I recently bought a Hart Cart and realized all this stuff about a lawsuit after I made the purchase. I figured I would not get my product so called with concerns. I was assured of a date and it came and went. I called again and got a ship date and it did ship and I have received the cart and I am very satisfied, for the money you can not go wrong.I would just like to add that if Mr. Hart is such a crook, how come he has a great record with the BBB ?? The only problem I can see is that he has a hard time keeping them in stock.I think there is a little more to the lawsuit than people are willing to tell, but no matter how you look at it I am very pleased with my purchase !!

is being sued for unspecified amount for Civil Fruad, Breach of Contract, Misuse of Appropriated Funds, and Criminal Conversion.

The suit alledges Plaintiff paid $26,600 for product and never recieved it.

Remember, this is alledged and not proven.

Make no mistake, this is an actual lawsuit filed in the court listed above. I called and verified as should anyone else attempting to do business with Hart Marketing Inc, or Shawn Hart.

Prosecuters office did acknowledge reports filed against Hart Marketing Inc there investigator had been reviewing the case but with no outcome at this time.

Several Filings have been made and no verdict in suit at this time.

I saw somewhere that was a class action suit getting started against Hart Marketing Inc. If anyone has more solid info, I would like the info posted so I may contact the plaintiff in the class action suit.

Jealously is an ugly animal. To all who read this response: This is a simple matter of "sore loser" syndrome. I have personally built my company from scratch to what it is today. We have never cheated anyone in 14 years of business, and do not intend to start. 100% of these allegations were fabricated by an individual who is broke, desperate, untruthful, and obviously jealous of our continued success. This person is not smart enough to know that his unwarranted actions are being traced and that he will be held personally responsible for his actions. We have sold 1000's of products through various mediums including the internet, and have had not one complaint to date, until we shut down a would be competitor who was working out of a phone booth 15 miles from my office, and trying to steal our clients through fraudulent acts including theft, and criminal conversion. We maintain a "bricks and mortar" business with several full time employees for both sales and service. We have real overhead and pay real taxes. Unlike non-existent internet business people we accept full responsibility for our actions and product.

We also maintain product liability insurance to protect ourselves and our consumers from defective products. Anyone who knows me and/or my family personally will tell you that I have worked hard to honor my word and to treat others how I want to be treated. This uneducated person (you know who you are) should be in jail with his brother for theft and fraud. Warning to all, Parts are not available through hartmarketinginc.com shawnhartinc.com hartcarts.com or any other place this Hart Marketing guy owns. It's a total scam.

Sure he can sell you a cheap made utv, but when it breaks he can't get parts.

I have 2 utvs i purchased from him.

One has a cracked gear box, can't get the part and it's been 3 months waiting.
Other is broken transmission housing straight out of the crate. He claims i did it when I have pictures of the thing broke and still factory bolted to the crate with the plastic and all still on the thing.

If you call, ask for Shawn Hart, See if he will actually answer your phone call if there is a problem. I bet he will talk to you to sell one, but when it comes to parts or issues, he sends you to a place in Winchester, Indiana for service, then this guy says No parts, he has to order them.

Be very very carefull. We found out after our purchase and ripoff that he owes money to everyone in the world.

The IRS is after him for fruad from my sorces, there's a another person that paid for a utv that still hasn't received them. He's been waiting for 3 months and can't get his money back.

We have contacted the local sherriff's dept and they have started there own investigation. With there help, we may be able to get our money back.

Hart Marketing, Inc. always appreciates the comments of our customers and has never failed to try to satisfy there needs or resolve there complaints. Our company is a member of the Better Business Bureau and we have not had any complaints at all about this issue.

On further investigation to this report, we have concluded that this individual, Scammedbyshawnhart, from New York, NY has never been one of our customers and has never bought from our company. In fact, we are certain that this report is posted both falsely and maliciously to deface our company. We have reviewed our records and have not received a chargeback on any Hart Cart sale to date.

Although there is little we can do to restore the credibility this person has sought to destroy, we will continue to provide excellent customer service to each new and prospective buyer.
