out, you cant be that lazy. do what the contract says and you won't have any problems. no one is special, people wont make exceptions for you, they will do their job as they are trained to do them. laws do protect them and these contracts.

your contracts are written by people that know what they are doing, i assure you. anything you have questions about is in the contract, usually very clearly. Most people cry and say, 'they didn't tell me that when i signed up.' guess what, they don't have to! others say, 'i guess that was in the fine print.' the whole damn thing is in fine print! if it was all in bold print you would have to flip through pages and sign a book, making you feel even more uncomfortable about signing up for, 'just a gym membership.'

The fact of the matter is when you signed your name, you signed it stating that you understood what you were signing. this is what we call in the business world as a legal business agreement. your contract will say things like, 'this contract is non-cancelable unless under the terms provided above,' or, 'if, in the event, this facility temporarily or permanently closed the buyer is bound to the obverse terms. this agreement is transferable to an affiliate within 5-10 miles of the facility of origin.' other things to look for are, 'i understand that this term agreement will automatically renew to a month to month basis at the above rate, not to exceed the monthly payment amount of $__.__ for __ months until the buyer provides a written notice delivered to the address below by registered/certified US mail no fewer than thirty (30) days prior to requested cancellation,' and my personal favorite, 'this signed agreement from the buyer is legally binding and i understand that non-use of facility does not relieve me of responsibility for due payments to the seller.' in this print you can see it says, 'do not sign this agreement until you have read its terms or if you see any blank lines/spaces.'

save you own money and never sign without reading people, come on. these people are professionals. they're rich, they don't need your money that badly, your health clubs do. most of the people that complain are mad at themselves because someone verbally told them that everything will be ok. since when do people in this country trust sweaty stranger?

fyi: when people complain to the better business bureau, they don't investigate. they don't send a copy of your letter to the company. the make a copy for them selves and send the VERY letter you sent to them to the company that you complain about. then abc financial makes a copy, notes it where necessary, and shreds the ORIGINAL letter you sent trying to accomplish something, when actually all you did was kill a tree.

if your health club closes down and you signed an agreement with the club, your membership will be transfered unless they have no affiliates in the area. if you call your attorney and try to sue, or if you call the attorney general, all you did was waste someones time. they request a copy of the contract you signed, read it, see YOU didn't read it but still signed it, they find out nothing illegal was done, they throw out your case. you are lucky if you even hear from anyone just to tell you that you DON'T have a case.

you people have a good life. next time join a gym that doesn't have contracts, only such a gym doesn't exist.

Its funny this person stated this company is rich and don't need any of our money. Wonder how they became rich..take the millions of customers they bill for and multiply that by a service fee of 19.50 (that they can slap on for any reason they come with) and see what u come up with..that's all it takes to become rich...

Anyway, they never stated that my visa check card was declined or that I had insufficient funds in my checking account, the only excuse they could come up with for scamming me was that my bank did not release the funds--twice, bunch of bull. Its mighty funny they released the funds for 11mos to the APEX billing company on time every month, but now that ABC financial (crooks) took over, my bank mysteriously won't pay them, wow!! Not to mention, when ABC decided to include a fee and process my payment again, the bank finally released the funds...yeah RIGHT!! How come my bank didn't hold that payment as well--this is my proof that they are scams in my case--not talking about others--yes the other folks should have read their contract, I don't have a contract issue--but how do YOU PROVE a so called computer issue--they can say all day long the bank wouldn't release the funds, how do you prove that--YOU CAN'T! The bank says the funds were available and ABC never tried to debit my account--so I guess they will give me my money back--we'll see--but come on, you can see shady written all over this!


I learned from this....my contract is up now. I let the gym call ABC financial to cancel my account...because I paid the gym membership in full with cash. There is no renewal and there is no contract. Prior to doing this, I called ABC took myself off auto withdrawal, they will send me a coupon book (which I don't need now)
I cancelled the credit card they have on file so they cant debit my account in the future--if they do--I can sue-- Thats how you kill a bird with that STONE!!
